The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, November 18, 2008 beginning at 7:30 p.m. Members present were Samuel Butcher, Dianne Hearn, Thomas Gill, Barbara Kelley, Holly Morris and Corey Wisneski. Chairman Joseph Messina was absent. Dr. Gill was Acting Chairman. Also present was Joe Grady, Conservation Administrator.
PH, SACK, 54 OCEAN RD. NORTH, ADDITION, SE 18-1493
Representing the applicant was Doug Friesen from Duxborough Designs. The proposed project was construction of a second story addition and reconstruction of the existing deck. The site is located on a barrier beach and area subject to coastal storm flowage. The existing dwelling sits on a full foundation. The issue is whether the proposed addition is a substantial renovation to the dwelling to trigger the requirement that the structure be placed on a pile-type foundation. As mitigation, the applicant proposes to decrease the amount of impervious coverage on the site. The Commission had questions regarding the calculations to determine if the proposed renovation is less than 50% of the value of the structure and asked the applicant for more detail and documentation that there are no significant renovations
being done to the existing first floor. Ms. Morris made a motion that was seconded to continue the public hearing to December 2, 2008 at 7:50 p.m. The vote was 6 – in favor; 0 – opposed. Motion passed.
PH, DUXBURY CONSTRUCTION, 34 FRIENDSHIP LN., S.F. DWELLING
Representing the applicant were Freeman Boynton and Kevin Leary. The proposed project is to tear down the existing dwelling and construct a new single family dwelling. There is to be no net gain of coverage within the 100-foot buffer to the wetlands. The Commission asked the applicant to implement a plan to control the phragmites. No DEP file number had been issued. Ms. Morris made a motion that was seconded to continue the public hearing to December 2, 2008 at 8:05 p.m. The vote was 6 – in favor; 0 – opposed. Motion passed.
ADMINISTRATIVE MATTERS
The Commission reviewed requests for Certificates of Compliances for SE 18-1447 (661 Washington St.); SE 18-1415 (549 Bay Rd.); SE 18-1408 (Berrybrook); and SE 18-1397 (91 Gurnet Rd.). The Commission postponed action on the request for SE 18-1447 since the landscaping is not complete. Mr. Butcher made a motion that was seconded to issue Certificates of Compliances for SE 18-1415. The vote was 6 – in favor; 0 – opposed. Motion passed.
Ms. Kelley made a motion that was seconded to issue Certificates of Compliances for SE 18-1408. The vote was 6 – in favor; 0 – opposed. Motion passed.
Ms. Hearn made a motion that was seconded to issue Certificates of Compliances for SE 18-1397. The vote was 6 – in favor; 0 – opposed. Motion passed.
Mr. Grady reported on an incident regarding cutting wood on the Camp Wing Conservation Area without permission from the Commission.
Mr. Grady reported that he had sent a letter to a professional dog walker who was using town-owned land and conservation land for her private business without permission.
The Commission reviewed draft minutes of the meetings on 8/19/2008 and 9/19/2008. Mr. Butcher made a motion that was seconded to approve the minutes of the meeting on 8/19/2008 as presented. The vote was 4 – in favor; 0 – opposed; 2 – abstentions (Hearn, Morris). Motion passed.
Ms. Morris made a motion that was seconded to approve the minutes of the meeting on 9/9/2008 as presented. The vote was 6 – in favor; 0 – opposed. Motion passed.
