Conservation Comm. Meeting - 2008/04-15
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, April 15, 2008 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Thomas Gill, Dianne Hearn, Barbara Kelley, and Holly Morris.  Samuel Butcher and Corey Wisneski were absent.  Joe Grady, Conservation Administrator was also present.

PM, HISTORIC O’NEIL FARM, INC., AUTUMN AVE., TRAIL FOOTBRIDGE
Representing the applicant was Pat Loring.  Also present for the discussion were Robert and Myrna Walsh from 280 Autumn Ave.  Ms. Loring reported that the applicant has received a $25,000 grant from the MA Conservation & Recreation Department Greenway Program and would like to construct a walking trail with a footbridge over an intermittent stream.  All the work will be done by hand.  Ms. Walsh questioned the access for construction of the footbridge and noted that the right-of-way shown on the plan was not available for access by the applicant.  Mr. Messina indicated that the issue regarding right of access was between the two property owners and not pertinent to the issues regarding the wetlands.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the construction of the walking trail and footbridge.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, SPOOR, 80 MARSHALL ST., PIER
Representing the applicant were Richard Johnson from Amory Engineers, Michael Spoor and Joseph Lojko.  Mr. Johnson submitted a revised plan that showed a shared pier for the properties at 80 and 84 Marshall Street.  The location of the pier was along the property line and included two gangways and two floats.  Mr. Messina questioned the configuration of the floats and Mr. Johnson explained that the configuration was to allow for sufficient boat usage for each family.  Ms. Morris noted that the Commission’s Rules & Regulations currently refer to only one float.  Mr. Johnson referenced the Zoning Bylaw for shared piers that allows two floats.  (The Commission noted that the regulations will need to be updated to address shared piers.)  Mr. Grady asked the applicant to have the plan stamped by a land surveyor and to show the property lines for both properties and the Land Court ruling.   No DEP file number had been issued.  Dr. Gill made a motion that was seconded to continue the public hearing to May 13, 2008 at 7:35 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, ANDERSON, 46 CRANBERRY DR., SE 18-1466
The DEP file number was issued.  Dr. Gill made a motion that was seconded to issue the Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed a letter dated 4/4/2008 from Marta Nover of Nover-Armstrong Associates Inc. regarding a revision to the plan for Orders of Conditions SE 18-1412.  Ms. Armstrong from Nover-Armstrong Associates explained the revisions and indicated the area of lead paint contamination had expanded closer to the pond, but the scope of work had not changed.  The revised plan established a new siltation barrier and limit of work line.  Dr. Gill made a motion that the Conservation Commission accepts the revised plan and proposed changes as being within the scope of the original Orders of Conditions for SE 18-1412.  The vote was 5 in favor; 0 – opposed.  Motion passed.
