The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, April 1, 2008 beginning at 7:30 p.m. Members present were Chairman Joseph Messina, Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Holly Morris and Corey Wisneski. Joe Grady, Conservation Administrator was also present.
PH, ANDERSON, 46 CRANBERRY DRIVE, ADDITION
Representing the applicant was Alan Vautrinot from Vautrinot Land Surveying Co. The proposed project is construction of a garage addition and deck. The project conforms to the regulations. Excavated material will be placed in the front yard away from the wetlands. No DEP file number had been issued. Mr. Butcher made a motion that was seconded to continue the public hearing to April 15, 2008 at 7:45 p.m. for the file number. The vote was 7 – in favor; 0 – opposed. Motion passed.
CONT’D. PH, TURCOTTE, BAY RD., SE 18-1461, DELINEATION
Representing the applicant was Jennifer Turcotte. The Commission’s consultant, Lenore White from Wetland Strategies was also present. Ms. Turcotte explained the revised plan. Ms. White agreed to the delineation as shown on the revised plan. It was noted that the purpose of this hearing was only to determine resource areas, that no work was being proposed. Don Foster, 566 Bay Road had a question regarding the intermittent stream. Audrey Lemieux, 590 Bay Rd. reported there were eastern box turtles on the site. The applicant noted the site is in a Rare Species Habitat Area. Dr. Gill made a motion that was seconded to accept the delineation of wetland resource areas as shown on the revised plan dated 3/29/2008. The vote was 7 – in favor; 0 – opposed. Motion passed.
CONT’D. PM, SULLIVAN, 307 BAY RD., PORCH, DECK
Representing the applicant were Christopher and Patricia Sullivan, David Gould, and Joe Webby from Webby Engineering. A revised plan was submitted that showed the coverage at 14.9%. The project conforms to the regulations. Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The vote was 7 – in favor; 0 – opposed. Motion passed.
CONT’D. PH, ULICH & PLANK, 174 & 178 MARSHALL ST., SE 18-1464
Representing the applicants were Paul Brogna from Seacoast Engineering, Shawn Dahlen and Jeff Plank. As requested, Mr. Brogna submitted a plan stamped by a land surveyor and responded to the comments from Division of Marine Fisheries. As proposed the shared pier does not cross over salt marsh, but if the property owners proposed individual piers those structures would be located over salt marsh. Ms. Morris questioned why the owners needed the pier and had concerns regarding scouring and impacts to wildlife. Mr. Butcher had concerns regarding aesthetics, recreation and habitat issues as well as precedent for permitting structures on a coastal beach. It was noted the 8’ x 8’ platform does not conform to the regulations so the Commission required the platform to be 6’ x 8’ with no boxes
hanging off the structure. Mr. Butcher made a motion that was seconded to issue Orders of Conditions for the shared pier with the provision that the platform 6’ x 8’. The vote was 7 – in favor; 0 – opposed. Motion passed.
ADMINISTRATIVE MATTERS
The Commission reviewed a funding request for summer interns to be paid from the Conservation Fund for land management. Dr. Gill made a motion that was seconded to approve the expenditure of $9,400 for Fiscal Year 2008 and $9,300 for FY 2009 for a total of $18,700 from the Conservation Fund for interns. The vote was 7 – in favor; 0 – opposed. Motion passed.
The Commission discussed the issue of a float stored on salt marsh off King Caesar Road. Ms. Morris made a motion that was seconded to issue an enforcement order to Alexander Stohn to remove the float from the salt marsh. The vote was 7 – in favor; 0 – opposed. Motion passed.
The Conservation Administrator reported on illegal all-terrain vehicle activity in the Thaddeus Chandler Sanctuary off Valley Street.
