Conservation Comm. Minutes - 2007/08-07
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, August 7, 2007 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Samuel Butcher, Thomas Gill, Barbara Kelley, and Corey Wisneski.  Dianne Hearn and Holly Morris were absent.   

PM, THOMAS, 15 QUAIL RUN, SITE WORK
Representing the applicant was Chris Phillips.  The proposed project was to re-grade a portion of the lawn in the buffer to salt marsh and remove by hand old landscaping debris dumped on  the salt marsh.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the landscaping project provided there is no lawn expansion.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, FANTONI, 408 BAY RD., SE 18-1413
Representing the applicant was Robert Bertolli from JC Engineering.  The proposed project was demolition of the existing dwelling and construction of a new single family dwelling.  The Commission questioned the coverage ratio and setbacks of the foundation to the wetlands.  As proposed, the project does not conform to the regulations.  The Commission asked the applicant to revise the foundation plan to conform to the regulations.  Mr. Butcher made a motion that was seconded to continue the public hearing to August 21, 2007 in order for the applicant to revise the plans.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, HOUSER, 5 EAST PINE POINT RD., S.F. DWELLING, SE 18-1425
Representing the applicant was Stanley Humphries from LEC Environmental.  The proposed project is to demolish the existing dwelling and construct a new single family dwelling.    The proposed project is on a barrier beach and land subject to flooding.  The structure will be constructed on pilings.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, REED, 120 PATTEN LN., RIPRAP WALL REPAIR

PH, DELPRETE, 1 SPRING ST., BEACH REPAIR
Because the three Notices of Intents pertained to storm damage repair of abutting properties the projects were discussed simultaneously.  Representing the applicants were Paul Brogna from Seacoast Engineering Co. and Stanley Humphries from LEC Environmental.  Mr. Brogna described the project which is to rebuild the storm damaged section of the riprap wall and to rebuild the sacrificial dune and install a sand drift fence.  Issues raised by the Commission included more information on the core envelope, planting plan, location of limit of work and specifics on construction activities such as access to site and truck traffic.  The Commissions also asked the applicant to stake out in the field the loction of the proposed work.  Several abutters spoke about the beach access easement of the neighborhood.  No DEP file numbers had been issued for the three projects.  Mr. Butcher made a motion that was seconded to continue the public hearing for 120 Patten Ln. to August 21, 2007 at 8:40 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.  

Mr. Butcher made a motion that was seconded to continue the public hearing for 72 Goose point Lane to August 21, 2007 at 8:41 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

Mr. Butcher made a motion that was seconded to continue the public hearing for 1 Spring St. to August 21, 2007 at 8:42 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, MCLAUGHLIN, 685 WASHINGTON ST., ADDITION, GARAGE
Representing the applicant was Paul Brogna from Seacoast Engineering Co.  The proposed project is to raze and rebuild the existing addition, construct a garage and a retaining wall in the buffer to salt marsh.  A revised plan was submitted that relocated several of the wetland flags.  The Commission asked for more specifics regarding the retaining wall and foundation plan for the garage.  Mr. Butcher questioned the location of the shared septic system and asked that it be shown on the site plan.  No DEP file number had been issued.  Phillip and Susan Caliendo of 670 Washington Street commented on the location of the proposed driveway and garage.  Mr. Butcher made a motion that was seconded to continue the public hearing to August 21, 2007 at 8:50 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, MCKENNA, 427 BAY RD., GARAGE, SE 18-1422
The applicants, Lorrie and Bill McKenna were present for the discussion.  The proposed project is construction of a garage in the buffer to bordering vegetated wetlands.  The Commission questioned the percentage of coverage and asked that the applicant’s engineer show existing coverage and proposed coverage either on the plan or in a letter.  The Commission also requested more detailed information on the proposed foundation.  Mr. Butcher made a motion that was seconded to continue the public hearing to September 11, 2007 at 7:55 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PM, WEBSTER PT. LLC, TREMONT ST., ROADWAY, UTILITIES
Representing the applicant was Steven Silva from Coler & Colantonio.  A revised plan was submitted.  Mr. Silva indicated that roadway construction would stay out of the 100-foot buffer to the wetlands.  Mr. Messina questioned note # 4D on the plan and asked that it be removed from the plan.  Dr. Gill made a motion that was seconded to issue a negative determination for the construction of the roadway and associated utilities with the stipulation that no work is performed within the 100-foot buffer and the applicant will submit to the Commission a revised plan that deletes note #4D.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, COMMANDER, 45 SEABURY POINT RD., SE 18-1423
The DEP file number had been issued.  Dr. Gill made a motion that was seconded to issue Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
Dr. Gill made a motion that was seconded to approve the conservation restrictions for the O’Brien, Nudd, and Loring bogs.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

Mr. Butcher made a motion that was seconded to reaffirm the enforcement order issued to Duxbury Farms for violation of the Orders of Conditions SE 18-1315 for cutting vegetation beyond the limit of work.  The vote was 5 – in favor; 0 – opposed.  Motion passed.
