Conservation Comm. Minutes - 2007/02-06
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, February 6, 2007 beginning at 7:30 p.m.  Members present were Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry, and Holly Morris.  Joseph Messina was absent. Joe Grady, Conservation Administrator was also present.  Since Mr. Messina was absent, Dr. Gill was Acting Chairman.  

EXECUTIVE SESSION – POTENTIAL LAND ACQUISTIONS
At 7:30 p.m. Ms. Kelley made a motion that was seconded by Mr. Butcher to go into executive session.
Motion:  to go into executive session to consider the taking, purchase, exchange, lease or value of real property which, if discussed outside of this session could have a detrimental effect on the negotiating position of the governing body.  
Vote:  A roll call vote was taken:  6 – in favor; 0 – opposed.  Motion passed.  

At 7:50 p.m. Ms. Kelley made a motion that was seconded by Mr. Butcher.
        Motion:  to reconvene into open session.
        Vote:  A roll call vote was taken: 6 – in favor; 0 – opposed.  Motion passed.

PH, CARROLL, 91 GURNET RD., FOUNDATION
Representing the applicant were Attorney William York and contractor Dick Rockwood.  Mr. York explained the project which was to reconstruct the dwelling on a new open pile foundation.  Mr. Rockwood indicated that the piling design would be finalized after test borings were done to determine what the soil conditions were in the area.  Mr. Butcher asked the applicant to clarify whether the project was a rebuild since the Notice of Intent indicates the project is only for a foundation.  Mr. York responded that the plans show a reconstruction of the single family dwelling and that the Notice of Intent is for reconstruction of the dwelling and not just for construction of a pile foundation.   He indicated that the applicant may temporarily move the remaining portion of the existing structure while the new foundation is being constructed.  No DEP file number had been issued.  Ms Kelley made a motion that was seconded to continue the public hearing to February 20, 2007 at 7:50 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, SILVIA & SILVIA, MILLBROOK CROSSING, SE 18-1378
The applicant requested a continuation of the public hearing.  Mr. Butcher made a motion that was seconded to continue the public hearing to May 1, 2007 at 7:35 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PM, BEZDEK, AQUACULTURE GRANT
Mr. Merry and Mr. Grady recused themselves from this public meeting.  The applicant, Claire Bezdek explained her aquaculture grant.  Ms. Morris made a motion that was seconded to issue a negative determination that a Notice of Intent is not required with the stipulation that the applicant comply with the requirements of the Division of Marine Fisheries.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D PH, DUXBURY YACHT CLUB, 23 MATTAKEESETT CT., SE 18-1396
Representing the applicant was Jay Doherty.  The Commission received a memo from Duxbury Bay Management Commission stating it had no comment on the project.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
Mr. Grady summarized the proposed revisions to the Zoning Bylaw regarding coverage and piers for the Annual Town Meeting.

Meeting adjourned at 8:30 p.m.
