Conservation Comm. Minutes - 2006/11-07
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, November 7, 2006 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry and Holly Morris. Samuel Butcher was absent.  Joe Grady, Conservation Administrator was also present.

PH, MEYER, 434 LINCOLN ST., ADDITION, SE 18-1389
Representing the applicant was Rick Grady from Grady Consultants.  The proposed project is removal of a 12-foot section of the existing house and construction of a larger addition.  The septic tank will be relocated 64 feet from the wetlands.  The project conforms to the regulations.  Dr. Gill made a motion that was seconded to issue the Orders of Conditions.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PH, GIACCHETTO, SUMMER ST. (DUXBURY ESTATES) ROADWAY, DRAINAGE
This application is filed under the Duxbury Wetlands Protection Bylaw only since the wetland is an isolated land subject to flooding.  Representing the applicant are Chuck and Tom Giachetto and Rick Grady from Grady Consulting.  The applicant had previously filed an Abbreviated Notice of Resource Delineation (ANRAD) to determine the wetlands on the site.  Mr. R. Grady gave an overview of the proposed planned development project and indicated the only work within the buffer to the isolated wetland is a portion of the access road, landscaping and retention swale.  The closest point of the work to the wetlands is 65 feet.  Mr. R. Grady reported the applicant has filed with the Natural Heritage Endangered Species Program since the site is shown on the Priority Habitat map.  Mr. R. Grady asked for a continuation of the hearing until the applicant hears back from Natural Heritage.  An abutter, Phil Weir of 22 Fordville Rd. had concerns regarding the proposed drainage system and high groundwater in the area.  Mr. Grady discussed groundwater test pit data the applicant had gatherred.  Dr. Gill made a motion that was seconded to continue the public hearing to December 19, 2006 at 7:35 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed expenditure from the Conservation Fund for legal services.  Dr. Gill made a motion that was seconded to spend $58 from the Conservation Fund for an invoice from Town Counsel.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

The Commission reviewed requests for Certificates of Compliances for SE 18-1254 (30 Lincoln St), SE 18-1365 (Plumfield Ln), and SE 18-1301 (41 Keene St.)  The Commission postponed action on the request for SE 18-1365 since more debris needs to be removed.  Ms. Kelley made a motion that was seconded to issue a Certificate of Compliance for SE 18-1254.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

Ms. Morris made a motion that was seconded to issue a Certificate of Compliance for SE 18-1301.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

The Commission reviewed minutes of meetings for 6/13/06, 7/18.06 and 8/8/06.  Ms. Hearn made a motion that was seconded to approve the minutes of the meeting on 8/8/06, as written.  The vote was 4 – in favor; 0 – opposed; 2 abstentions (Merry, Morris).  Motion passed.

Ms. Hearn made a motion that was seconded to approve the minutes of the meeting on 6/13/06, as written.  The vote was 5 – in favor; 0 – opposed; 1 – abstention (Gill).  Motion passed.

Ms. Hearn made a motion that was seconded to approve the minutes of the meeting on 7/18/06, as written.  The vote was 4 – in favor; 0 – opposed; 2 – abstentions (Gill, Messina).  Motion passed.

The Conservation Administrator reported on a potential land swap with the Water Department for land adjacent to the Birch Street Water Tank.  The Commission took no action until they could review the plan.
