Conservation Comm. Minutes - 2006/12-05
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, December 5, 2006 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry and Holly Morris.  Joe Grady, Conservation Administrator was also present.

PM, TEKIN, 398 SUMMER ST., SEPTIC
Representing the applicant was Steve Kotowski from Webby Engineering Co.  The proposed project is replacement of the septic system.  The only work within the 100-foot buffer to bordering vegetated wetlands is installation of the septic tank and pump chamber.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the project.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

PH, BORGHESANI, 51 CLEARWATER DR., SEPTIC, SE 18-1390
Representing the applicant was James Borghesani and Steve Kotowski from Webby Engineering Co.  The proposed project is replacement of the septic system in the buffer to bordering vegetated wetlands and a small isolated wetland.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, SILVIA & SILVIA, MILLBROOK CROSSING, SE 18-1378
The applicant requested a continuation of the public hearing.  Mr. Butcher made a motion that was seconded to continue the public hearing to February 6, 2007 at 8:00 p.m.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY CONSTRUCTION, 70 FAIRWAY LN., BRIDGE, UTILITIES
Representing the applicant was Freeman Boynton.  The proposed project is to replace a wooden bridge with a stone bridge over an intermittent stream.  The work will be done in the summer when the streambed is dry.  Utilities will also be installed across the stream.  No DEP file number has been issued.  Mr. Butcher made a motion that was seconded to continue the public hearing to December 19, 2006 at 8:10 p.m.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed a revision to the proposed addition plan at 46 Landing Road, SE 18-1388.  The applicant proposes to square off the addition by one foot.  Mr. Butcher made a motion that was seconded that the proposed revision to the plan is a minor change and is consistent with the original Orders of Conditions for the project.   The vote was 7 – in favor; 0 – opposed.  The motion passed.

The Commission reviewed a bill from Town Counsel.  Mr. Butcher made a motion that was seconded to spend $58 from the Conservation Fund for legal service.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

The Commission reviewed requests for Certificates of Compliances.  Mr. Merry made a motion that was seconded to issue a Certificate of Compliance for SE 18-964, 290 Powder Point Ave.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

Mr. Merry made a motion that was seconded to issue a Certificate of Compliance for SE 18-1239, 31 Hawkins Place.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

Mr. Merry made a motion that was seconded to issue a Certificate of Compliance for SE 18-1154, 19 Ocean Rd. South.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

The Commission postponed action on the Certificates of Compliances for SE 18-1365 and SE 18-1237 since the areas need more stabilization.

The Commission reviewed the minutes of the meetings on 8/8/06, 7/11/06, and 6/13/06.
Ms. Kelley made a motion that was seconded to approve the minutes of the meeting on 6/13/06, as written.  The vote was 5 – in favor; 0 – opposed; 2 – abstentions (Butcher, Hearn).  Motion passed.

Ms. Kelley made a motion that was seconded to approve the minutes of the meeting on 7/11/06, as written.  The vote was 5 – in favor; 0 – opposed; 2 – abstentions (Gill, Messina).  Motion passed.

Ms. Kelley made a motion that was seconded to approve the minutes of the meeting on 8/8/06, as amended for a typographical correction.  The vote was 5 – in favor; 0 – opposed; 2 – abstentions (Merry, Morris).  Motion passed.
