The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, November 1, 2005 beginning at 7:30 p.m. Members present were Chairman Samuel Butcher, Dianne Hearn, Barbara Kelley, and Donald Merry. Thomas Gill, Joseph Messina and Holly Morris were absent. Joe Grady, Conservation Administrator was also present.
PH, COLLARI, AMEND ORDERS OF CONDITIONS, SE 18-1237, addressStreet475 ELM ST., BARN
The applicant, Linda Collari explained the project which is to construct a pole barn for horses. The barn will have no foundation. Ms. Kelley voiced concern about manure and fertilizers near the wetlands. An abutter, John Lehman had questions about livestock regulations and aesthetics. The Commission requested that the applicant have no paddock or livestock rearing activities within 25 feet of the wetlands. Mr. Merry made a motion that was seconded to amend the Orders of Conditions SE 18-1237 to include the construction of a pole barn with the understanding that no paddock or livestock rearing activities are permitted within 25 feet of the wetlands. The vote was 4 – in favor; 0 – opposed. Motion passed.
PH, DUXBURY CONSTRUCTION, addressStreet321 KING CAESAR RD., SEAWALL REPAIR
Representing the applicant were Freeman Boynton and the property owner Fostira Rachwalski. The proposed project is to repair the concrete seawall. Mr. Grady voiced concern about placement of the new footings and suggested the footings be set deeper so they would not be exposed. No DEP file number had been issued and the Commission had not received the review from the Duxbury Bay Management Commission. Mr. Merry made a motion that was seconded to continue the public hearing to November 15, 2005 at 8:05 p.m.
ADMINISTRATIVE MATTERS
The Commission reviewed two requests for Certificates of Compliances, SE 18-1234 (30 Deer Run) and SE 18-1276 (addressStreet67 Fordville Rd.). Ms. Kelley made a motion that was seconded to issue a Certificate of Compliances for SE 18-1234. The vote was 4 – in favor; 0 – opposed. Motion passed.

The Commission reviewed a request to spend $215 from the Conservation Fund to pay for the DPW staff to assist the Open Space Committee with the annual cleanup of the Swanson Field. Ms. Kelley made a motion that was seconded to spend $215 from the Conservation Fund for staff support for the Open Space Committee cleanup of the Swanson Field. The vote was 4 – in favor; 0 – opposed. Motion passed.
The Commission signed the conservation restriction for the Swanson land parcel off addressStreetFranklin Street.
Mr. Grady reported that two Enforcement Orders had been issued for SE 18-1221 and SE 18-1222 since the work was not being done in compliance with the Orders of Conditions and the State Building Code. Ms. Kelley made a motion that was seconded to reaffirm issuance of the Enforcement Orders for SE 18-1221 and SE 18-1222. the vote was 4 – in favor; 0 – opposed. Motion passed.
The Commission rescheduled the meetings of November 29 and December 13 to December 6, and December 20, 2005.
