Conservation Comm. Minutes - 2004/06-22

The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, June 22, 2004 beginning at 7:30 p.m.  Members present were Chairman Friend Weiler, Thomas Gill, Brendan Halligan, Barbara Kelley, and Joseph Messina.   Samuel Butcher and Arthur Vautrain were absent.   Joe Grady, Conservation Administrator was also present.

PH, DELISLE, WEST ST., GARAGE & DRIVEWAY
Representing the applicant were Rich Delisle and Shayne McGlone from McGlone Enterprises Inc.  Mr. McGlone submitted a revised plan showing a revised wetland line based on a site visit with the Conservation Administrator.  Mr. McGlone explained the project, which was construction of a driveway and garage within the buffer to bordering vegetated wetlands.  The proposed single family dwelling is located outside the jurisdiction of the Commission.  Mr. John MacCormack, 333 Church St. noted he was an abutter and was not notified of this public hearing.  Mr. MacCormack also asked if the plan could show the abutting parcels.  He also commented that the Planning Board had previously denied a plan to develop this property because of wetlands.  With concerns of runoff from the driveway in close proximity to the wetlands Dr. Gill asked if the driveway could be crushed stone rather than paved.  Mr. Grady asked the applicant to create a larger buffer between the wetlands and the proposed activities.  Ms. Sheila Lynch-Benttinen, 344 West St. had concerns regarding the garage and runoff toward the pond on her property.  No DEP file number had been issued.  Dr. Gill made a motion that was seconded to continue the public hearing to July 13, 2004 at 7:40 p.m.  A vote (5 – 0) was taken and the motion passed.

PH, REED, 120 PATTEN LN., PIER REPAIR, SE 181264
Representing the applicant was Paul Brogna from Seacoast Engineering Co.  The proposed project is to replace ice-damaged pilings and platform in the exact footprint.  Dr. Gill made a motion that was seconded to issue Orders of Conditions.  A vote (5 – 0) was taken and the motion passed.

ADMINISTRATIVE MATTERS
The public hearing for the rules & regulations scheduled for June 29, 2004 has been postponed.

The Commission reviewed several requests for Certificates of Compliances and took the following votes.  Dr. Gill made a motion that was seconded to issue Certificates of Compliances for SE 18-638.  A vote (5 – 0) was taken and the motion passed.

Dr. Gill made a motion that was seconded to issue a Certificate of Compliance, under the Town Bylaw, for SE 18-968.  A vote (5 – 0) was taken and the motion passed.

Dr. Gill made a motion that was seconded to issue Certificates of compliances for SE 18-1214.  A vote (5 – 0) was taken and the motion passed.

Dr. Gill made a motion that was seconded to issue Certificates of Compliances for SE 18-1040.  A vote (5 – 0) was taken and the motion passed.

The Commission discussed dedicating a parcel of conservation land in memory of Dr. Lansing Bennett.

The Commission reviewed expenditures for the Conservation Fund.  Dr. Gill made a motion that was seconded to approve the expenditure of $546 from the Conservation Fund for legal services from Town Counsel.  A vote (5 – 0) was taken and the motion passed.

Dr. Gill made a motion that was seconded to approve the expenditure of $133.01 from the Conservation Fund for mutt mitts at Bay Farm Field.  A vote (5 – 0) was taken and the motion passed.

Mr. Grady reported a violation to the Orders of Conditions for 128 Bay Road.  The homeowners had cut vegetation in the wetlands and inside the limit of work line.  Dr. Gill made a motion that was seconded to issue an Enforcement Order to the property owner of 128 Bay Road.  A vote (5 – 0) was taken and the motion passed.
