Conservation Comm. Minutes - 2003/07-01

The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, July 1, 2003 beginning at 7:30 p.m.  Members present were Samuel Butcher, Thomas Gill, Brendan Halligan, Anne Hill, Joseph Messina, and Arthur Vautrain. Chairman Friend Weiler was absent. Mr. Butcher was Acting Chairman for the meeting.

PM, DEER RUN VENTURES, LLC, 411 LAKESHORE DR., SITE WORK
Representing the applicant was Brad McKenzie from the McKenzie Engineering Group, Inc.  The proposed work was construction of the driveway and site work within the buffer to bordering vegetated wetlands.  Lakeshore Drive is located between the wetlands and the proposed site.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required.  A vote (6-0) was taken and the motion passed.

PH, PIPER, 30 BILL BAKER BLVD., ADDITION, SE 18-1213
The applicant, Bill and Jane Piper were present for the discussion.  The proposed project was construction of an addition in the buffer to bordering vegetated wetlands.  The proposed addition would be constructed within the existing lawn area.  Mr. Butcher read a letter from the abutter, Mr. Edward Murphy, dated 6/16/03. The letter indicated the applicant was referencing a wetland delineation on the abutting property and the accuracy of that wetland line was under appeal by Mr. Murphy.  Mr. Butcher was reluctant to approve the proposed project until the applicant had either an independent wetland delineation performed or the Conservation Administrator review the wetland line in order to determine the distance the proposed addition is from the resource area.  Mr. Halligan made a motion that was seconded to continue the public hearing to July 15, 2003 at 7:40 p.m.  A vote (6 - 0) was taken and the motion passed.

CONT'D. PH, HUMMOCK LLC, GURNET RD., SE 18-1191, SE 18-1192,
      SE 18-1193, SE 18-1194, & SE 18-1195
The applicant submitted a written request to continue the public hearing to July 15, 2003 at 7:45 p.m.  Mr. Halligan made a motion that was seconded to continue this public hearing to July 15 2003 at 7:45 p.m.  A vote (6 - 0) was taken and the motion passed.

CONT'D. PH, JANNETTY, 10 HOWLANDS LANDING, SE 18-1207
The applicant, Joe and Miriam Jannetty were present for the discussion.  Mr. Butcher indicated that the Commission has not received any comments from the Harbormaster regarding the proposed project.  The Commission felt the Harbormaster had ample time to respond and was reluctant to continue the hearing for a second time.  The Commission had no problems with the proposed project.  Dr. Gill made a motion that was seconded to issue Orders of Conditions for the proposed repair of the earthen pier.  A vote (6 - 0) was taken and the motion passed.

PH, HAYES, 36 ST. GEORGE ST., SEPTIC, SE 18-1209
Representing the applicant was Kevin Biggens from Ross Engineering Co.  The proposed project was to upgrade the existing septic system within the inner riparian zone and buffer to salt marsh.  It was noted the proposed location is as far from the resource area as possible.  The Board of Health has approved the project.  Mr. Halligan made a motion that was seconded to issue Orders of Conditions.  A vote (6 - 0) was taken and the motion passed.

PH, PINE PT. PLACE R.T., 3 PINE POINT PLACE, ADDITION, SE 18-1215
Representing the applicant were Stanley Merry and Paul Brogna of Seacoast Engineering Co.  The proposed project was construction of a porch addition to an existing garage on a barrier beach and buffer to salt marsh and coastal bank.  No grade changes were proposed and the addition was to be constructed on concrete sonotubes.  Mr. John Bernazani, an abutter spoke in opposition to the proposed project.  He questioned the delineation and was concerned with the increase in coverage on the site.  Several abutters, Tom Berganzani, Caroline Dunham, and David Flynn spoke in opposition to the project and questioned the use of the structure and the potential of the existing garage to be converted to a second dwelling. Mr. Merry responded that the proposal was only for a porch for use by his family.  Mr. Butcher noted that the Commission could only review the proposal in relation to wetland regulations.  Mr. Butcher asked the applicant to reevaluate the coverage issue and consider keeping the amount of impervious cover on the property to the existing percentage.  Several of the Commissioners wanted to visit the site.  Dr. Gill made a motion that was seconded to continue the public hearing to August 19, 2003 at 8:15 p.m.  A vote (6 -0) was taken and the motion passed.

PH, WILLIAMS, 66 CAPTAINS HILL RD., GUESTHOUSE, SE 18-1212
Representing the applicant were Joanne Williams and Terry Chase of Stenbeck & Taylor Co.  The proposed project was construction of a one-bedroom guesthouse with an attached garage in the buffer to bordering vegetated wetlands.  It was noted that the Conservation Administrator had questions regarding the wetland line and had scheduled a site visit with Stenbeck & Taylor to review the line.  Mr. Halligan made a motion that was seconded to continue this public hearing to August 5, 2003 at 7:45 p.m.  A vote (6 - 0) was taken and the motion passed.

CONT'D PH, DUXBURY BEACH RESERVATION, INC (DBR), SE 18-1198
It was reported that the Commission is working on the draft Orders of Conditions but the latest draft was presently not available for review.  Mr. Halligan made a motion that was seconded to continue the public hearing to July 15, 2003 at 7:30 p.m.  A vote (6 - 0) was taken and the motion passed.

ADMINISTRTIVE MATTERS
Mr. Halligan made a motion that was seconded to issue a one-year extension permit to project SE 18-1025.  A vote (6 - 0) was taken and the motion passed.
