Conservation Comm. Minutes - 2003/02-04
The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, February 4, 2003 beginning at 7:30 p.m.  Members present were Chairman Friend Weiler, Brendan Halligan, Anne Hill, Mark Mahoney, Arthur Vautrain, and Joseph Grady, Conservation Administrator. Samuel Butcher and Thomas Gill were absent.

DUXBURY BEACH RESERVATION, INC. (DBR, Inc.)
Representing DBR, Inc. were Al Vautrinot, Jim O'Connell, Margaret Kearney, and Kay Foster.  Mr. Vautrinot submitted the draft Beach Management Plan for review by the Commission.  The Commission scheduled the next meeting with DBR, Inc. for March 4, 2003 at 8:30 p.m.

PM, WETLANDS BYLAW REVISION
Mr. Weiler summarized the proposed revisions to the bylaw.  Mr. Mahoney made a motion that was seconded to recommend to the Board of Selectmen and the Town Meeting to adopt the bylaw revisions.  The motion passed unanimously.

ORWIG/EMERSON, 44 WIRT WAY (SE 18-1156)
Representing the applicant was Dan Orwig who requested a revision to the Orders of Conditions to permit depositing 50 cubic yards of fill to raise the patio 4.5 feet in order to access the proposed dwelling and deck in a V-zone.  He indicated that zoning would allow only a 30-square-foot landing in this particular area.  The Commission was not in favor of the proposed fill and suggested the applicant consider a 30-square-foot landing and stairs.

PM, SULLIVAN, 675 BAY RD., SEAWALL REPAIR
The applicant, Brian Sullivan explained the project, which is to repair a section of the concrete seawall that had collapsed.  The work would be done from the upland.   Mr. Weiler suggested the applicant consider weepholes to relieve pressure behind the seawall.  Mr. Mahoney made a motion that was seconded to issue a negative determination that a Notice of Intent is not required.  The motion passed unanimously.

PH, ELDREDGE, 8 GOOSE POINT LN., ADDITION
Representing the applicant were Kathleen Eldredge, Dave Eldredge and Dave Healy.  Mr. Healy explained the project, which is construction of two additions in the buffer to bordering vegetated wetlands.  The rear two-story addition would replace an existing deck and be constructed on pilings, 35 feet from the wetlands.  One issue related to the project was the amount of impervious coverage.  The rear addition extended beyond the footprint of the existing deck.  The amount of existing coverage already exceeded the allowable 15%.  The Commission indicated that the applicant could not exceed the existing amount of coverage.  Mr. Healy indicated that previously there was an impervious driveway that was removed and the area grassed.  Mr. Mahoney pointed out that that particular area was in the road right-of-way and not on the applicant's property.  The Commission indicated that the applicant must revise the plan to show no net gain in coverage.  No DEP file number had been issued.  Mr. Mahoney made a motion that was seconded to continue this public hearing to February 18, 2003 at 8:20 p.m.  The motion passed unanimously.

PH, ELLIS, 727 BAY RD., SINGLE FAMILY DWELLING & POOL
Representing the applicant were Michael Ellis and his engineer, Patrick Rosengrave.  Mr. Rosengrave explained the project.  The proposed single family dwelling would be outside the buffer to bordering vegetated wetlands, but the proposed garage and swimming pool are located within the buffer.  Mr. Mahoney asked the applicant to consider a 25-foot natural buffer between the wetlands and lawn area. The proposed project conforms to the regulations. No DEP file had been issued.  Mr. Mahoney made a motion that was seconded to continue this public hearing to February 18, 2003 at 8:25 p.m.  The motion passed unanimously.

PH, BAYSIDE MARINE CORP., 433 WASHINGTON ST., RIPRAP
Representing the applicant were Jack Kent Jr. and Jack Kent III.  Mr. Kent, Jr. explained the project, which is to install riprap and fill to restore the upland to the original dimensions and to prevent future erosion of the coastal bank and marsh.  Mr. Kent showed photographs of the area that had eroded during the January 2003 storm.  No DEP file number had been issued.  Mr. Mahoney made a motion that was seconded to continue this public hearing to February 18, 2003 at 8:30 p.m.  The motion passed unanimously.

CONT'D. PH/PM, MURPHY, CONGRESS ST., SE 18-1167, DELINEATION
Representing the applicant was Mark Casey of South Shore Survey Consultants, Inc.  Mr. Casey submitted a revised plan dated 1/27/03 that incorporated the revisions the Conservation Administrator requested.  Mr. Mahoney made a motion that was seconded to accept the wetland delineation as shown on the revised plan dated 1/27/03.  The motion passed unanimously.

ADMINISTRATIVE MATTERS
A motion was made and seconded to spend $3,167 from the Conservation Fund for fences at the Round Pond and Trout Farm parking areas.  The motion passed unanimously.

A motion was made and seconded to spend $331.75 from the Conservation Fund for legal services related to the Belle land gift.  The motion passed unanimously.

Mr. Grady reported that site inspections revealed that up to six property owners are illegally storing their floats on the salt marsh.  The Commission indicated that the Conservation Administrator should send out a letter instructing the applicants to remove the floats off the marsh within 10 days or they will be fined.
