Conservation Comm. Minutes - 2003/04-01
The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, April 1, 2003 beginning at 7:30 p.m.  Members present were Chairman Friend Weiler, Samuel Butcher, Thomas Gill, Anne Hill who arrived at 8:00 p.m., Mark Mahoney, Arthur Vautrain, and Joseph Grady, Conservation Administrator. Brendan Halligan was absent.  

CONT'D. PM, BAY FARM ASSOC., BAY FARM RD., AQUATIC WEED TREATMENT
Ms. Hill was not present for this public meeting. Representing the applicant was Dominic Meringolo of Aquatic Control Technology, Inc.  The proposed project was continuation of the management program for weed control in the pond.  Mr. Meringolo indicated that the pond now requires small amounts of aquatic herbicide and that the company files with DEP for necessary permits for any chemical applications.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required.  The vote was 6 in favor and 0 opposed, so the motion passed.

The applicant requested a continuation since the revised plan was not completed.  Mr. Mahoney made a motion that was seconded to continue this public hearing/public meeting to May 20, 2003 at 7:40 p.m.  A vote was taken and the motion passed 6 - 0.

These five Notice of Intents were discussed simultaneously since all dealt with the same parcel of land.  Representing the applicant was Dan Orwig of Orwig Associates.  He explained the project was to reconstruct the 5 existing structures, four of which he feels existed prior to zoning regulations, and to correct a drainage problem in the area.  The proposed project required bringing in fill and grading the site.  A dune with beach grass would also be created to act as a buffer between the dwellings and Gurnet Rd.  Mr. Orwig explained how the floodwaters would be managed and indicated the old drainage system would be abandoned and new drainage pipes would be tied into tide gates.  All the proposed dwellings would be built on pilings.  The Commission had concerns with the proposed drainage system and the amount of fill being brought into the site and the effect of the fill on abutting properties.  Mr. Grady asked that elevations be added to the plan.  Mr. Mahoney requested more detailed plans on the proposed dwellings.  Mr. Vautrain asked who would maintain the drainage structure and what would happen if the tide gates failed as they have in the past.  Abutters had the same concern of maintenance of the structure and questioned where the water would go.  Several abutters commented on the existing flooding in the area and questioned the impact the proposed drainage would have on abutting properties; concerns were raised about erosion to Cable Hill and flooding of Hummock Ln.  Richard Kruegger of 48 Ocean Rd. North submitted a letter from abutter Martin Federici who had concerns regarding the proposed drainage. Robin Chiminiello of 5 Cable Hill presented a copy of letter from Richard MacDonald, Director of Inspectional Services regarding zoning status of the 5 lots.  Mr. Mahoney questioned whether the Commission should hire a consultant to review the proposed drainage.  The Commission scheduled a site visit for April 6, 2003 at 10 a.m.  Mr. Mahoney made a motion that was seconded to continue the public hearings for the 5 notices of intents to May 20, 2003 at 8:10 p.m.  The motion passed unanimously.

The applicant, Robert Mastergeorge explained the project, which was construction of an aboveground pool and deck.  The pool would be located 75 feet from a cranberry bog.  The applicant needs to verify that the proposed project meets the 15% impervious cover regulation.  Mr. Timothy Pink of 145 Screenhouse Ln. made the applicant aware that the bog is a working bog and that there is aerial spraying of fertilizers.  He agreed to give advance notice to the applicant when spraying would take place.  Mr. Mahoney made a motion that was seconded to write the Orders of Conditions.  The motion passed unanimously.

ADMINISTRATIVE MATTERS
Mr. Butcher made a motion that was seconded to issue a Certificate of Compliance for SE 18-775 (32 Fordville Rd.).  The motion passed unanimously.

The Commission reviewed a Chapter 61A purchase and sale for parcel 060-029-000 off Temple Street by Pauline Harrington.  Mr. Weiler commented that the Commission has previously discussed thoroughly the parcel and had determined that the price of the parcel was too high for its open space value. Mr. Grady reported the buyer of the parcel might be willing to donate a portion of the parcel for open space. Mr. Vautrain reported that the Community Preservation Committee had suggested the Board of Selectmen explore the community housing possibility of the parcel.  Dr. Gill made a motion that was seconded to recommend to the Board of Selectmen to not exercise the Town's option of first refusal to purchase parcel 060-029-000 for open space purposes with the proviso that the Conservation Administrator continue working with the buyer on the land donation.  The motion passed unanimously.

The Commission reviewed the request for the Duxbury Sprint Triathlon on September 21, 2003.  It was suggested that an access corridor be delineated for the swimmers at the beach.  Mr. Mahoney made a motion that was seconded to approve the request for the Duxbury Sprint Triathlon on September 21, 2003.  The motion passed unanimously.
