Conservation Comm. Minutes - 2004/06-17
The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, June 17, 2003 beginning at 7:30 p.m.  Members present were Chairman Friend Weiler, Samuel Butcher, Thomas Gill, Brendan Halligan, Anne Hill, Mark Mahoney, and Arthur Vautrain.  Also present was Joe Grady, Conservation Administrator.

OPEN SPACE PLAN, GOALS REVIEW
Pat Loring of the Open Space and Recreation Planning Committee reviewed the 5-year action plan and discussed the goals of the Conservation Commission for the next five years.

PH, BUCKLEY, 20 MILL POND LN., POOL, SE 18-1210
The applicant, Kevin Buckley explained the project, which was installation of an aboveground pool in the buffer to bordering vegetated wetlands.  The proposed pool would be 92 feet from the wetlands.  The project conformed to the regulations.  Mr. Mahoney made a motion that was seconded to issue Orders of Conditions.  A vote (7-0) was taken and the motion passed.

PH, DUXBURY CONSTRUCTION CO., 30 CHRISTMAS TREE WAY,
SE 18-1208, WATERLINE
Mr. Mahoney recused himself from this hearing.  Representing the applicant was Freeman Boynton.  The proposed project is installation of a waterline.  The applicant is to confirm that the proposed work complies with the conservation restriction and easement plan for the subdivision.  Mr. Butcher commented that the boring technique might require added siltation barrier to prevent silt from getting into the wetlands.  Prior to the work commencing the contractor and the Conservation Administrator shall meet on site to discuss slurry and water for boring.  Mr. Butcher made a motion that was seconded to issue the Orders of conditions, provided that the project complies with the conservation restriction and easement plan.  A vote (6-0) was taken and the motion passed.

PM, DUXBURY CONSTRUCTION CO., 662 CONGRESS ST., SEPTIC
Mr. Mahoney recused himself from this public meeting.  Representing the applicant was Freeman Boynton.  The proposed project was installation of a septic tank and pump chamber in the buffer to bordering vegetated wetlands and riverfront area.  The leaching facility is outside the Commission's jurisdiction.  Mr. Grady noted that the plan should be revised to show a perennial stream rather than intermittent stream.  A septic system repair is a permitted use in the riverfront area.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the proposed project.  A vote (6-0) was taken and the motion passed.

PH, HALLISEY, 30 WENDELL POND RD., POOL, SE 18-1211
Mr. Grady recused himself from this discussion since he is an abutter.  Representing the applicant was Alan Vautrinot of Vautrinot Land Surveying and the property owner, Robert Hallisey.  The proposed project is installation of a pool 57 feet from the wetlands.  Mr. Vautrinot noted that the property is within an estimated habitat area, but a letter from Dr. French of the Natural and Endangered Species Program indicates there will be no impacts.  Mr. Vautrinot explained that the pool could not be moved farther from the wetlands because it had to be at least 25 feet from the septic system.  The Commission requested that the applicant not plant a lawn between the pool apron and the wetlands.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  A vote (7-0) was taken and the motion passed.

PM, EDDY, 29 PINE RIDGE LN., SHED
The applicant, Allen Eddy explained the project, which is construction of a shed 73 feet from bordering vegetated wetlands.  The proposed site is within an existing lawn area.  Mr. Mahoney made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the proposed project.  A vote (7-0) was taken and the motion passed.

INTERVIEWS FOR CONSERVATION COMMISSION VACANCY
The Commission interviewed Bill Tenhoor and Joe Messina for an upcoming vacancy on the Conservation Commission.

PM, MCCARTHY, 2 KING CAESAR RD, PIER REPAIR
The applicant, Steven McCarthy explained the project, which is to repair the existing pier that was storm damaged.  The work required replacing the two end piles.  Mr. Mahoney commented that once the contractor, Anchorage Marine assessed the damage they should contact the Conservation Administrator if any additional work is required.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the proposed project.  A vote (7-0) was taken and the motion passed.

CONT'D PH, STRIAR, TANGLEWOOD TRAIL, SE 18-1203
The applicant sent a written request asking for a continuation of the public hearing.  Mr. Mahoney made a motion that was seconded to continue this hearing to August 5, 2003 at 7:35 p.m.  A vote (7-0) was taken and the motion passed.

CONT'D PH, JANNETTY, 10 HOWLANDS LANDING, SE 18-1207
Mr. Grady reported that there has been no response to a memo to the Harbormaster, Shellfish Advisory Committee and Waterfront Advisory Committee asking for their review of the project.  The Commission decided to allow more time for responses.  Mr. Mahoney made a motion that was seconded to continue the public hearing to July 1, 2003 at 8:00 p.m.  A vote (7-0) was taken and the motion passed.

PM, DUFFY, 273 TREMONT ST., IRRIGATION WELL
Representing the applicant were Paul Brogna of Seacoast Engineering and Mary Duffy.  The proposed project is installation of an irrigation well located 45 feet from a pond.  Mr. Butcher asked that siltation barrier be placed around the drilling site.  Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the proposed project.  A vote (7-0) was taken and the motion passed.

ADMINISTRATIVE MATTERS
The Conservation Administrator recommended a Partial Certificate of Compliance for SE 18-1101 since the lawn needs to be established.  Mr. Mahoney made a motion that was seconded to issue a Partial Certificate of Compliance for SE 18-1101.  A vote (7-0) was taken and the motion passed.

The Conservation Administrator recommended postponement of action on the request for Certificates of Compliances for SE 18-976 and SE18-977.

Mr. Mahoney made a motion that was seconded to spend $20 from the Conservation Fund for bicycle maintenance.  A vote (7-0) was taken and the motion passed.

Mr. Butcher made a motion that was seconded to spend $816 from the Conservation Fund for legal services.  A vote (7-0) was taken and the motion passed.

The Commission scheduled a public hearing to discuss deer hunting for August 19, 2003 at 7:30 p.m.

Mr. Grady reported that Don Carney of 164 Bolas Rd. complained that the high water table on his property was a result of the East Street bog reservoir.  The Commission recommended hiring a surveyor to establish elevations and to review the old documents and easement plan to determine the appropriate elevation of the reservoir.
