Conservation Comm. Minutes - 2003/11-04

The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, November 4, 2003 beginning at 7:30 p.m.  Members present were Chairman Friend Weiler, Thomas Gill, Brendan Halligan, Anne Hill, and Arthur Vautrain. Samuel Butcher and Joseph Messina were absent.  Joe Grady, Conservation Administrator was also present.

PIER ACCESS AND SHORELINE STUDY COMMITTEE (PASS)
Members of PASS, Bill Tenhoor, John Haggerty, Shawn Dahlen, Heidi Pape-Laird and Peter Roveto, updated the Commission on what PASS has been doing over the last two years.

CONSERVATION COMMISSION RULES & REGULATIONS REVISIONS
The Commission reviewed with JoAnn Muramoto of Horsley & Witten the scope of the rules & regulations update.

PH, TOKARSKI, 55 BIANCA RD., SITE WORK, SE 18-1236
The applicant, Mark Tokarski described the project, which was to remove approximately 19 trees and to regrade a section of the yard to create lawn within the buffer to bordering vegetated wetlands.  The applicant agreed to maintain a 35-foot undisturbed buffer between the lawn and the wetlands.  Dr. Gill made a motion that was seconded to issue Orders of Conditions for the proposed site work.  A vote (5-0) was taken and the motion passed.

PH, DUXBURY CONSTRUCTION CO., 64 STANDISH ST., SE 18-1232
Representing the applicant was Freeman Boynton.  The proposed project was a septic system upgrade and construction of an addition in the buffer to bordering vegetated wetlands.  Mr. Boynton submitted a revised plan that located the soil absorption system 71 feet from the wetlands.  There will be no new grading within 35 feet of the wetlands.  The proposed addition is in the footprint of existing decks.  Dr. Gill made a motion that was seconded to issue Orders of Conditions for the proposed project.  A vote (5-0) was taken and the motion passed.

PH, DUXBURY CONSTRUCTION CO., 41 BAY POND RD., SE 18-1233
Representing the applicant was Freeman Boynton.  The proposed project was to demolish a section of the existing dwelling and garage and construct a new garage, addition, boathouse and septic system upgrade and perform landscaping and vista pruning.  The applicant agreed to have no new lawn within 25 feet of the wetlands.  As proposed, the boathouse would be located on the coastal bank.  The Commission indicated it would not permit any digging within the coastal bank and denied the proposed boathouse.   Dr. Gill made a motion that was seconded to issue Orders of Conditions for the proposed work with the exception of the proposed boathouse, which is not permitted on the coastal bank.  A vote (5-0) was taken and the motion passed.

CONT'D. PM, O'SULLIVAN, 959 MAYFLOWER ST., DECK
The applicant, James O'Sullivan submitted the impervious coverage calculation.  Mr. Grady reviewed the calculation and indicated the percentage was close to 15%.  Dr. Gill recommended the applicant have an engineer certify the coverage and the rest of the Commissioners agreed.  Mr. Halligan made a motion that was seconded to continue this public meeting to December 2, 2003 at 7:35 p.m.  A vote (5-0) was taken and the motion passed.

CONT'D PH, PRAT, 20 LAKESHORE DR., SE 18-1230
The applicant, Pierre Prat submitted photographs that showed the existence of an old patio in the area of the new deck.  All old bricks from the patio will be removed and the area planted.  Mr. Halligan made a motion that was seconded to issue Orders of Conditions for the deck.  A vote (5-0) was taken and the motion passed.

PH, SPOOR, 80 MARDSHALL ST., SITE WORK, SE 18-1231
The applicant, Michael Spoor described the project, which was to move the existing dwelling outside the 100-foot buffer and regrade the area and landscape.  The Commission noted that any vista cutting would require approval from the Conservation Administrator prior to the work commencing.  Dr. Gill made a motion that was seconded to issue Orders of Conditions for the proposed site work.  A vote (5-0) was taken and the motion passed.

ADMINISTRATIVE MATTERS
Mr. Grady reported that a new house on Vine St. is being constructed next to Conservation Commission owned land and the Bay Circuit trail.  He asked that the Commission allocate up to $1,200 for the installation of property bounds along the trail.  Dr. Gill made a motion that was seconded to spend up to $1,200 from the Conservation Fund for the installation of 5 property bounds along a section of the Bay Circuit trail off Vine St.  A vote (5-0) was taken and the motion passed.

Dr. Gill made a motion that was seconded to pay $988 from the Conservation Fund for legal services regarding land acquisitions.  A vote (5-0) was taken and the motion passed.

The Commission reviewed the draft minutes of the meeting on 8/12/03.  Mr. Vautrain made a motion that was seconded to accept the minutes of the meeting on 8/12/03 as written.  A vote (5-0) was taken and the motion passed.

Meeting adjourned at 10:15 p.m.
