The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, December 3, 2002 beginning at 7:30 p.m. Members present were Chairman Friend Weiler, Thomas Gill, Anne Hill, Arthur Vautrain, and Joseph Grady, Conservation Administrator. Samuel Butcher, Brendan Halligan, and Mark Mahoney were absent.
PH/PM, LORING, ELM ST., DELINEATION, SE 18-1177
Representing the applicant was Mark Casey from South Shore Survey Consultants, Inc. Mr. Casey explained the plan showing the delineation of the resource areas. Mr. Grady gave his review of the plan and asked the applicant to show topography and spot elevations, particularly along the ditch on the plan and to stake the edge of the bog in the field and reference those stakes on the plan. He also asked that the location of the soil transits be shown on the plan. The issue is whether the resource area is a bordering vegetated wetland or isolated land subject to flooding. Amy MacNab, 269 Tobey Garden St., commented that the applicant shows the bog as bordering vegetated wetlands and questioned what it bordered. Brad Mackenzie, 91 Rogers Way, commented that in order to define the limit of land subject to
flooding the applicant should review the entire watershed and submit supporting drainage calculations. Mr. George Wadsworth, 115 Elm St., asked that the zoned wetland line and topography be shown on the plan since eventually the Planning Board would be reviewing the plan. Ms. Hill made a motion to continue the public hearing to January 21, 2003 at 7:40 p.m. The motion passed unanimously.
PM, RICHARDSON, 54 PLANTATION DR., IRRIGATION WELL
Representing the applicant were Mark Casey of South Shore Survey Consultants, Inc. and the property owner, John Richardson. The proposed project is installation of an irrigation well 25 feet from wetlands. The driveway is located between the well location and the wetlands. Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The motion passed unanimously.
CONT'D. PH, MASS. HIGHWAY, ROUTE 3, DELINEATION, SE 18-1170
The applicant submitted a written request for a continuation of the public hearing. Ms. Hill made a motion that was seconded to continue this public hearing to December 17, 2002 at 8:00 p.m. The motion passed unanimously.
PH, MCGRATH, 274 MARSHALL ST., POOL
Representing the applicant was Shawn Dahlen. The proposed project is installation of a swimming pool and pool house within the buffer to a coastal beach and dune. The applicant agreed to submit a landscape plan for approval before any work is done on the slope above the coastal beach. The proposed project conforms to the regulations. Dick Rothmund of 246 Marshall St. commented that there is an old historical well on the abutting property and he asked for assurance that the project would not impact that site. No DEP file number had been issued. Mr. Vautrain made a motion that was seconded to continue this public hearing to December 17, 2002 at 8:20 p.m. The motion passed unanimously.
PH, DUXBURY CONSTRUCTION CO., 44 BAY RD., SE 18-1176
Representing the applicant was Freeman Boynton. The proposed project is filling and grading a depression in the backyard and construction of a deck approximately 97 feet from the wetlands. Dr. Gill made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.
PH, O'DONNELL, 1036 FRANKLIN ST., GARAGE, SE 18-1175
The applicant, Edward O'Donnell explained the project, which was to rebuild an existing garage, located approximately 70 feet from bordering vegetated wetlands. Prior to the work commencing the applicant needs to calculate the coverage ratio. Mr. Vautrain made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.
PM, DOOLITTLE, 110 LAUREL ST., DELINEATION
The applicant sent in a written request to withdraw the application. A motion was made and seconded to accept the withdrawal. The motion passed unanimously.
DUXBURY BEACH RESERVATION, INC. (DBR,INC.), EXTENSION PERMITS, SE 18-860, SE 18-861, & SE 18-862
Representing the applicant was Al Vautrinot and Lester Smith. The Commission continued its discussion on extending the existing Orders. Discussion centered on how long to extend the Orders. Mr. Weiler reported that the Commission would be interviewing three consultants at its next meeting on December 17, 2002 beginning at 8:30 p.m. Mr. Vautrinot reported they are working on a new draft of the Beach Management Plan. Dr. Gill made a motion that was seconded to approve the request of the applicant and extend the existing Orders for three years. The vote was 0 - in favor and 4 - against. The motion failed. A second motion was made and seconded to extend the Orders for 90 days with the proviso that the Orders not expire in the summer. The motion passed unanimously.
ADMINISTRATIVE MATTERS
A motion was made and seconded to issue a Certificate of Compliance for SE 18-497. The motion passed unanimously.
The Commission postponed action on the request for a Certificate of Compliance for SE 18-941 since the Conservation Administrator had not conducted a site inspection.
The Commission reviewed a letter from Paul Brogna, Seacoast Engineering Co., regarding the extension permit of the Hedberg pier, SE 18-568. A motion was made and seconded to extend the time period to drive the piles to April 1, 2003 with the understanding that all the work on the pier will be completed by May 20, 2003. The motion passed unanimously.
The Commission signed a duplicate original of the Orders of Conditions for SE 18-1135 in order for the Orders to be recorded at the Registry of Deeds.
