The Conservation Commission held a meeting in the Basement Mural Room of Town Hall on Tuesday, September 24, 2002 beginning at 7:30 p.m. Members present were Samuel Butcher, Thomas Gill, Anne Hill, Mark Mahoney, Arthur Vautrain, and Joseph Grady, Conservation Administrator. Brendan Halligan and Friend Weiler were absent. Mr. Butcher was Acting Chairman.
PUBLIC HEARING - DEER HUNTING ON CONSERVATION LAND
The Conservation Commission held this public hearing to evaluate a proposal to allow hunting on some of its conservation lands. The hearing started with an introduction by Mr. Butcher and then a presentation on deer management by Bill Wyotek of the Massachusetts Division of Fish & Wildlife. After the presentation the Chairman took comments and questions from the audience. Several people voiced concerns about the safety of the walkers in the woods. Mr. Butcher reiterated that tonight's meeting was to gather information and that the Commission would not be making a decision until the next meeting at which time the specific proposal would be presented. Mr. Mahoney made a motion that was seconded to continue this public hearing to October 8, 2002 at 8:30 p.m. The motion passed unanimously.

Mr. Butcher reported the applicant had withdrawn his application.
PH, ALBIN, 35 MERRY AVE., ADDITION, SE 18-1163
The applicant, Rochelle Albin described the project, which was to construct an addition and deck approximately 75 feet from bordering vegetated wetlands. The proposed project conforms to the regulations. Mr. Mahoney made a motion that was seconded to write the Orders of Conditions. The motion passed unanimously.

Mr. Mahoney recused himself from this hearing. The DEP file number had been issued. Dr. Gill made a motion that was seconded to write the Orders of Conditions. The motion passed 4 - 0.
CONT'D. PH, EMERSON, 44 WIRT WAY, SE 18-1156
Representing the applicant were Michael Emerson and Daniel Orwig. Mr. Grady reported he and the applicant met with the Building Inspector regarding moving the dwelling outside the wetland. Mr. Emerson presented a revised plan that relocated the dwelling outside the wetlands. A small portion of the proposed deck would be located in the area of the existing dwelling footprint. Mr. Mahoney requested the structure be on a sonotube foundation. The Commission also asked that the applicant minimize the number of deck supports in the wetland by cantilevering the deck. Mr. Mahoney commented that normally the Commission would not approve any portion of the structure in the wetland, but this was an unique situation in that the applicant is cooperating with the Commission by moving the majority of the project to the
uplands, which is a vast improvement over the existing situation that has the structure entirely in the wetland. Mr. Mahoney made a motion that was seconded to write the Orders of Conditions for the proposed reconstruction of the dwelling as shown on the revised plan dated 9/24/02, that shows the dwelling relocated to an upland location and that only the southeast section of the deck is permitted with minimal support posts in the marsh. The motion passed unanimously.
ADMINISTRATIVE MATTERS
A motion was made and seconded to issue a Certificate of Compliance for SE 18-1062. The motion passed unanimously.
