Community Preservation Committee Meeting
Thursday, April 15, 2004

The Community Preservation Committee (CPC) held a meeting in the Mural Room, Lower Level of the Town Hall on Thursday, April 15, 2004 beginning at 8:00 a.m.  Members present included Chairman Holly Morris, Jody Hall, Tony Kelso, Arthur Vautrain, and George Wadsworth. Pat Loring was absent.  Joe Grady, Conservation Administrator was also present.

FINANCE COMMITTEE MEETING OF APRIL 13, 2004
Ms. Morris and Mr. Wadsworth reported on the meeting.  It was recommended that a letter be sent to Joel Lerner, at the Department of Environmental Management for his opinion regarding restrictions on the Delano property.

JAYCOX PROPERTY
Nancy Reed, a realtor and representative of the prospective buyer of the property presented an alternative proposal to the Town purchasing the entire parcel.  Ms. Reed explained the alternative, which was that the buyer would retain possession of a portion of the parcel for two buildable lots and the back portion of the parcel would be offered to the Town for purchase.  Mr. Grady reviewed the values of the parcel for the Town.  Mr. Wadsworth commented that one of the purposes of the CPA was to take land out of development.  Mr. Grady reported that an appraisal was done on this parcel in combination with the adjacent Merry parcel purchased by the Town in 2000.  The appraisal would need to be updated to evaluate the potential for two buildable lots.  Mr. Grady also reported that feasibility of two buildable lots may depend on the exact location of the Wetlands and Watershed Protection District as defined by the 30-foot contour.  An engineer/surveyor would need to locate the contour in the field.  Mr. Grady asked if Ms. Reed would commit to having the engineering work done.  Mr. Wadsworth made a motion that was seconded by Mr.Kelso.
        Motion: that the Town, through the Community Preservation Committee purchase an appraisal in the amount not to exceed $1,800 to determine the value of developing one or two buildable lots on the Jaycox parcel.
        Vote:  5 - in favor; 0 - opposed.  Motion passed.

WARRANT ARTICLES FOR JUNE SPECIAL TOWN MEETING
The CPC discussed potential warrant articles.  The CPC had previously committed to requesting to reserve space for articles pertaining to Delano land transfer to the Water Department, Jaycox property, and O'Neil Farm.  In addition, the CPC discussed whether to reserve space for an article for funding of the plans and specifications for the Wright Building and to finalize the use of the building.  Ms. Hall made a motion that was seconded by Mr. Kelso.
Motion:  to reserve two warrant articles for the Wright Building; one article to decide the use of the building and the second for funding of plans and specifications for construction bid documents.  The dollar value for the second article will be determined once the architectural assessment report is complete.
Vote:  5 - in favor; 0 - opposed.  Motion passed.

The Planning Director, Christine Stickney noted that there may be state preservation grant funds (Massachusetts Preservation Projects Fund) available for exterior preservation and ADA compliance for historical buildings.

The CPC discussed an article for an architectural assessment of the Tarkiln Building that would include assessing the condition of the building, the historical significance and potential uses.  Ms. Hall made a motion that was seconded by Mr. Kelso.
Motion:  to reserve space on the warrant for funding a study to assess the historical and architectural nature of the Tarkiln Building with the amount for the study to be determined.
Vote:  5 - in favor; 0 - opposed.  Motion passed.

Mr. Grady reported that Peter Buttkus, Lands and Natural Resource Department may need additional funds to complete the construction of the multi-purpose field off Keene Street.  Mr. Wadsworth made a motion that was seconded by Arthur Vautrain.
Motion:  to reserve a space on the warrant for an article for additional money for the Keene St. multi-purpose field project.
Vote:  5 - in favor; 0 - opposed.

Ms. Hall left meeting at 9:20 a.m.

DELANO PROPERTY UPDATE
Mr. Grady reported that DHCD has approved the lease for the Delano house and the Housing Authority was to take control of the house in May 2004.

ISLAND CREEK FISH LADDER RESTORATION PROJECT
John Carnuccio, Chairman of the Duxbury Bay Management Committee and consultant Bob Fultz were present for this discussion.  Mr. Carnuccio explained the project and asked the CPC to consider funding a portion of the restoration project.  He indicated it would require a total of $70,000 to complete the project as far as Island Creek Pond and to restore the fish ladder as far as Mill Pond would require $40,000.  The entire cost of the project is $167,000 but the Committee has applied for grants, donations and in-kind services. Mr. Wadsworth questioned the water quality of the ponds and noted two issues that need to be addressed were street drainage runoff and water quality samples.  Ms. Morris also indicated that the CPC had to determine if the proposal was allowable under the Community Preservation Act and asked Mr. Fultz if he knew of similar projects in other towns that used CPA funds.  Mr. Vautrain thought the project would qualify as an historical preservation project.  Mr. Kelso volunteered to check whether the project would fit under the purview of CPA.  Mr. Wadsworth made a motion that was seconded by Mr. Kelso.
        Motion:  to reserve a space on the warrant for the June Special Town Meeting for the Island Creek Fish Ladder Restoration project, with the dollar amount to be specified later.
        Vote:  4 - in favor; 0 - opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The CPC signed two bills for legal services from Town Counsel.

OTHER MATTERS
Mr. Wadsworth reported that the Water Advisory Board has approved the proposed Delano land transfer to the Water Department.
