Community Preservation Committee Meeting
Thursday, February 26, 2004

The Community Preservation Committee (CPC) held a meeting in the Mural Room, Lower Level of the Town Hall beginning at 8:00 a.m.  Members present included Chairman Holly Morris, Diane Bartlett, Jody Hall, Tony Kelso, Pat Loring, Arthur Vautrain, and George Wadsworth. Joe Grady, Conservation Administrator was also present.

OPEN FORUM
No subject was brought forth.

JAYCOX PROPERTY
Ms. Morris reported that Mr. Jaycox, the property owner of the Christmas Tree Farm off West Street has received a purchase and sale agreement for the property and that the parcel is under Chapter 61 so the Town of Duxbury will have the right of first refusal to buy the parcel.  The Committee decided to schedule a site visit, do further research on the parcel, and take no vote until the Town has received the Notice of Intent to Sell document from the property owner.

SWANSON PLAN
Mr. Grady reported that a plan of the Swanson parcel is needed for the conservation restriction.  He presented estimates for the costs of a sketch plan or an 81X plan.  The Committee also discussed having property bounds installed.  Ms. Bartlett made a motion that was seconded by Ms. Hall.
        Motion: to expend from the CPC administrative budget up to $8,100 for the cost of having the 81X plan drawn and property bounds installed as needed at the discretion of the Conservation Administrator.
        Vote:  7 - in favor; 0 - opposed.  Motion passed.

WRIGHT BUILDING
Ms. Morris reported the contract with Finegold Alexander & Associates Inc. had been signed and that the RFP Committee would reconvene to discuss potential uses for the building.

TOWN MEETING ARTICLES
Ms. Morris reported on the meeting with the Board of Selectmen regarding Town Meeting articles.  Board of Selectmen voted in favor of articles 31 and 32 but against article 33. The Committee discussed what to do about a conservation restriction on the portion of the Delano property designated for water purposes, but any action would be delayed until after Town Meeting.

PUBLIC INFORMATION HEARING
The Committee reviewed the agenda for the meeting and who would be speaking.

ADMINISTRATIVE MATTERS
The Committee reviewed the draft minutes of the meetings for 2/4/04. Ms. Bartlett made a motion that was seconded by Ms. Hall.
        Motion: to approve the minutes of the meeting on 2/4/04 as written.
          Vote:  5 – in favor; 0 – opposed, 2 - abstention (Vautrain and Loring).  Motion passed.

The Committee reviewed and signed bills for legal services from Town Counsel, and an oil delivery for the Delano house.

OTHER BUSINESS
Ms. Morris reported that the date for the landowner workshop had been changed.

The Committee scheduled a CPC meeting for Thursday, March 11, 2004 at 8:00 a.m.

O'NEIL FARM
Ms. Morris, Ms. Loring and Mr. Kelso recused themselves from this discussion and left the meeting at 9:30 a.m.  Mr. Wadsworth became Acting Chairman.  Mr. Vautrain, Ms. Hall, Ms. Bartlett and Mr. Wadsworth all gave their reasons for preserving the O'Neil farm and the conservation restriction. Ms. Bartlett made a motion that was seconded by Ms. Hall.
        Motion:  to recommend to the Special Town Meeting that the Town contribute to the purchase of the O'Neil Farm by using $1.5 million from the CPA funds for the purpose of securing a permanent conservation restriction which would remove development rights and provide public access on the property.
        Vote: 4 - in favor; 0 - opposed.  Motion passed.
