Mayor Gaughan called the meeting to order and introduced Kimberleigh Huber, participant and winner of the Library’s Summer Reading Celebration drawing to be “Mayor for the Day”. Mayor Huber led the Pledge of Allegiance. Ms. Huber was presented with a book selected by Judith Wines, Librarian and signed by the Mayor and Board of Trustees.
Mayor Gaughan recognized the staff and participants of the Bozenkill Park summer recreation program including: Adriene Bush, Camp Director; Colleen and Jeff Thomas, park and pool management; John and Brian Kowalski, campers as well as Tucker-Seinburg Hughes a long-term participant in the program. These young boys have attended the camp program several times a summer for the past several years and will not be eligible to attend next year without a counselor in training program. The Board will consider this at a later time.
Trustee Whalen presented his Comprehensive Planning Committee report detailing the steps taken in weekly meetings for the completion and implementation of the Comprehensive Plan. Goals include the presentation of a full draft plan for Board and public comment by October 2006, revised plan based on public input by November 2006, submittal to Albany County Planning Board, State Environmental Quality Review, Public Hearing, and official adoption of the plan by board resolution. Amendments of the Sub-Division and Zoning Regulations in accordance with the recommendations of the adopted plan should be completed by March 2007.
Keith Lee reported for Maple Avenue Park’s Committee that Carl Schilling has positioned the site for the shelter and hopefully with break ground in a couple of days.
Mayor Gaughan reports on the Senior Congregate Meal Program Grant funding. Two grants were submitted to support their food program and use of facilities. Unofficially we anticipate $9,800 reimbursement from the Department of Aging to assist the seniors as well as St. Lucy’s Church who has supported the senior program over the years. The Mayor meets with the Barton & Loguidice engineers as well as Mr. Thomas, developer, related to the Brandle Road Water Project.
Chief Dan Madison reports on the new Security System, NIMS and the Village Emergency plan.
Tim McIntyre reports on the construction work on 156 and on Gun Club Road
Commissioner Salerno reported on graffiti markings in the village resulting in juvenile arrests, neighborhood watch,
Trustee Vlahos made a motion seconded by Trustee Whalen and carried to approve the Treasurer’s report with one addition in the General Fund of $547.00. Roll Call: All in favor.
Public Comment
Richard Sanderson read a prepared letter expressing concern for activities relating to shelf items for sale at Ketchum’s, now under new management. Mr. Sanderson also raised concerns regarding the use of a gas barbeque grill near the fuel pumps. The Mayor requested a copy of Mr. Sanderson’s letter so that he may research the issues raised and properly answer the concerns.
Pam Crounse Jones, Brandle Road, expressed concern and dissatisfaction with the well project and the Village’s request for a property easement.
Ed Cowley made a design presentation to the Board for a replacement cupola for Orsini Park Gazebo.
The Clerk read the Legal Notice for the Public Hearing on Local Law No. 4-2006 amending Local Law No. 2-2005 known as “The Zoning Ordinance of the Village of Altamont, Albany County, New York” to extend the moratorium on subdivision regulations for 6 months or to April 1, 2007.
There was no Public Comment.
Trustee Vlahos made a motion seconded by Trustee Whalen and carried to close the Public Hearing.

Trustee Whalen made a motion seconded by Trustee Aylward and carried as follows: Local Law # 4-2006, amending Local Law No 2-2005 known as “The Zoning Ordinance of the Village of Altamont, Albany County, New York on extending the moratorium on subdivision regulations for 6 months or to April 1, 2007 to allow for the completion of the Village Comprehensive plan and completion of new water source and transmission line to the village network. Trustee Aylward made a motion seconded by Trustee Dineen and carried to approve the concept for replacement of Orsini Park gazebo cupola as per design submitted by Edward Cowley. Roll Call: All in favor
Trustee Vlahos made a motion seconded by Trustee Dineen and carried to approve tap-in fee waiver and a freeze of the $2,500 benefit assessment fee for certain Brandle Road residents. Roll Call: All in favor
Trustee Vlahos made a motion seconded by Trustee Dineen and carried to adopt the Village Emergency Plan as submitted by Commissioner Salerno. Roll Call: All in favor
The request to approve the adoption of the Altamont Police Standard Operating Procedures Manual was tabled to allow time for further review.
Trustee Dineen made a motion seconded by Trustee Aylward and carried to dispose of non-running 1997 Dodge Intrepid Police Vehicle as scrap. Roll Call: All in favor
Trustee Whalen made a motion seconded by Trustee Dineen and carried to clarify appointment of Heather DeSarbo as Deputy Court Clerk/ Provisional Court Clerk effective July 25, 2006. (August 2006 minutes). Roll Call: All in favor
Trustee Aylward made a motion seconded by Trustee Dineen and carried to approve Board Minutes of August 1, 2006 as submitted. Roll Call: All in favor
Trustee Aylward made a motion seconded by Trustee Dineen and carried to enter into Executive Session to discuss personnel issues. Roll Call: All in favor.
Trustee Dineen made a motion seconded by Trustee Aylward and carried to come out of Executive Session. Roll Call: All in favor.
Trustee Vlahos made a motion seconded by Trustee Whalen and carried to enter into Regular Session.

Trustee Dineen made a motion seconded by Trustee Aylward and carried as follows:
RESOLVED that the Mayor is authorized to direct the Village Attorney to bring disciplinary charges against a part-time police officer, accepting the recommendation of Commissioner of Public Safety Anthony Salerno, and pending the hearing of these charges is suspended from work privileges without pay for 30 days pursuant to Village Law Section 8-804.

Trustee Vlahos made a motion seconded by Trustee Whalen and carried as follows:
RESOLVED that, Village Board adopts procedural parameters for all charges brought against any person covered under Village Law Section 8-804 as follows:
- Person shall have 8 days to answer the charges in writing
- Hearing shall be scheduled before a hearing officer designated by the Mayor
- Hearing Officer shall conduct a hearing within thirty (30) days or as soon as practicable. The rules of evidence shall not apply. The hearing officer shall receive evidence in the form of testimony and documents from the Village the person charged.
4. The Village will provide a stenographer to transcribe the proceedings.
5. The Hearing Officer shall issue a written decision as to the member’s guilt or innocence and
impose an appropriate penalty within thirty (30) days of receiving the transcript from the
stenographer.
