REGULAR BOARD MEETING

November 6, 2007

Attending: Donald F. Cropsey, Jr., Building Inspector; Paul Miller, Chief AFD; Approximately 30 guests.

 

Mayor Gaughan opened the meeting with the Pledge of Allegiance.

 

Trustee Aylward made a motion seconded by Trustee Dineen and carried to accept the Treasurer’s Abstracts # 10 and # 11 as submitted. Roll Call: All in favor

 

Trustee Whalen made a motion seconded by Trustee Aylward and carried to accept the bid of $1,050 from

Richard Grant for 1993 Toro Grounds Master 325-D Riding Mower w/Blower attachment per request of Tim

Mc Intyre. Roll Call: All in favor

 

Trustee Aylward made a motion seconded by Trustee Dineen and carried to accept the resignation of part-time Police Officer Scott Mannarino effective October 5, 2007 per letter of resignation. Roll Call: All in favor

 

Trustee Dineen made a motion seconded by Trustee Aylward and carried to approve the appointment of part-time Police Officer, Robert W. Bennett, Jr., @ $15.00 per hour, subject to a 52-week probationary period, effective 11/6/2007 per request of Commissioner Anthony Salerno. Roll Call: All in favor

 

Trustee Aylward made a motion seconded by Trustee Dineen and carried to approve the appointment of Paul Miller, Chief; Mark Wertman, 1st Assistant Chief, and Robert White, 2nd Assistant Chief voted into office by the membership of the Altamont Fire Department on November 5, 2007. Roll Call: All in favor

 

Trustee Aylward made a motion seconded by Trustee Whalen and carried to approve the request of Library Lights Holiday fund-raiser to support the building fund of the new Altamont Free Library to be held during the month of December at the Gazebo in Orsini Park per request of Tony Kossmann, President.

Roll Call: All in favor

 

Trustee Aylward made a motion seconded by Trustee Dineen and carried to approve the request of ACT to hold Victorian Holiday event commencing on the weekend of November 30, 2007. Roll Call: All in favor

 

The following agenda item was tabled. Consider Change Order File 895.002 related to Power and Telephone handholes for Brandle Road Well Site and Transmission Main Improvement- Contractor: Stilsing Electric, Inc. - credit to Owner in the amount of $3,278.00; and Consider Change Order File 895.002 related to installation of 420.69 cubic yards of cobblestones to stabilize the access road at an additional cost of $13,041.39 to the Owner.

 

Trustee Marshall made a motion seconded by Trustee Aylward and carried to accept the Proposal of Barton & Loguidice, P.C., File: 704.1880 relating to Standby Generator at Waste Water Treatment Plant in the amount of $7,825 per request of Tim Mc Intyre. Roll Call: All in favor

 

Trustee Aylward made a motion seconded by Trustee Whalen and carried authorizing funds not exceeding $1,500 to secure the services of a structural engineer to assess damage on floor and drains of firehouse.

Roll Call: All in favor

 

Trustee Aylward made a motion seconded by Trustee Dineen and carried to reschedule Board Meetings due to Holidays on the following dates: December 4, 2007 meeting rescheduled to December 11, 2007; and January 1, 2008 meeting rescheduled to January 8, 2008. Roll Call: All in favor

 

Trustee Dineen made a motion seconded by Trustee Aylward and carried to approve the production and circulation of a Village Newsletter doing approximately 3-4 mailings annually at strategic times. Cost estimated at $1,200 annually. ($600 for 2007-08 fiscal year) Roll Call: All in favor

 

Attorney E. Guy Roemer re-opened the Public Hearing by reading the Legal Notice on enacting Local Law

# 5- 2007 Village of Altamont Zoning Law 2007 and rescinding in its entirety, an ordinance adopted by the

Altamont Village Board on November 9, 1971 known as The Zoning Ordinance of the Village of Altamont,

Albany County New York and amended by Local Law #2- 1985, - Local Law #1-1986; Local Law #1- 1999.

 

The following individuals addressed the Board of Trustees by letter and read into the record by Trustee Whalen:

 

Joan Kappel asks for consideration in allowing “accessory housing” which, through approval of a Special Use Permit, would allow a second unit in a single family home for rental purposes and to remain as such as long as the original resident occupies the home.

 

Tom and Kathy Coonan are opposed to the enactment of the “historic overlay district” that they describe as an unneeded control over homeowner decision making regarding their property.

 

Troy Miller writes in support of R-20M Zoning and individual ownership of resulting condominiums and townhouses.

 

John and Susan Murphy write that owning a Victorian home requires certain responsibilities and the zoning laws need to have teeth to keep this type of community.

 

Carl Schilling addressed the Board regarding his vacant property and future plans for multi-family dwellings.

Mr. Schilling wants the freedom to create what he thinks is best for his property and invites the Board to walk

the land with him.

 

Jeff Perlee speaks in favor of “M” zoning to insure preserving green space. If you remove the M from the

Zoning then you have large expensive single family homes and would create a “gap” for individuals who no

longer justify living in large homes and have to move resulting in the loss of dedicated caring people from the

Village.

 

Tom Talbot, Lincoln Avenue, ask for clarification “Presidential Estates” type housing in the Village.

 

Troy Miller states that other than the Altamont Blvd. town homes there are none in the Village. Further, the

concerns of Steve Simmons, Indian Meadow Pass, at the previous Public Hearing Meeting don’t apply to the

other side of the street. (Bozenkill Road) Mr. Miller suggested that the Board consider keeping R-20M and

regulating the size of the apartments.

 

Melanie Jakway spoke about requiring guidelines for the Historic Overlay District area.

 

Jeff Perlee acknowledged the productive hard work of the Zoning Law committee and the Board.

 

With no further comments from the public, the Board continued to discuss the areas of concerns with the Zoning

 Law 2007 proposal

 

Attorney E. Guy Roemer advised the Board of Trustees to continue the Public Hearing at the December 11,

2007 meeting at 7:45 pm.

 

Trustee Aylward made a motion seconded by Trustee Dineen and carried to approve the October 2007 Board Minutes as submitted. Roll Call: All in favor

 

Trustee Dineen made a motion seconded by Trustee Marshall and carried to enter into Executive Session to discuss Personnel issues.  All in favor

 

Trustee Dineen made a motion seconded by Trustee Whalen and carried to exit Executive Session.

All in favor.

 

Trustee Aylward made a motion seconded by Trustee Marshall and carried to enter into Regular Session.

All in favor.

 

Trustee Aylward made a motion seconded by Trustee Marshall to accept with regrets the resignation by letter dated November 5, 2007 of Attorney E. Guy Roemer effective Wednesday, November 7, 2007.

Roll Call: All in favor

 

Trustee Whalen made a resolution seconded by Trustee Aylward and carried authorizing Mayor Gaughan to secure interim legal services estimated @ $175 per hour. All in favor

 

Trustee Dineen made a motion seconded by Trustee Aylward and carried to adjourn at 9:15 pm.  All in favor.
