Mark Masinda opened the Regular Meeting at 7:35.
ZBA2013-9 Request for waiver Section 13.02 of the Willington Zoning Regulation at 156 River Road (Map 17 Lot 27A Zone R80) Owner: Tom Buccino Applicant: Martha Sternberg-Ennis
Martha Ennis was present to speak about her request for a waiver. She stated that she was looking for a place to do her art work and will not be open to the public.
Tom Buccino explained that the space M. Ennis is looking at was used for a similar use by the previous tenant (ZBA2012-3 150 sq ft space for office, and art studio) the space is located on the first floor.
M. Masinda said that the Regulations state that the Commission/Board could waive the requirement for a Special Exception upon meeting certain requirements.
B. Semprebon motion to approve the request for a waiver.
A. Poole seconded the motion. All voted in favor.
The Board Members discussed giving the Zoning Agent the authority to grant waiver for Special Exception that are similar in use and have no greater impact than the previous use.
B.Semperbon motion to give the Zoning Agent the authority to grant Special Exception Waivers, when the use does not significantly change and has no greater impact than the previous applicant. The waivers can be granted for The Mill Works located at 156 River Road.
J. Prusak seconded the motion. All voted in favor.
Minutes from the August 8th Special Meeting will be tables until the October 10, 2013 meeting.
