ZBA2013-4 Variance of Zoning Regulation Section 8 Table 8.02 for a 11’ side yard variance where 25’ is required for a garage and dining room addition at 43 Old Farms Road (Map 22 Lot 42 Zone R80) Owner/Applicant: Brian & Robin Green (Received May 9, 2013 Public Hearing June 13, 2013 Decision within 65 days after close of P.H.)
Mark Masinda said that he and Brian Semprebon were at the site walk on May 21, 2013.
M. Masinda asked the applicant to talk about the application. Brian Green explained that they would like to build a two car garage and add a dining room to their house. The garage would be attached to the house by a mudroom. B. Green said that they had already talked to the EHHD and the project was approved. Robin Green stated that the house was built before zoning.
M. Masinda asked if anyone wanted to speak either for or against the application. No comments were made. M. Masinda closed the P.H.
M. Masinda called the regular meeting to order.
Old Business
The Board Members had a brief discussion on the application.
ZBA2013-4 Variance of Zoning Regulation Section 8 Table 8.02 for a 11’ side yard variance where 25’ is required for a garage and dining room addition at 43 Old Farms Road Owner/Applicant: Brian & Robin Green (Received May 9, 2013 Public Hearing June 13, 2013 Decision within 65 days after close of P.H.)
A. Poole motion to approved ZBA2013-4 an 11’ side yard variance. J. Prusak seconded the motion. All voted in favor.
Request for reconsideration by applicant to separate the addition and the accessory building ZBA2013-3 Variance of Zoning Regulations Section 8, 8.01.02 & Table 8 & Section 9 for 25ft front yard where 50ft is required for an addition and 25 ft rear yard where 50 ft is required for accessory building at 141 Tolland Turnpike (Map 29 Lot 24 Zone R80) Owner/Applicant: Aaron and Jen Krueger (Received April 11, 2013 Public Hearing April 11, 2013 continued to May 9, 2013 Decision within 65 days after close of P.H.)
J. Rup motion to let the vote stand. No one seconded the motion.
M. Masinda motion to discuss how they would like to proceed with the request.
B. Semprebon seconded the motion.
B. Semprebon said that he could see the merit in separating the two variances, there was no objection to the accessory building and it is two projects.
J. Rup question why this application was coming before the Board again and read a portion of an email that was sent by S. Yorgensen dated May 30, 2013 saying the applicant would be reapplying. The Board Members discussed the applicant reapplying and waving the fees. The Board cannot wave the fees because the fees are set by Town Ordinances
J. Rup submitted a copy of the email he received from S. Yorgensen to be added to the record.
B. Semperbon said at the last meeting they had very little discussion on the accessory building. Most of the discussion was on the addition to the house.
B. Semperbon stated that a request had been made to split the application and the Attorney said if the decision was not published a revote could be taken.
B. Semprebon motion to separate ZBA 2013-3 into two separate requests.
A variance of Zoning Regulation Section 8, 8.01.02 & Table 8 & Section 9 for 25ft front yard where 50 ft is required for an addition.
A variance of Zoning Regulation Section 8, 8.01.02 & Table 8 & Section 9 for 25 ft rear yard where 50 ft is required for accessory building.
J. Prusak seconded the motion.
J. Rup wanted clarification on what the applicants were requesting. M. Masinda said the applicants are requesting that the two variances be put to a separate vote.
The Board Members discussed the reasons for separating the two variance, and the fees for the application.
Voting in favor were A. Poole, B. Semprebon, & J. Prusak. Opposed J. Rup & M. Masinda. Vote passed
B. Semprebon motion to approve a variance of Zoning Regulation Section 8, 8.01.02 & Table 8 & Section 9 for 25 ft rear yard where 50 ft is required for accessory building.
J. Prusak seconded the motion.
Voting in favor A. Poole, B.Semprebon, M. Masinda, & J Prusak. Abstaining
J. Rup Vote passed

New Business
ZBA2013-5 Special Exception for Outdoor Festival at 150 Village Hill Road (Wilderness Lake Campground) (Map 42 Lot 5 Zone DR) Owner: Ray Crossen Applicant: Project Sole (Received June 13, 2013 Public Hearing by July 11, 2013 Decision within 65 days after close of P.H.)
Requesting a Public Hearing date for June 27, 2013.
The Attorney stated that they would like to request a Public Hearing date of June 27, 2013. Alyssa Omlie from Reed Street Productions was present to represent Project Sole. A. Omlie explained that Project Sole collects the shoes from the runner and donates them to charitable organization all over the world. She said it is a fun and recreational activity for the family. The event is for one day. Public Hearing date is set for June 27, 2013
The Board Members discussed the availably of the Members for requested date.
ZBA2013-6 Variance of section 4.03 to build a detached garage in front of house at 33 Navratil Road (Map 14 Lot 57 Zone R80) Owner: Brad & Lori Demeule Applicant: Roger Schofield (Received June 13, 2013 Public Hearing on July 11, 2013 Decision within 65 days after close of P.H.)
Application is received and site walk set for July 9, 2013 at 7:00PM.
B. Semprebon motion to approve the minutes of the May 9, 2013 meeting.
A. Poole seconded the motion. All voted in favor.
