ZBA2013-3 Variance of Zoning Regulations Section 8, 8.01.02 & Table 8 & Section 9 for 25ft front yard where 50ft is required for an addition and 25 ft rear yard where 50 ft is required for accessory building at 141 Tolland Turnpike (Map 29 Lot 24 Zone R80) Owner/Applicant: Aaron and Jen Krueger (Received April 11, 2013 Public Hearing April 11, 2013 continued to May 9, 2013 Decision within 65 days after close of P.H.)

Aaron Kruger was present to speak about his application.  He said they would like to put an addition on the house. The front porch will be removed and a living room and mud room will be added. The addition will go along the side of the house and around to the to the front of the house. The addition cannot be put in the back because of the location of the oil tank and electrical systems. The second project is to build a garage in the rear of the property. The driveway is shared with the neighbor. Site walk was done on April 30, 2013. The Board Members discussed the location of the septic system the 4ft retaining wall in the front of the property.
J. Rup stated his concerns are with the property being located on a state highway and at the base of the hill, and possibly future expansion of the road.
A. Poole said the issue is with the property and the land not the road.
M. Masinda said the property is non conforming.
M. Masinda motion to close the Public Hearing.  B. Semprebon seconded the motion.  All voted in favor.
M. Masinda called the regular meeting to order.
Old Business

B. Semprebon motion to approve ZBA2013-3 Variance of Zoning Regulations Section 8, 8.01.02 & Table 8 & Section 9 for 41ft front yard where 90ft is required for an addition and 25 ft rear yard where 50 ft is required for accessory building
A. Poole seconded the motion.
M.  Masinda asked for discussion on the application. The Board Members discussed the amount of variance needed. The uniqueness of the property and that the property is non conforming.
Mark Masinda, Annemarie Poole and Brian Semprebon voted in favor. John Rup voted to oppose. Motion did not pass.

J. Rup motion to approve the minutes of the April 11, 2013 meeting.
 A. Poole seconded the motion. All voted in favor.

New Business
The application was received ZBA2013-4 Variance of Zoning Regulation Section 8 Table 8.02 for a   11’ side yard variance where 25’ is required for a garage and dining room addition at 43 Old Farms Road Owner/Applicant: Brian & Robin Green (Received May 9, 2013 Public Hearing June 13, 2013 Decision within 65 days after close of P.H.)

Site walk set for new application May 21, 2013 at 6:30
