ZBA2013-1 Request for modification of variance ZBA2012-8 at 333 River Road (Map 30 Lot 17 Zone DC) Owner/Applicant: B&M Realty Trust, LLC (Received February 14, 2013 Public Hearing March 14, 2013 continued to April 19, 2013 Decision within 65 days after close of P.H.)
David Held with Provost & Rovero and Attorney Joanne Paul were present to speak about the application.
T he Board Members had requested a map showing the different buildable areas on the property.
D. Held presented a buildable area map to the Board Members.
The map titled Buildable Area Exhibit No.3 Prepared for B & M Realty Trust, LLC River Road (Route 32 & Tolland Turnpike (Route 74) Willington, Connecticut Date 3/15/2013 scale 1’ = 30’ Sheet 1 of 1.
D. Held stated that the box on the map is showing what relief they are asking for.
Minimum width of 100 ft., with a maximum slope of 40% the shape would be what is shown in blue on the map.
Ralph Tulis said he has seen the map and it was good representation of the property and that it narrowed the variances that are needed.
Rick Maloney asked Attorney Paul how she would amend the recorded variance.
She said; delete the condition that ties the variance to the conceptual plan. Delete the reference to buildable area. Revise the variance to provide relief from the frontage, slope and the shape requirement.
R. Maloney asked what map the variance would be using as reference. D. Held said the one dated 3/5/2013. He also stated that EHHD had given its approval.
R. Maloney asked if they wanted to keep the 150’ setback requirement on the location of the septic system to wetlands or water course when in sand and gravel soil. They said yes.
R. Maloney said that they had asked questions of Attorney Branse as to how they could modify the variance.
R. Maloney asked what regulations they are looking for relief from.
Attorney Paul stated 4.04.02 and 4.04.02.01 relief from the slope and the shape and the width of the land.
D. Held said they would like to vary the slope requirement from 15% to 40%. Also reduce the 150’ to 100’ for the width. That is 50’ of relief.
The Board Members discussed the best use of the land.
M. Masinda asked if anyone wanted to speak either for or against the application.
No one had any comments.
The Public hearing was closed.
ZBA2013-3 Variance of Zoning Regulations Section 8, 8.01.02 & Table 8 & Section 9 for 25ft front yard where 50ft is required for an addition and 25 ft rear yard where 50 ft is required for accessory building at 141 Tolland Turnpike (Map 29 Lot 24 Zone R80) Owner/Applicant: Aaron and Jen Krueger (Received April 11, 2013 Public Hearing April 11, 2013 Decision within 65 days after close of P.H.)
Aaron Kruger was present to speak about his application. The house was built in 1836 and is within the 50’ front line set back. He said he would like to put an addition in the front of the house that is in line with the front porch. As part of the project they would also like to add a garage in the rear of the property. The driveway is shared with the neighbor. Public Hearing will be continued to May 9, 2013. Site walk will be held on Tuesday April 30, 2013 at 6:00 PM.
R. Maloney motion to continue the Public Hearing to May 9, 2013. B. Semprebon seconded the motion. All voted in favor.
M. Masinda called the regular meeting to order.

Revisions 3/5/2013” Sheet 1of 10
Variance of Regulations section 4.04.02 minimum width from 150 to 100’ and shape of buildable area.
Variance of 4.04.02.01 minimum slope from 15% to 40%.
Section 4.19, 100’ variance of the 150’ setback requirement for waste disposal systems from wetland or watercourses
Section 11.20.04.06, 150’ variance on a 200’ requirement for the location of septic system to wetlands or watercourse when in sand and gravel soils.
(No variance was given from section 11.20.04.01, 11.20.04.02, 11.20.04.03, 11.20.04.04 or 11.20.04.05)
R. Maloney seconded the motion.

R. Maloney motion to approve the minutes of the March 14, 2013 meeting.
B. Semprebon seconded the motion. All voted in favor.
