Public Hearing was open by Mark Masinda at 7:36

ZBA2013-2 Application for variance of Zoning Regulation  section 8 for side yard setback of 18ft where 25ft is required  for a 25’X40’ addition at 40 Cisar Road (Map 8 Lot 3A Zone R80) Owner: Lao Lane Xang Temple Applicant: David Lebel (Received February 14, 2013 Public Hearing February 14, 2013 Decision within 65 days after close of P.H.)
Peter Henry from Holmes and Henry Associates said that he was representing the Temple. The Temple would like to add an addition to their home. Mr. Henry handed out copies of the present house and the house with the proposed 25’X 40’ addition.  He explained to the Board Members the location of the addition. He also discussed the location of the septic system and the different elevations of the land. The addition will have a cathedral ceiling and would be enter through the bottom floor. Mr. Henry presented pictures of the present house. Mr. Henry presented a letter from an abutting property owner Keosamone Keovilay supporting the application.
The hardship is the topography and elevations of the land. The septic system is located in the rear of the property and CL&P has a right of way that goes through the property and would not allow a building in the right of way.
Chin was present to speak about the application. She stated that she is the President of the Temple. Chin explained the history of the Temple. She stated that the Temple received a Special Permit in 1996. The population has increased.  They meet once a month from 10AM to 2PM on Sunday.
M. Masinda asked if anyone wanted to speak either for or against the application.
Pam Wells an abutting property owner was present to speak in favor of the application.
Natalie Terly was also present to speak in favor of the application.
A site walk was done by Board Members on February 2, 2013

R. Maloney motion to close the Public Hearing. J. Rup seconded the motion. All voted in favor.

M. Masinda called the regular meeting to order.

Old Business:

R. Maloney motion to approve a 7’side line variance. The variance is only for the addition described in the Site plan that is part of the record. The plan is titled Plan Prepared for Lao Lane Xang Temple 40 Cisar Road Willington, CT. Limited property /Improvement Location Survey Scale 1”=20’ dated 1/10/13 File No. 93001 sheet 1 of 1 Revision 1/14/13
B. Semprebon seconded the motion. All voted in favor.

In the correspondence a letter from Attorney Branse about a variance that the Board granted for 333 River Road owner B & M Realty Trust.
B & M Realty Trust is requesting a Modification of the variance that was granted.
The Board Members discussed the previous application and asked for copies of the recording of the original meeting.

B. Semprebon motion to approve the minutes of the December 13, 2012 meeting.

 R. Maloney seconded the motion. All voted in favor.
