Public Hearing was open by Mark Masinda at 7:30

 ZBA2012-10 Variance of Zoning Regulation section 4.05 (Buildings in Front or Rear Yards) for utility garage at 48 Balazs Road (Map 44 Lot 10 Zone R80) Owner/Applicant: David Black (Received November 8, 2012 Public Hearing December 13, 2012 Decision within 65 days after close of P.H.)

Mr. Black was present to speak about his application. He said that he would like to build a utility building. He stated that he could not build it in the back yard because the land slops down.  The land on the other side is being used for the septic system and reserve septic area. The property also has wetlands. The front yard is flat and the building will not be seen from the road. A site walk was done on November 17, 2012. The Board Members looked at the map with the proposed location of the building. The building will be 30’X32’. R. Maloney asked if anyone wanted to speak either for or against the application. Mr. Anderson spoke in favor of the application.
M. Masinda motion to close the Public Hearing. R. Maloney seconded the motion. All voted in favor.

ZBA2012-11 Variance of  Zoning Regulation section 8 for a side yard setback of 15 feet where 25ft is required for a carport at 224 Village Hill Road (Map 47 Lot 20 Zone R80) Owner/Applicant: Gary A Mesick (Received November 8, 2012 Public Hearing December 13, 2012 Decision within 65 days after close of P.H.)
Gary Mesick was present to speak about his application. He presented plans of what the structure would look like. M. Masinda was present at a site walk done on November 17, 2012.  The property line is at an angle the front line is 21’6” to the side property line the rear of the car port will be 15’ from the property line.
M. Masinda asked if anyone present wanted to speak either for or against the application.
M. Masinda motion to close the Public hearing.  B. Semprebon seconded the motion. All voted in favor.

ZBA2012-12 Application for Special Exception per Section 13 of the Zoning Regulation for office space at 165 River Road (Map 15 Lot 08 Zone R80) Owner/Applicant: Virgo Municipal Finance Fund LP (Received November 8, 2012 Public Hearing December 13, 2012 Decision within 65 days after close of P.H.)

Joanna Alpert was present to speak about the application. They are managing the building and have a tenant that would like to lease a unit for general office work.
M. Masinda motion to close the Public Hearing. A. Poole seconded the motion. All voted in favor.

M. Masinda called the regular meeting to order.

Old Business:
  ZBA2012-10 Variance of Zoning Regulation section 4.05 (Buildings in Front or Rear Yards) for utility garage at 48 Balazs Road (Map 44 Lot 10 Zone R80) Owner/Applicant: David Black (Received November 8, 2012 Public Hearing December 13, 2012 Decision within 65 days after close of P.H.)

R. Maloney motion to approve the variance of section 4.05 for a utility building to be built in the front yard. The hardship is the topography of the land with wetland in the rear of the property.   The variance is approved with the condition that the use is only for what the applicant proposes in the application.
B. Semprebon seconded the motion.  All voted in favor

ZBA2012-11 Variance of  Zoning Regulation section 8 for a side yard setback of 15 feet where 25ft is required for a carport at 224 Village Hill Road (Map 47 Lot 20 Zone R80) Owner/Applicant: Gary A Mesick (Received November 8, 2012 Public Hearing December 13, 2012 Decision within 65 days after close of P.H.)

R. Maloney motion to approve a 10’ side line variance. The hardship being the house predated zoning and size and shape of the lot. The approval is only for the carport applied for in the application.
B. Semprebon seconded the motion. All voted in favor,

R. Maloney motion to approve the Special Exception for 165 River Road.
A. Poole seconded the motion. All voted in favor.

New Business
Pre Application Jeanette Rohan would like to speak to the Board about 165 River Road.

Jeanette Rohan came to the Board Members with some ideas she has for the use at 165 River Road. She would like to keep the office space and remove a barn that is in disrepair and use the other barn for a banquet facility.
Some suggesting from the Board Members was to look into the amount of parking needed and speak to EHHD about septic system. J. Rohan question to the Board is could this be an approved use for this location? The Board did not feel it was a question they could answer at this time.
