Public Hearing was opened by Mark Masinda at 7:47.

ZBA 2011-17 Application for a 10’ variance for sign (Section 19.07.02.01.01) at 156 River Road The Mill Works (Map 15 Lot 27A Zone R80) Owner/Applicant: Thomas Buccino (Received Dec 8, 2011 Public Hearing Dec 8, 2011 P.H. continued to Jan 12, 2012 extension to 30 days requested and granted. (February 9, 2012 P.H. to be closed or 35 days extension granted Decision within 65 days after close of P.H.)

Mark Masinda and Rick Maloney discussed the possibility of an extension. Mr. Buccino was not present at meeting.
Mr. Buccino called on his cell phone. Mr. Maloney asked if he had talked to DOT site supervisor.  Mr. Buccino stated that he had received an email from him saying he would not be coming out to do a site walk.
R. Maloney stated that he received an email from Susan Yorgensen saying that the DOT right of Way is separate and distinct. It is not a consideration for the variance.

Public Hearing was closed.
M. Masinda opened the regular meeting.

R. Maloney motion to approve a variance of 10’ from the road for a sign submitted with the application. J. Rup seconded the motion.

R. Maloney started the discussion stating that he felt the approval of a variance for the sign has nothing to do with the DOT right of way. The only issue is the site line and the appropriateness of where the sign is placed. The hardship is that there is nowhere else the sign can be placed. It is a commercial building in a residential zone. It is a unique property. The benefit of having the building identified is beneficial to all parties.  
M. Masinda was in agreement with R. Maloney it is the only location for the sign.
J. Rup stated that the building is a commercial building and needs a sign so that people will know who is in the building and what their products are.
 All voted in favor.

New Business:
Minutes:
R. Maloney asked to hold minutes until next meeting.
The Board Members will review the memo from Attorney Branse and discuss it at the next meeting.
