Public Hearing was opened by M. Masinda at 7:35.
ZBA2011-9 Application for Special Exception to teach martial arts, meditation & wellness training at 156 River Road (Map 15 Lot 27A Zone R80) Owner: Thomas Buccino Applicant: R & D Kempo, LLC (Received August 15, 2011 Public Hearing Sept 8, 2011 Decision within 65 days after close of P.H.)
Dan Arnini owner of Hidden Dragon Karate was present to speak about his application.
B. Semprebon asked the number of class and size of the classes he held each day.
D. Arnini submitted a hand out with the number of class and number of student in each class. The handouts will be added to the file as Exhibit #1 & #2. Most class will be held after 5:00PM.
R. Maloney asks the number of employee. D. Arnini stated he was the only employee.
R. Maloney asks Mr. Buccino if he had look at the email Ms Yorgensen has sent him regarding parking. Mr. Buccino stated that the current number of parking spaces in use at this time is 19 spaces. The total numbers of spaces available are 50 spaces 30 on site and 20 across the street. The usage for Hidden Dragon will be 10 parking spaces on site and 3 across the street. All student will be drop off in the back of the building.
M. Masinda asked if anyone present wanted to speak in favor of the application.
David Charette from the Economic Development Commission was present to support the applicant.
Silva Taylor Smith was present to support the applicant.
Andrew Daros from Stafford Spring was present to support the applicant.
Dave Smith from Stafford Springs was present to speak in favor of the applicant.
Many addition audience members spoke in favor of the applicant.

ZBA2011-10 Application for 5’8” front yard and 8’ side yard variance to add new deck to existing pool at 57 Pinney Hill Road (Map 14 Lot 89 Zone R80) Owner/Applicant: Rory McGloin (Received August 15, 2011 Public Hearing Sept 8, 2011 (Site walk on August 29, 2011) Decision within 65 days after close of P.H.)
Rory McGloin was present to speak about the application.
M. Masinda stated that he was present at the site walk.
The pool was built in 1970 by Sabrina Pools. The pool has a 3 ft concrete space around it.
R. McGloin stated that he is requesting a 5’8” front line and 8’ side yard to add a deck next to pool.
R. McGloin stated that the hardship is the slop of the road and the pre existing non conforming pool.
No one present to speak either for or against the applicant.

R. Maloney motion to approve the application with 10 parking place on site and 3 across the street. J Prusak seconded the motion. The Board Member discussed the drop off location for the student and parking. All voted in favor.

R. Maloney motion to approve a 6’ front yard variance of and 8’ side yard variance to add deck to existing pool. B. Semprebon seconded the motion. M. Masinda state that he was at the site walk. The Board Members had a brief discussion on the location of the deck and fence located over the property line.The topography of the land and slop of the yard and the curve of the road being the hardship

ZBA2011-13 Request for Waiver of Requirement for Special Exception at 156 River Road (Map 15 Lot 27A Zone R80) Owner: Tom Buccino Applicant: Jack Broderick
The Board Members discussed the email from Ms Yorgensen about waivers. M. Masinda stated the applicant is asking to waive the Special Exception because there are existing uses within this property. We have waive the Special Exception on other property but it was when a similar type business rotated in and out of that existing property. Not because there was a similar business next door.
R. Maloney stated that Ms. Yorgensen has question about use and size that need to be resolved before we can adequately address the waiver. The use is similar but the size is different and additional parking would be needed. R. Maloney stated that Ms Yorgensen needs to speak to Mr. Buccino and address these issue.
