Public Hearing was called to order at 7:30 PM by Mark Masinda.

Public Hearing:
ZBA2010-9 Application for 40’ rear yard variance to build 2nd story addition on existing foot print at 24 Balazs Road (Map 44 Lot 15 Zone R80) Owner/Applicant: James F Poirier (Received January 13, 2011 Public Hearing for February 10, 2011
B.Semprebon recused himself from the application and was seated in the audience. W. Bland was seated for B. Semprebon.
Annemarie Poole stated that a site walk was held on January 29, 2011 William Bland, Jerry Lopes & Brian Semprebon were present.
William Bland presented pictures that he had taken at the site walk.
James Poirier owner of 24 Balazs Road was present to speak about the application.
He stated that he would like to put a 2nd story addition on the house. He stated the addition would be on the same foot as the existing house. James Poirier stated the house was renovated in 1985 and a foundation was poured at that time.
Board Member discussed how the addition would be built on the existing foot print and would not be closer to the water. They talk about the open deck and the deck that is covered. They discussed the foundation and the concert slab.
M. Masinda asked if anyone wanted to speak either for or against the application.
B. Semprebon now seated with the public stated that he had issue with the accuracy of the application. The hand drawn map has four lot lines and the map of record has three lot lines. The numbers on the hand drawn map do not match the numbers on the map on file. The 10’ being asked for is based on a drawing that is wrong.
B. Semprebon stated that without a survey there is no way to tell how far the house is from the property line.
The Board Members discussed the need for a more accurate survey before they could issue a variance. A variance cannot be given if any part of the structure is over the property line.
James Poirier stated that Eastern Highland approved up to five bedrooms on the present system.
The Board Members discussed the distance the house was from the lake, if the existing deck and stairs could be over the property line and in the common area, how much of a variance would be need and how accurate the figure would be.
The Board Members felt that they need more accurate dimension before a variance could be issued.
A. Poole motion to continue the Public Hearing to the March 10, 2010 meeting. J. Rup seconded the motion. All voted in favor.
