Regular Meeting:

Mark Masinda called the meeting to order at 7:37.

ZBA2009-4 Appeal of the decision of Zoning Agent (section 7.07.04) 88 River Road (Map 10 Lot 17 Zone R80) Owner/Applicant: Paula Beebe (Received August 13, 2009 Public Hearing September 10, 2009 decision by November 12, 2009) Site Walk August 19, 2009

M. Masinda asked if anyone wanted to start the discussion.
B. Semprebon stated that S. Yorgensen had answers the two questions that were asked.
What is the definition of a separate outside entrance, and what is considered to be the living space of the principal dwelling?
J. Lopes stated that he had email S. Yorgensen for clarification on separate living space. He stated that the entrance and landing are consider livable space.
The Board Members discussed single family dwelling, In-law apartment, separate outside entrance and In-law apartment within a single family dwelling.
Discussion was held on zoning regulation section 3.47 definition of dwelling and 3.48 definition of dwelling, one-family.
The Board Members stated that the landing or mudroom is considered part of the living space.

B. Semprebon motion to approve the application with the conditions the property remain in the condition that would continue to allow the entrance area to be in compliance with the interpretation of living space. J. Rup seconded the motion. All voted in favor.

B.  Semprebon made a motion to approve the minutes of September 10, 2009. J.  Lopes seconded the motion. All voted in favor.

The Board Members discussed Building & Zoning permit process.
