Public Hearing:
Mark Masinda called the Public Hearing to order at 8:07.

ZBA2009-4 Appeal of the decision of Zoning Agent (section 7.07.04) 88 River Road (Map 10 Lot 17 Zone R80) Owner/Applicant: Paula Beebe (Received August 13, 2009 Public Hearing September 10, 2009 decision by November 12, 2009) Site Walk August 19, 2009

Paula Beebe read a letter to the Board Member. (Copy of letter included)
M. Masinda asked if anyone wanted to speak.
Mark Jones, Dave Wilson, Bill Blanch and others spoke in support of the applicant.
Mike Kowalski stated that he was the new builder. He said that he went to the building department and spoke with Mr. Staveski to see if building permit were in order.
B. Semprebon asked the contractor about the plans and how much of the project need to be complete when he took over.
Mr. Kowalski state that most of the building was done, the workmanship was in question and painting need to be completed.

Discussion was held on the issue of hardship.

M. Masinda stated that any decision that is made about the property will stay with the property forever.
M. Masinda stated that the regulations do allow for In Law apartment with access through the living space of the principal dwelling.
J. Lopes stated that it was possible for the upstairs to be close off and become a separate living space.

M. Masinda asked P. Beebe what the original application was for.
P.  Beebe stated that she did not realize that the builder was only asking for second floor bedroom.
B. Semprebon stated that the original building permit did not say anything about stairs.

M. Masinda stated that Mr. Jones did offer an option. The option is to close off the stair way in the kitchen area and also on the second floor and use the central stairway.  P Beebe did not think the option was good.
Discussion was held on using a difference entrance.
Mr. Kowalski asked the Board Members about the regulations. What is considered living space?
Would a mudroom be considered part of the living space?
P. Beebe asked the Board Members if the entrance way was considered part of the living space.
No other public was present to speak against the application.
J. Lopes motion to close the Public Hearing. B. Semprebon seconded the motion. All voted in favor.

Regular Meeting:
The regular meeting was called to order by M. Masinda at 8:48

                             
Old Business:

 B. Semprebon stated that he would like a clearer definition of living space. Is the space at the bottom of the stairs living space?
Discussion was held on what is living space? What would happen if they tried to sell the property?  What would happen if the application was not approved? Is the entrance part of the dwelling?
M. Masinda stated that he would e-mail S.Yorgenen and ask for clarification on these questions.
B. Semprebon made a motion to continue discussion to next meeting. J. Rup seconded the motion. All voted in favor
