Public Hearing:

File  #ZBA2007-6 Application to locate a new shed (10ftX14Ft) to left side of the driveway entrance 100ft from Hall Hill Road. 28 Hall Hill Road (Map 9 Lot 10 Zone R80) Owner /Applicant John P Phelps (Received 8-9-07 P.H. 9-13-07 decision within 65 days after close of P.H.

Site walk was done on September 10, 2007 at 6:00 A.Poole, M. Masinda. B Semprebon and N. Wilson was present.

M. Masindia opened the Public Hearing at 7:30. J Phelps was present at the public hearing.
M. Masinda asked Mr. Phelps to tell the Board member about his application.
Mr. Phelps stated that his house was located on the corner of Hall Hill Road and Timber Lane. The house is set in the far back side of the property. Having a corner lot gives us two frontages according to the zoning regulation. The lot has a sloping back yard; a pool is located on one side, and a utility building is already in place on the other side. There is no remaining property available in the back yard to put the shed.
The only location left was in the driveway, because of the lot location it is considered the front yard
R. Maloney asked what was designated as the front line.
J. Phelps state it was Timber Lane. And that Hall Hill is the sideline.
R. Maloney states that relief was need from regulation 4.03 and 4.05.
M. Masinda asked if anyone wanted to speak either for or against the application.
Mr. Sherman as an abutter does not oppose the shed being placed in the driveway.
M. Masinda closed the Public Hearing.

Mr. Rup arrived and was seated.

File # ZBA2007-7 Application for addition of a family room and enclosed porch and a covering of the entrance door with an existing slab. 164 Lohse Road (Map 15, Lot 12, Zone R80) Owner/Applicant: James E Dinger (Received 8-9-07 P.H. 9-13-07 decision within 65 days after close of P.H.)

Mrs. Dinger was present and stated that they would like to enclose and cover the front door and existing slab. The hardship being the whole house is within the 50ft required set back.
Discussion was had about the hardship as non-conforming the house being to close to the road.
M. Masinda asked if anyone would like to speak either for or against the application. No one was present.
M. Masinda closed the P.H..

File #ZBA2007-8 Application to build a garage next to existing house 202 Willington Hill Road (Map 13 Lot 67 Zone R80) Owner/Applicant Matthew Beebe (Received 8-9-07 P.H. 9-13-07 decision within 65 days after close of P.H.)

Mr. Beebe was present to speak about the application he stated that they would like to build a garage next to the house located on Rt 320 the house  was built in1948 pre zoning.
Mr. Beebe explained that there is a steep hill in the back of the house and his well is also located there. The location of the well and the topography of the land he feels are the hardship.
Mr. Beebe stated that instead of digging into the hill which could upset his well he would like to locate the garage at the end of his driveway. A 4 inch slab will be the foundation of the new garage.
M. Masinda asked if there would be separation from the foundation and the well.
M. Beebe stated that there would be a 25’seperation.
M. Beebe is asking for a 20’ side line variance and a 56’ front line variance.
R. Maloney asked if he had any concerned about encroaching on his neighbors property.
Mr. Beebe stated that his neighbor had no problem with the location of the garage being so close to the property line.
M. Masinda asked if anyone present would like to speak either for or against the application. No one was present.
M. Masinda closed the P.H.

Regular Meeting:
Regular meeting called to order at 8:00.

Minutes:
Motion was made by R Maloney to table the minutes till the end of the meeting. A Poole seconded the motion.
All voted in favor

Correspondence:
A quarterly newsletter from the Connecticut Federation of Planning and Zoning Agencies was in the correspondence folder.

New Business:

File#ZBA2007-9 Application to build a two car garage off an existing footprint slightly altered at 22 Old River Road (Map 43 Lot 7 Zone R80) Owner/Applicant Michael Anthony Robertino (Received Sept 13, 2007 P.H. Oct 11, 2007 decision within 65 days after close of P.H.)
M Anthony was present and stated that he could not make the P.H. but would be sending   a representative and asked what kind of question he should be prepared to answer. The Board gave his some suggestion.
A Site walk was set for 9-17-07 at 6:00 PM. And the P.H. for 10-11-07.

R. Maloney motion to approve application 2007-8. A. Poole seconded motion.
A 27’ front line variance and a 34’ centerline of road variance 21’ side line variance.  The variance is only for the proposed construction of a garage as detailed in the application.

Unanimous.  A 27’ front line variance and a 34’ centerline of road variance 21’ side line variance for a 30 x 24 ft. garage is approved.

R. Maloney made a motion to approve application 2007-7. B. Semprebon seconded motion.

The board had a discussion about the hardship. A Poole proposed that the variance be limited to the sketch submitted with the application. The hardship is the house is non compliance with current Zoning Regulation.
The variances granted are a 27’ front line for the proposed enclosed front porch over the existing slab, a 20’ variance for the 10’ X 14’ porch on the right side of the house and a 10’ variance for the addition of a family room on the back rear of the house. The variance is limited to the sketch submitted with the application.

Unanimous. The Board Member discussed the hardship two front lines and the topography of the land.

Motion to approve relief from section 4.03 and 4.05 of the Zoning Regulations

J. Rup abstained. Voted in favor, A.Poole, M. Masinda, R. Maloney, B. Semprebon. Variance granted to locate a shed in the front yard.
