ZONING BOARD OF APPEALS
MINUTES
September 14, 2006

Commission Members present:     Mark Masinda, Chairman
                                        R. Maloney, Vice Chair

PUBLIC HEARING:

·       A public hearing opened at 7:31 pm. for File #2006-09 -  Application for modification of a variance to replace handicap ramp and 4’ deck with 8’ covered porch at 383 River Road (Map 29, Lot 2-0A) Owner/Applicant: Knights Associates, LLC (Received 8/15/06, Public Hearing 9/14/2006)

Merritt Knight was present and discussed the dimensions of the covered porch proposed for the property.  He also explained that the roof over the porch would only be one story high and Mr. Knight explained he wanted an escape route off the second floor if there was ever a fire.

Members discussed the footprint of the existing deck and handicap ramp and the fact that the footprint would not change or be any more non-conforming.

N. Wilson made a motion to close the hearing, R. Maloney seconded.  Vote: All in favor

Hearing closed at 7:48 pm.

Regular meeting called to order at 7:48 p.m. Members present – same as above.

Mr. Masinda presented the minutes of 7/13/06 and asked if any members had any corrections.  Mr. Rup said his name was spelled wrong on the last page 2nd paragraph from bottom.  Mr. Wilson made a motion to approve the minutes, Mr. Rup seconded.  Vote:  All in favor.

New Business:

File 2006-10 – Application for a variance to construct an attached garage and porch to existing house at 61 Krivanec Rd. (Map 27, Lot 14-0B, Zone R80) Owner/Applicant: Douglas Grimason.  (Received 9/14/06, Site Walk was scheduled for 9/25/06 at 6:30 p.m., Public Hearing on 10/12/06, Decision by 12/14/06)

Mr. Grimason explained that the position of the house on the lot and location of window were what he considered hardships also the septic location.

Old Business:

·       File #2006-07 - Application for a variance to construct a porch across and to right side of house on property at 49 Schofield Road (Map 43, Lot 18) Owner/Applicant: Robert J. Dickson, Sr.

   Mr. Gary Dickson and John Jenkins were present and Mr. Dickson submitted a request for an extension.  Mr. Maloney moved to accept request, Mr. Wilson seconded.  Vote:  All in favor.

The commission decided they would schedule a special meeting of the members eligible to vote to act on Mr. Dickson’s application for a variance.  Ms. Jordan, ZBA Clerk would contact Ms. Poole when she returned from vacation and see if 9/20/06 was okay with her.

File 2006-09 – Mr. Wilson made a motion to accept application as submitted. Mr. Maloney seconded.  

It was decided that an 8’ covered porch as proposed on print submitted 9/13/06 be approved.  Vote: All in favor.  Motion carried.

Discussion:  Commission discussed that either Mondays or Thursdays, except for 10/12/06, would be good days to meet with Mark Branse for a seminar.  Ms. Jordan will contact Atty. Branse and schedule a special meeting.

Mr. Maloney also explained that asking for legal advice from the attorney should be done as last resort after first discussing any problems with the Planning and Zoning agents who are professionals in their field.

Adjournment:  Mr. Wilson made a motion to adjourn, Mr. Maloney seconded.  Vote:  All in favor.
