ZONING BOARD OF APPEALS
MINUTES
May 11, 2006

Commission Members present:     Mark Masinda, Chairman
                                        Richard Maloney, Vice Chairman
                                        Norman Wilson, Secretary
                                        Annemarie Poole
                                        Brian Semprebon


PUBLIC HEARING:

·       File 2006-05 – Application for a 90’ zone yard variance for a pump station and related structures at the Senior Housing Complex at 60 Old Farms Road. (Map 17, Lot 1, Zone DER) Owner/Applicant:  Town of Willington.

Hearing opened at 7:34 p.m.  Present for the application:  John Patton, Chairman of Senior Housing Committee; Jim Erickson of Lenard Engineering, Inc.; Mike Eldredge, 1st Selectman.

Mr. Maloney asked what the hardships are for requesting the variance.

John Patton explained that the location of the four drilled wells as per DPUC, wetlands on the property and the topography of the area.

Mr. Masinda reported that all abutters have been notified.

Mr. Wilson asked about the location of the pump station and how that was determined.

Mr. Erickson of Lenard Engineering explained that the location of the pump house in relation to the wells.  It is central to all the wells and has access from the parking area so that vehicles could get to it.  He also explained that the generator will have a hospital grade muffler to lessen the noise, it is the highest grade muffler that can be installed.  The generator will be run on diesel that will be stored under the generator.  The generator will provide emergency fire/water protection when the power goes out.

Mr. Masinda asked if there were anyone to speak either for or against this application.  There were none.

Mr. Maloney made a motion to close the hearing.  N. Wilson seconded the motion.  Vote:  all in favor.  Hearing adjourned 7:52 p.m.

Regular meeting called to order at 7:53 p.m. Members present – same as above.

Mr. Masinda presented the minutes of 3/9/06 and asked if any members had any corrections.  

B. Semprebon stated that in paragraph 3 of the minutes concerning the site walk at 89 Lohse Road, Lisa Jordan was present and not her husband Keith Boyle.  

Mr. Maloney made a motion to approve the minutes as amended.  Ms. Poole seconded.  Vote:  All in favor.

Mr. Masinda read a resignation letter from John Prusak.  Mr. Wilson made a motion to accept the letter, Mr. Maloney seconded.  Vote:  All in favor.

New Business:  File #2006-06 – An application for a variance to remove a leaking roof, raise walls by 32” and install new peaked roof on property at 143 River Road (South Station Firehouse) (Map 15, Lot 14A) Owner/Applicant:  Willington Fire Department., Inc. #1.  

Stuart Cobb, Asst. Chief. Showed a power point presentation showing the building and explaining what renovations needed to be done.  He reported that he had gone to CIP and had gotten approval to raise the walls and peak the roof.  He also said the footprint would stay the same the only thing would be increasing the cubic footage.  

The Commission scheduled the public hearing for June 8, 2006.  Mr. Malone asked if Mr. Cobb could sketch a scaled drawing of the property and also the existing building and the proposed building.  The Commission did not feel a site walk was necessary.

Old Business:

A question was raised by B. Semprebon concerning the request by the Town for a variance and setting a precedence regarding hardships. Mr. Maloney explained the State statute regarding unique uses that do not affect the district as a whole.

Mr. Wilson made a motion to grant a 90’ zone yard variance that only applies to uses, buildings, or structures for which the variance was sought and only in the location on the lot as stated on the variance to be recorded in the land records.  Mr. Maloney seconded.  Vote:  All in favor, motion carried.

Discussion:  Mark Masinda proposed the name of Jack Rup of Fisher Hill Road to fill the vacancy created by the resignation of John Prusak.  Mr. Maloney made a motion to accept the proposal, Mr. Semprebon seconded.  Vote:  All in favor.

Mr. Macinda asked that Ms. Jordan draft a letter to the Selectmen proposing Mr. Rup.

Mrs. Poole made a motion to adjourn, Mr. Wilson seconded.  Vote:  All in favor.

Meeting adjourned at 8:15.
