ZONING BOARD OF APPEALS
MINUTES
December 8, 2005


PUBLIC HEARING:

·       File #ZBA2005-08 – Application for a 35’ variance to construct a detached garage on property at 176 Moose Meadow Rd (Map 31, Lot 7) Owner/Applicant: Peter Kristoff (Received 11/10/05, Site Walk was scheduled for 11/19/05 at 3 p.m.; Public Hearing scheduled for 12/8/05; Decision by 2/9/06)

Hearing opened at 7:30 p.m.
Members present: Richard Maloney, Norman Wilson, John Prusak (arrived at 7:36 pm), Annemarie Poole, Mark Masinda seated for Pat Wright.  Also present: Peter & Donna Kristoff.

A site walk was held on November 19, 2005 at 3 pm.  A. Poole, M. Masinda, N. Wilson and Mr. Kristoff were present.

Mr. Kristoff explained that the hardship was the topography and reserve area for the septic system and the only reasonable place for the garage was where it is proposed.  The lot is very steep and narrow.  He is proposing to build the garage into the hillside in the same fashion as the existing house.

There was no one at the hearing either for or against the application.

R. Maloney made motion to close hearing, N. Wilson seconded.  Vote:  All in favor.
Hearing closed at 7:43 p.m.


REGULAR MEETING:  Members present:  Same as above.

CALL TO ORDER:  7:44 p.m.  Mr. Maloney requested that Old Business be decided next.  All in favor

OLD BUSINESS:    

·       File #ZBA2005-08 – Application for a 35’ variance to construct a detached garage on property at 176 Moose Meadow Rd (Map 31, Lot 7) Owner/Applicant: Peter Kristoff

N. Wilson made a motion to discuss the application, J. Prusak seconded.

Mr. Wilson explained that during the site walk he measured from the proposed garage to the property line and determined that it was fifteen feet, confirming the need for a 35’ rear line variance.

After some discussion Mr. Wilson amended the motion to read: To grant a 35’ rear line variance to construct a detached garage.  Mr. Prusak seconded the motion.  Vote:  All in favor.


MINUTES:  A motion was made by N. Wilson to approve the November 10, 2005 minutes with the following corrections: Mr. Patton explained that the hardship for his variance was the non-conformity of the existing house; and the meeting was adjourned at 7:50 pm not 7:40, J. Prusak
seconded the motion.  Vote:  All in favor.

NEW BUSINESS:
·       File #ZBA2005-09 – Application for a 3’ side yard variance to construct an extension on an existing garage on property at 25 Navratil Rd (Map 14, Lot 57K) Owner/Applicant: Christopher James (Received 12/8/05, Site Walk was scheduled for Saturday 1/7/06 at 10 am; Public Hearing scheduled for 1/12/06; Decision by 3/9/06)

CORRESPONDENCE:   A review of a letter from Attorney Branse to Susan Yorgensen dated November 21, 2005 concerning “ZBA’s granting of a variance from a pre-condition for a special permit.”  

DISCUSSION:        It was decided to have Ms. Jordan make copies of all pertinent information concerning the correspondence from Atty. Branse, any subsequent files and minutes and send to members to go over before the January meeting where it will be discussed.

J. Prusak has been appointed Treasurer for the Town of Willington and because of the new responsibilities was thinking of resigning from the Commission.  After a discussion by the members R. Maloney made a motion to make M. Masinda a full member, replacing J. Prusak and having Mr. Prusak become an alternate effective December 31, 2005.  N. Wilson seconded. Vote: All in favor.

ADJOURNMENT:  A.  Poole made a motion to adjourn, M. Masinda seconded. Vote: All in favor.
