ZONING BOARD OF APPEALS
MINUTES
October 14, 2004

PUBLIC HEARING: Members seated: R. Maloney, Chr., N. Wilson, Secy., P. Wright, A. Poole, J. Prusak seated for C. Deskus.
        
1.      File 2004-14 – Application for a Special Exception for an Engineering Design Firm at 156 River Road.  Owner: Thomas Buccino; Applicants: Timothy P. Morello and John C. Dybowski.

Hearing opened at 7:30 p.m.  Members present – same as above.  Thomas Buccino and John Dybowski were also present.

A site walk was held on 10/7/04.  Present for site walk were T. Buccino, A. Poole, N. Wilson, M. Masinda, and J. Prusak.

Mr. Dybowski explained that they designed computer boards that talk to computers.

Inland Wetlands Agent Susan Yorgensen submitted a memo stating there does not appear to be any impact upon regulated areas.  Eastern Highlands Health District submitted a memo stating the total proposed activities and number of employees does not constitute a change of use for the property.     

No one was present to speak either for or against the application.

Hearing closed 7:39.

REGULAR MEETING:   Members present:  Same as above .

CALL TO ORDER:  Opened at 7:40 p.m.

OLD BUSINESS:

1.      File 2004-11 – Application for an 11’ side line variance to construct a 23’ x 10’ deck
and 15’ x 30’ above ground pool at 69 St. Moritz Circle.  Owner/Applicant:  Donna McGuinness.

R. Maloney asked J. Prusak if he had listened to tapes of the previous meeting.  Mr. Prusak stated he had not.  Mr. Maloney stated that Mr. Prusak could be included in the discussions but would have to refrain from voting.

P. Wright was not quite ready to make a decision.

R. Maloney made a statement concerning following regulations.

The discussion was about an 8’ fence being included in the variance approval. The fence to be constructed along the boundary line and deck to protect light, glare and noise from the neighbors property.  The fence would go the entire length of the pool and deck along the property line for approximately 45’ and a secondary fence on the deck from the house to pool.

N. Wilson made motion to incorporate fencing in the approval of a 11’ side line variance. A. Poole seconded motion.  

Vote: R. Maloney, A. Poole, N. Wilson for; P. Wright against.  Variance denied.

2.      File 2004-14 – Application for a Special Exception for an Engineering Design Firm at
156 River Road.  Owner: Thomas Buccino; Applicants: Timothy P. Morello and John C. Dybowski.

N. Wilson, A. Poole and J. Prusak commented about how gracious Mr. Buccino was and what a beautiful job he had done with the building.

N. Wilson made motion to approve special exception.  P. Wright seconded.  

Vote:  All in favor.

MINUTES:        P. Wright made a motion to approve July, August and September minutes.  J. Prusak seconded.  Vote:  All in favor.

DISCUSSION:

        P. Wright submitted a paper “How to Survive an Application for a Special Exception/Variance.  All members got a copy to look over and it will be formally approved at the next meeting.  A copy will be sent to the Selectmen’s meeting when it is approved.

        R. Maloney against reminded the Commission members to start thinking about the election of officers coming up at the December meeting.  

        There was also a reminder that there is no November meeting.

Motion made by R. Maloney made a motion to adjourn meeting, seconded by N. Wilson.
Vote: All in favor.  Meeting adjourned at 8:10 p.m.
