MINUTES
June 10, 2004
PUBLIC HEARINGS: Members seated: R. Maloney, Chr., N. Wilson, Secy., P. Wright, Annemarie Poole seated for C. Deskus, Vice Chr., and John Prusak seated for T. Smith.
1. File 2004-03 – Application for a Special Exception at 165 River Road. Owner: 165 River Road, LLC; Applicant: ABC Group.
Hearing opened at 7:35 p.m. Present for hearing were members as stated above and David Caron owner of 165 River Road, LLC. Mr. Burrows of ABC Group was not present and had not signed the application.
A site walk was held on 5/17/04 for all applicants of 165 River Road. Present for site walk were members: N. Wilson, A. Poole and R. Maloney. Mr. T. Coombs co-owner of 165 River Road, LLC was also present.
Mr. Caron discussed issue of having to come before the board every time he rents space to a new business. He felt that 165 River Road, LLC having a special exception would cover any businesses that were leased space in the building.
R. Maloney explained that each business needed to apply for a special exception according to the zoning regulations. The exception is business specific and they were the applicants, Mr. Caron and 165 River Road, LLC were the landlords/owner. Mr. Maloney also explained the board needed more information from each business as to what they were doing, if they had signage, how many employees, and how many parking spaces were allotted to their business. The applicants also needed to attend the hearing to answer any other questions the board or abutters may have.
Hearing continued to July 8th at which time the applicant needs to supply list of equipment on site, number of employees, hours of operation and sketch of office space and square footage allotted to their business.
Mr. Maloney asked if there was anyone present that wanted to speak either for or against this file and the other businesses at 165 River Road.
Caroline Steele, 10 Depot Road, mentioned that the landlord had been through this before and should have known the procedure.
Elliot Steele, 10 Depot Road, was concerned about the drilling equipment on the property and the noise created early in the morning. He was also concerned about the septic and that the problems they were having with bacteria in their well water may be due to activities at 165 River Road.
Chris Sampson, 10 Depot Road, wanted to know more about traffic, well usage, toxic seepage and the volume and supply of water used on the property.
Some of the board members also had concerns. Mr. Maloney told Mr. Caron he needed to request in writing a waiver of sewage disposal system plan.
Mr. Caron became upset and left the meeting.
2. File 2004-04 – Application for a Special Exception at 165 River Road. Owner: 165 River Road, LLC; Applicant: Northeast Realty.
Hearing opened at 8:00 p.m. Present for hearing were members as stated above and David Caron owner of 165 River Road, LLC. Business owner was not present and had not signed the application.
Hearing continued to July 8th at which time the applicant needs to supply list of equipment on site, number of employees, hours of operation and sketch of office space and square footage allotted to their business.
3. File 2004-05 – Application for a Special Exception at 165 River Road. Owner: 165 River Road, LLC; Applicant: World Class Wire & Cable, Inc.
Hearing opened at 8:01 p.m. Present for hearing were members as stated above and David Caron owner of 165 River Road, LLC. Business owner was not present and had not signed the application.

4. File 2004-06 – Application for a Special Exception at 165 River Road. Owner: 165 River Road, LLC; Applicant: Cooksey Keepsakes.
Hearing opened at 8:02 p.m. Present for hearing were members as stated above and David Caron owner of 165 River Road, LLC. Business owner was not present and had not signed the application.

7. File 2004-09 – Application for variance at 41 Timber Ln. Owner/Applicant: Timothy Cleaver.
Hearing opened at 8:05 p.m. Members were present as stated above. Mr. Tim Cleaver was also present.
Mr. Cleaver explained the hardship of the property was that the topography, position of the house, the bulkhead, well and septic made putting the addition anywhere else improbable.
Mr. Andrew Seidl and Ms. Penny Hunt of 43 Timber Lane spoke in favor of the variance.
Mr. Rick Soucy, 64 Latham Rd also spoke in favor of variance.
Mr. Ken Andrew of 35 Timber Lane was concerned about any trees being cut down. Mr. Cleaver assured him he was not cutting any trees.
Hearing closed 8:10 p.m.

Board asked A. Jordan to find the historic number of people for the building, also for well and septic.
They were concerned as to what is used as far as equipment and chemicals on the property.
The board members also felt it was up to the applicants to do their jobs and supply the information needed to review their applications.
7. File 2004-09 – Application for variance at 41 Timber Ln. Owner/Applicant: Timothy Cleaver.
P. Wright made a motion to approve an 8’ side line variance. N. Wilson seconded.
