MINUTES
September 11, 2003
PUBLIC HEARINGS:
· File #2003-17 – Hearing opened at 7:32 p.m. for application for a 31’ front line variance to erect a 2’ x 5’ masonry fireplace within the 50’ front yard setback at 56 Old Farms Road (Map 22, Lot 55, R80 zone) Owner/Applicant: Janice Deskus.
Members present: C. Csiki, R. Maloney, N. Wilson seated for R. Manaskie, and T. Smith seated for R. Claus. Also present: Janice Deskus.
A site walk was held on 9/9/03. Present for site walk: C. Csiki, R. Maloney, T. Smith, N. Wilson and Mr. & Mrs. Chris Deskus.
Mrs. Deskus explained that the hardship was that the house was built in 1840 and was situated within the 50’ setback.
During site walk board members measured from the centerline of the road and determined that the variance for the chimney should be 31’ instead of the 20’ originally asked for because they used the 75’ rule.
No correspondence was presented for or against this variance and no one was present to speak for or against the variance.

· File #2003-18 – Hearing opened at 7:41 p.m. for application for a Special Exception under Section 13 of the Willington Zoning Regulations for property at 148 River Road (Map 15, Lot 27, R80 zone) Owner: Francis & Gina Kosowicz; Applicant: Martino Fine Books.
Members present: C. Csiki, R. Maloney, N. Wilson seated for R. Manaskie, T. Smith seated for R. Claus, and C. Deskus filling vacancy of D. Brown. Mr. & Mrs. Martino and Ms. Susan Danillo were also present.
A site walk was held on 9/9/03. Present for site walk: C. Csiki, R. Maloney, T. Smith, N. Wilson, Mr. & Mrs. Martino and Ms. S. Danillo.
It was noted that the portion of the Zoning Regulations under which this appeal was based is Section 13 not 9 and was so amended by C. Csiki and initialed by Mr. Martino on the application.
It was discovered that Ms. Yorgensen and Wetlands Agent had not submitted a memo concerning wetlands and soil erosion. A request will be made of Ms. Yorgensen.
Mr. Martino explained that he would be storing and warehousing books at the Hall Complex and would be moving his office to his home because of the expense. He would be the only employee and would be coming into the warehouse occasionally to ship and receive books.
The Board asked if there was designated parking and Ms. Danillo stated that there were approximately 17 spaces available and 5 are taken but they have not designated spaces given to each tenant. The Board asked that a designated plan be submitted.
No correspondence was presented for or against this special exception and no one was present to speak for or against the application.

Members present: C. Csiki, R. Maloney, N. Wilson seated for R. Manaskie, T. Smith seated for R. Claus, and C. Deskus filling vacancy of D. Brown.
CALL TO ORDER: Opened at 8:00 p.m.
MINUTES: Mr. Maloney made a motion to approve minutes of 8/7/03. Mr. Wilson seconded. No Discussion. Vote: All in favor.
CORRESPONDENCE:
Letter of resignation from Mrs. Brown, Read into record by C. Csiki.
Chr. Csiki letter to Mrs. Brown commending her on her service, read into the record by C. Csiki.
Memo from Atty. Branse regarding Dobson Boatyard vs. PCZ.
NEW BUSINESS:
· To fill vacancy made by D. Brown’s resignation. Motion made by R. Maloney that Chris Deskus fill the vacancy, seconded by N. Wilson. Vote: All in favor.
· To fill position of secretary. Motion made by T. Smith that C. Deskus fill the vacancy, seconded by R. Maloney. Vote: All in favor.
PRE-APPLICATION:
· File #2003-19 – Application for variances to construct a gazebo in front yard and construct an in-ground pool within 10’ of the side yard on property at 36 Tolland Tpke. (Map 30, Lot 31, R80 Zone) Owner/Applicant: Charles & Cheryl Woodworth. (Received 9/11/03; Site walk 10/4/03 at 9:00 a.m.; Hearing 10/9/03; Decision by 12/11/03). Application accepted without opposition.
Chr. Csiki put into the record that he received a call three weeks ago from Mr. Woodworth concerning the position of the garage. Mr. Woodworth also telephoned Mr. Csiki on 9/10/03 concerning getting his application on the agenda.
OLD BUSINESS:
· File #2003-17 – R. Maloney made a motion, seconded by N. Wilson, to approve a 31’ front line variance to erect a 2’ x 5’ masonry fireplace (and only as stated for that use as detailed in the application) within the 50’ front yard setback at 56 Old Farms Road
Members present: C. Csiki, R. Maloney, N. Wilson seated for R. Manaskie, and T. Smith seated for R. Claus.
Mr. Wilson stated that the proposed chimney did not increase the non-conformity of the house (closeness to the road).
Vote: All in favor.
· File #2003-18 – R. Maloney made a motion, seconded by T. Smith, to approve a Special Exception under Section 13 for property at 148 River Road. Owner: Francis & Gina Kosowicz; Applicant: Martino Fine Books.
All voted to approve the Special Exception of application 2003-18 for Martino Fine Books upon submission of documentation from Inland Wetlands, soil erosion and a parking plan.
Vote: All in favor.
