MINUTES
June 12, 2003
PUBLIC HEARINGS:
· File 2003-03 –Application for a variance to enclose an existing structure and add a
concrete floor to property at 24 Old Farms Road (Map 23, Lot 44, Zone R80) Owner/Applicant: Willington Hill Fire Dept.
Hearing called to order at 7:30. Present: C. Csiki, R. Maloney, R. Claus, N. Wilson
seated for R. Manaskie, T. Smith seated for D. Brown, also present but not seated Chris Deskus.
No one present from the fire department. Ms. Summers, an abutter was present but did not speak.
Chr. Csiki submitted into the record a letter from the Willington Hill Fire Dept. withdrawing their application. They will return to the pre-application status and consider other options for the future.
Hearing closed 7:35.
· File 2003-06 – Application for a 5’ side line variance to construct an addition on property at 15 Eldredge Road (Map 13, Lot 38, Zone R80) Owner/Applicant: Andrew & Feather Spearman.
Hearing opened at 7:35. Members present: Same as above. Also present for
hearing was Andrew and Feather Spearman and Maybelle F. McCormick.
Site walk was held 6/5/03. Present: C. Csiki, R. Maloney, C. Deskus and Mr. & Mrs. Spearman. Mr. Maloney measured the distance from the side line and determined that the addition would be 5’ within the setback.
Mrs. Spearman explained why the addition needed to be placed within the side line setback.
Mrs. McCormick wrote in favor, no one wrote or spoke in opposition.
Hearing closed 7:42.
· File 1999-13 – Revocation of Special Exception for a business (Christopher M. Turkington Landscaping) pursuant to Section 20, Sub-section 20.08.01 Town of Willington Zoning Regulations granted on 11/9/1999 for property located at 7 Village Street. (Map 14, Lot 2, Zone R80) Owner: Christopher M. Turkington.
Hearing opened at 7:43. Members present: Same as above. Also present for
hearing was Chris Turkington.
Mr. Turkington stated that no business was run out of building. He was having health problems and had sold his Landscaping business. He also was selling a small parcel to abutter for parking. This sale will generate approximately $8,000.00 he will use for water system and also septic system.
Chr. Csiki asked if Mr. Turkington stayed at the property.
Mr. Turkington stated he would stay if he was working late, he would crash on futon.
Mr. Maloney asked about the buffer.
Mr. Turkington stated he will clear the buffer of branches and debris.
Chr. Csiki asked Mr. Turkington what he was doing with the building.
Mr. Turkington said he was storing some equipment.
No one spoke for or against the revocation.

REGULAR MEETING:
Present: C. Csiki, R. Maloney, R. Claus, N. Wilson, T. Smith, and Chris Deskus.
CALL TO ORDER: Opened at 7:59 p.m.
MINUTES: waived approval until next meeting.

NEW BUSINESS:
· File 2003-06 – Application for a variance to construct an addition that would extend
approximately 4’10” into the 25’ side line setback on property located at 15 Eldredge Road (Map 13, Lot 38, Zone R80) Owner/Applicants: Andrew & Feather Spearman. (Received 5/8/2003, Site walk 6/5/2003, 7:00 p.m., Hearing on 6/12/2003, Decision by 8/16/03)
Present: Members as noted above and Mr. & Mrs. Spearman.
Motion to accept File 2003-06 was made by R. Claus, seconded by N. Wilson. Vote: All in favor.
Also accepted was a letter from an abutting property owner.
· Chr. Csiki asked for a motion to add Files 2003-07, 2003-08 and 1999-13 to agenda, Mr.
Wilson made the motion, Mr. Maloney seconded. Vote: all in favor.
· File 2003-07 – Application for a variance to construct (2) decks within the 25’ setback on
both the rear and side yards on property located at 245 River Road (Map 20, Lot 03, Zone R80) Owner/Applicant: Thomas Reichert.
Present: Members as noted above and Mr. Thomas Reichert.
Chr. Csiki explained application is untimely and that Mr. Reichert should withdraw. Mr. Csiki asked for a letter of withdrawal. Mr. Reichert said he would send a letter of withdrawal and we would refund his application fee. If he should reapply Mr. Csiki said the application would be special exception and variance.
· File 2003-08 – Application for a variance to exclude conditions on an application for
certificate of zoning compliance dated 3/5/02. Conditions are: “…Connector required for garage – zoning compliance not valid for garage if connector is removed or not installed.” Mr. Uppling initialed conditions.
Chr. Csiki explained that no hardship is involved, he also read the hardship clause of the zoning regulations to Mr. Uppling. Chr. Csiki also explained that Mr. Uppling agreed to the conditions of the zoning application by initialing the conditions.
Mr. Uppling submitted a letter of withdrawal.
· Discussed public hearing to revoke special exception for Christopner Turkington
Landscaping at 7 Village Street. File 1999-13 for non-compliance with conditions as permitted in the Town of Willington Zoning Regulations, Section 20, Sub-section 20.08.01.
OLD BUSINESS:
Commission discussed File 2003-05. Mr. Maloney made motion to approve file by granting a 16’ front line and 12’ side line variance for the purpose to construct a pitched roof over existing house. Mr. Wilson seconded motion. Vote: All in favor.
DISCUSSION: Commission discussed regulation change regarding dog kennels. Chr. Csiki asked Ms. Jordan that memo from Mark Branse to Susan Yorgensen and her response be sent to ZBA members.
ADJOURNMENT:
Motion made by R. Maloney to adjourn meeting seconded by N. Wilson.
Vote: All in favor
