May 9, 2002
Public hearing application 2002-04 opened at 7.34 p.m.
Present: C. Csiki; R. Maloney; D. Brown; R. Claus; and  C. Deskus seated for R. Manaskie

Mr. Kozicki, of 79 Old Farms Road, presented to the board the reasons that he wanted the 3’ front line variance.  Moving the addition back does not leave room for the front entrance.
Mr. Scott Trueb, 80 Old Farms Road, spoke in favor of the variance.
Motion made by R. Maloney.  Seconded by R. Claus.  
Vote:  All in favor.
Closed hearing at 7.43 p.m.

Chairman Csiki asked for a motion to approve minutes of 3/14/2002.  Motion made by R. Claus, seconded by D. Brown.  No discussion.  All in favor.
PREAPPLICATION
Pre-application #2002-05 – Application for a 9’ front line variance to erect a mud room and covered porch under Section 8.03, Table 8.02 of the Willington Zoning Regulations for property located at 50 Navratil Road.  Owner/Applicant:  Donald Boire (Zone R80, Map #14, Lot #18).  Received 5/9/2002, Site Walk 6/5/2002 at 6 p.m.; Hearing 6/13/2002; Decision before 8/8/2002.
Motion made by R. Maloney to accept application, Seconded by C. Deskus.
Vote:  All in favor
Pre-application #2002-06 – for a use variance in a R80 Zone to change garage to office/storage space under Section 9.03 of the Willington Zoning Regulations for property located at Cedar Ridge Apartments, 43 Burt Latham Road.  Owner: Mass Operating Group; Applicant: Cedar Ridge Apartments.  (Zone R80, Map #4, Lot #7) Received 5/9/2002, Site Walk 6/5/2002 at 6:30 p.m.; Hearing 6/13/2002; Decision before 8/8/2002.
CHAIRMAN CSIKI EXPRESSED CONCERN REGARDING THE BOARDS AUTHORITY TO HEAR THIS APPLICATION DUE TO THE NATURE OF THE REQUEST.  THE CHAIRMAN WENT OVER THE LAW AND ZONING REGULATIONS GOVERNING THE BOARDS RESPONSIBILITIES AND AUTHORITY.
AFTER SOME DISCUSSION IT WAS DECIDED TO ACCEPT THE APPLICATION AND FOR THE CHAIRMAN TO NOTIFY THE APPLICANT IN WRITING OF THE BOARDS CONCERNS.
Motion made by R. Maloney to accept application, Seconded by C. Deskus.
Vote:  All in favor
OLD BUSINESS:
        Application #2002-04
Motion made by R. Maloney to approve application 2002-04 as proposed and presented.  The applicant had demonstrated a bonafide hardship due to having septic system in rear of home, driveway on one side and septic system reserve on other side of the home and proposed addition.  Seconded by C. Deskus.  
Vote:  All in favor.
NEW BUSINESS:
        A motion was made by C. Csiki, seconded by R. Claus to rescind THE VARIANCE GRANTED AS REQUESTED IN application 2000-06 based on letter submitted by Christopher & Teri Gareau, dated May 8, 2002, requesting that in view of the modification to their building plans a Certificate of Zoning Compliance permit was approved on March 6, 2002, the Zoning Board of Appeals 19 foot sideline variance be rescinded.  Property located at 111 Daleville School Road. (Zone R80, Map 12, Lot 18C).
Vote:  Yes – D. Brown, C. Csiki, R. Claus, and C. Deskus
        No – R. Maloney
Motion passed – variance rescinded.

Land Use Law & Zoning Digest
DISCUSSION:
        May 28th meeting for Planning, Zoning and Inland Wetlands & Watercourses Commission Members and staff with speaker Mark Branse.  An update and overview of Connecticut Land Use Regulations.  Chairman Csiki encouraged all ZBA members to attend.
ADJOURNMENT:
Motion made by R. Claus to adjourn meeting seconded by D. Brown.
