P. Lord called the meeting to order at 7:10.

W2016-27 Application for Modification of permit W2015-16 to replace the rock cut at northeast corner of parking lot with block gravity retaining wall at 350 Ruby Road (Map 42 Lot 48-1 Zone DI) Owner/Applicant: FedEx Ground Package Systems, Inc. (Received November 14, 2016 Public Hearing by January 17, 2017 decision within 35 days after close of P.H.)

Attorney Dory Famiglietti was present representing FedEx Ground.  She said the application is for a minor modification of an approved wetlands permit.  She said they would like to replace the rock cut with a retaining wall; they did test borings that demonstrated the soil would not hold the rock cut.  Atty. Famiglietti said all work is in the upland review area, not in the wetland or watercourse area.   She said they are also proposing a nitrogen dilution system in the northwestern corner of the new parking lot.  She added that the new proposal will pull the retaining wall in further and away from the wetlands.  

John Martucci presented plans and explained that the soils couldn’t hold so they designed a block wall.  Mr. Martucci went over the plans and said the limited area of disturbance will remain the same.  He said 125 square feet of wall gave way when they were digging and it will be restored, stabilized, planted and mulched.  Mr. Martucci explained the nitrogen dilution system which will replace the water that would have soaked into the pervious surfaces.  He said the re-design has been approved by DEEP and explained the workings of the unit.  

Atty. Famiglietti said there is also a memorandum from Josh Wilson of Fuss & O’Neill; he is their wetland consultant and has signed off that the new work will not have impact any on the wetlands.  Atty. Famiglietti read the memo from Josh Wilson to the commission and the memorandum was submitted for the file.  

Discussion was held on keeping the area stabilized.  P. Lord asked the process of insulating the block wall and Mr. Martucci said 2 feet of compacted gravel goes in as a stabilizer.  He said the highest point of the wall is 10 feet and then it tapers down. P. Lord asked for clarification on the nitrogen system; it accepts storm water and filters the ground water.  Mr. Martucci said that was correct.  

T. Gutowski asked if S. Yorgensen had concerns or questions on the application before them and she said no; she understands what they want to do.  

P. Lord motioned to remand application W2016-27 to the Commissions IWWC Agent.  All in favor.  Motion carried.
