D. Schreiber called the meeting to order at 8:07.
New Business
W2012-46 Application for timber harvest at 56 Michalec Road (Map 60 Lot 2 Zone R80) Owner: Susan Cassone Applicant: Brian Riendeau (Received December 10, 2012 Public Hearing or Decision by February 11, 2012)
Karl Riendeau was present for the applicant. He said there is one wetland crossing and they will cross with a portable bridge. Mr. Riendeau said all boundary lines and trees have been marked with pink ribbon and explained that the property borders a state forest.
A discussion was held on the neighboring properties and the boundary lines. S. Yorgensen explained a previous application at this location and said one of the neighboring property owners believed the boundary lines were marked inaccurately. Mr. Riendeau said the boundary lines were marked by using the pins and fences and showed the crossing on the plans. He said it is an intermittent stream that flows when the water is high and is flowing at this time. T. Gutowski asked if they would cut all trees to the line of the state forest and Mr. Riendeau said yes and the plan is to harvest in February. He said it will be a 14 inch and up selective cut and will take approximately 2 months. T. Gutowski said that he should write those details and include them in the application.
T. Gutowski said she would like to see more detail on the plot plan; outline of harvest area, crossings, all skid roads, wetlands, intermittent streams. S. Yorgensen would like a copy of the Forest Harvest Notification Form.
T. Gutowski suggested sharing the information with the Forest Division. T. Gutowski would also like the applicant to state there is nothing in the Natural Diversity Data Base for this property and to state how they defined the property lines.
This application will be continued to the January 28th meeting.
Old Business
W2012-42 Application for construction of Dunkin Donuts with parking, driveway and utilities at 333 River Road (Map 30 Lot 17 (portion) Zone DC) Owner B & M realty Trust, LLC Applicant: Dekk Group, LLC (Received October 22, 2012 Public Hearing by December 10, 2012 Decision within 35 days after close of P.H.)
Dave Held a Licensed Professional Engineer and Land Surveyor at Provost and Rovero, Inc. was present and presented plans to the commission. He addressed the review comments made by the Jacobson & Associates detailed in the letter dated November 26, 2012. .
Mr. Held said the CDOT referral will be obtained after the permits are granted by the town.
Mr. Held pointed out the gravel maintenance access road added to the plans with notes and details added to the plans as well. He said posts have been added 12 feet on center.
Mr. Held referenced the subsurface data requested by Mr. Jacobson; they excavated a few extra test pits and added the test pit data to the plan on sheet 4. Mr. Held showed the areas tested on the plans.
The last comment from Mr. Jacobson was regarding silt fencing; Mr. Held said they added 10 foot wings of silt fencing and showed the locations on the plans.
Mr. Held submitted a letter from Jacobson & Associates to Susan Yorgensen stating the applicant adequately address their comments and they have no comment should the Commission choose to approve the subject application.
Mr. Held referenced an email from Jody Schmidt stating the septic system approval is per B100A.
A discussion was held on renovation calculations. S. Yorgensen said she normally requests renovation calculations when a septic is this close feet to the wetlands; this application’s septic is 65 feet from the wetlands. Mr. Held said they did not provide renovation calculations because the system is a Soil Air System in which air is injected into the leeching area. He explained the workings of the Soil Air System and said he did not believe renovation calculations were necessary with this system. A discussion was held on the system. Mr. Held said they went with the Soil air System due to the higher BOD levels from coffee, dairy and sugar. He said the system design is typical with what you would have with a four bedroom house and said they were conservative in their design which was also the feeling
of the sanitarian. T. Gutowski asked if he had this in writing from the sanitarian and Mr. Held said it has not been approved as of yet and she is still in the process of reviewing it.
T. Gutowski asked if S. Yorgensen had any concerns and she said her only concern is the renovation calculations and health district approval especially since there is no reserve area on site.
Ralph Tulis expressed his concerns on the divided lot; when the lot was originally developed there may have been a requirement that the two lots were merged. He also expressed his concern on the comments by Mr. Held that the wetland was created by the DOT drainage system. He said there is a watercourse that drains from the pond and they do not know the grade on the other side of the railroad track and this wetland may have preceded the railroad track. D. Schreiber said the lot issue is a Planning and Zoning issue. Mr. Held said they divided the property preceding this application; it was entitled to a free split. A discussion was held on the railroad and the wetlands.
T. Gutowski motioned to approve the application with the following conditions:
- Renovation Calculations to be submitted showing no adverse impact to the wetlands.
- Health District approval is obtained.
M. Drobney seconded the motion. All in favor. Motion carried.
W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.
Application was tabled.
Correspondence
- Memo to IWWC to Christina Mailhos regarding the Storm water on Hockla and Daleville Road.
The Commission will conduct a site walk on this site with the Town Engineer and Public Works in January. Members will email S. Yorgensen with dates available and would like this on the agenda in January.
Minutes
M. Drobney motioned to approve the minutes of November 26, 2012 as amended; Christine Anderson should read Christine Psathas. T. Gutowski seconded the motion.
