D. Schreiber called the meeting to order at 7:30. M. Drobney motioned to seat H. Dionne for K. Metzler.
New Business
W2012-42 Application for construction of Dunkin Donuts with parking, driveway and utilities at 333 River Road (Map 30 Lot 17 (portion) Zone DC) Owner B & M realty Trust, LLC Applicant: Dekk Group, LLC (Received October 22, 2012 Public Hearing by December 10, 2012 Decision within 35 days after close of P.H.)
Dave Held a Licensed Professional Engineer at Provost and Rovero, Inc. was present for the applicant and plans were presented to the Commission. The proposed site is for a 2400 sq. foot Dunkin Donuts restaurant at the corner of Rte. 32 and 74. The existing building adjacent to the proposed site was River Road Antiques. Mr. Held said the parcel contains one wetland in the Southwest side of the site adjacent to the railway and Rte. 74. He said the wetland was either created by the DOT drainage system or serviced by the DOT drainage system. He presented the proposed well and septic on the plans and said the wetlands were delineated in July by Michael Schaefer.
Mr. Held said they do have regulated activity within 100 feet of the wetland boundaries and the closest area of the septic leeching field to the wetlands is 66 feet. Mr. Held presented the septic design which is a Primary Design. He said they are not required to have a secondary reserve on the site because it is a redevelopment of a previously developed site and falls under Section B100 of the Public Health Code. T. Gutowski questioned what would happen if the septic failed.
Mr. Held said the soils in the area of the leaching are loamy sand and sandy loam with a little bit of gravel mixed in. The soil areas in the front of the building are sand and gravel but had been previously disturbed so they cannot put a septic system in there. Mr. Held said the system will be a Geomatrix GST Stone Leeching System with soil air. The soil air system will have two blowers which inject air into the two leeching systems on top because of the high BOD concentration in the waste water from the coffee, dairy products and sugar that gets dumped down the drain. This is the primary concern and was recommended by the town sanitarian.
D. Schreiber asked the amount of seats and Mr. Held said up to 40 chairs. D. Schreiber asked about fryolators and Mr. Held said he did not know as there is some food cooked on site but they would install a grease trap.
Mr. Held said the storm water system was designed to address peak flows and storm water quality. He showed the contours for the detention basin on the plans and said the drainage system leading into the detention basin includes a storm septor unit which all the catch basins lead into and is designed to control the floating solids, grease and oils. The water then flows into the detention basin which has an under drain system so the water quality volume is retained in the basin and infiltrated in the under drain system.
Mr. Held said the outlet would be a stand pipe so that they retain the entire water quality volume from the site. And at that point it would flow through the stand pipe and outlet structure to a flared end with rip rap protection and into the wetland area. Mr. Held said they have looked at two design points to the wetland area so they don’t increase peak flow which would potentially impact the flooding on the site.
D. Schreiber asked the amount of water processed through the septic system and Mr. Held said a little over 1200 gallons a day which is based on what the Public Health Code requires. He said plans have been submitted to the Health District and they are hoping for feedback soon.
T. Gutowski asked about alternatives for the septic and Mr. Held said the proposed area is the only area on site that is suitable.
T. Gutowski asked the locations of the driveways and Mr. Held said one entrance on Rte. 74 and one on Rte. 32 which would be two ways from both entrances as they want access from Rte. 32 and to access both lots. The barn is a separate lot and they have created an easement so they can access from Rte. 32. Mr. Held said an alternative would be to get rid of the Rte. 74 entrance but that would affect the second lot that is currently undeveloped. A discussion was held on the right of way line.
T. Gutowski asked the location of the recycling and waste and Mr. Held presented the area on the plans and said the access will be from the entrance on Rte. 74. T. Gutowski asked about the water leaving the wetland which goes under the railroad tracks and Mr. Held said it eventually gets to the Willimantic River but was not clear as to how and mentioned the 30 inch pipe under the railroad tracks. A discussion was held on the detention basin.
A discussion was held on the comments from the Commission’s engineer Jacobson & Associates. A discussion was held on whether or not a Public Hearing should be held. T. Gutowski said she does not think a Public Hearing is necessary as the impact to the wetlands is not substantial.
T. Gutowski expressed her concerns on the primary septic and if it fails and Mr. Held referenced the Soil Air System but he would get the necessary information from the Health District to clarify.
T. Gutowski asked if the storm water design would have to be submitted to DEEP and Mr. Held said no. Mr. Held said the system is designed for a 100 year storm. T. Gutowski asked who is responsible for the Operation Maintenance Plan for the detention basin and Mr. Held said the owner of the property.
A discussion was held on the Hydrodynamic separator which separates the fines and floatables.
T. Gutowski requested modifications to the plans suggested by the engineer with the exception of the referral to the DOT which cannot be obtained until after the permits are granted by the town.
A discussion was held on the contamination of the adjacent property. Mr. Held said he believes the two existing wells are fine and said they will have to go through additional testing to get approval for a public water supply.
Mr. Held said he would address the engineer’s comments and get the B100 information. The application was tabled until the December 10, 2012 meeting.

Minutes
T. Gutowski motioned to approve the minutes of September 1, 2012 with the following modifications; Heather Dionne was excused and W2012-4 should read "The commission agreed to have staff send a letter thanking the property owner for their correspondence and asking for an update on the work when it is completed." E. Brand seconded the motion. All in favor. Motion carried.
Staff Report and Discussion
Christine Anderson asked the next step for Dunkin Donuts. The Commission said they will come back to answer their questions December 10th at which time the Commission will look more closely and then make a decision. If approved, the application would go before the P & Z Commission.
T. Gutowski referenced Section 9 of the Regulations which say that a Public Hearing would be held if a petition was signed by 25 people or if the Commission believes there may have a significant impact to the wetlands and watercourses.
