D. Schreiber called the meeting to order at 7:30.

New Business

W2012-36 Application to remove reed plants around edge of pond at 380 Tolland Turnpike (Map 22 Lot 23 Zone R80) Owner/Applicant: John & Gail Kapinos (Received August 24, 2012 Decision by September 10, 2012)

John Kapinos was present.  He said the pond is 1000 feet from the road and the Fenton River is downstream from the pond.  The pond was drained a week ago by Hipski & Co. and further de-watering will be placed on the land.  T. Gutowski asked the location of the dredged material and Mr. Kapinos said they will leave it where it is until Mr. Hipski determines where to put it and after which time, Mr. Kapinos will spread it with his tractor.  

Mr. Kapinos said the pond is ½ acre but he is unsure of the depth.  A discussion was held on the weeds and cattails.  

Mr. Kapinos explained that the pond was drained approximately 20 years ago for mercury contamination.  Contamination was found at the spill site; after which extensive testing was done and they received a clean bill of health from the federal EPA.

A discussion was held on erosion and sedimentation control measures which were not shown on the plan.  Mr. Kapinos said he has a 3 foot wall that borders the pond and he could let the material de-water there or he could put in black tarp fencing.  S. Yorgensen suggested hay bales and a discussion was held on the placement of the hay bales.  M. Drobney asked about the lay of the land and Mr. Kapinos said it was fairly level.  

T. Gutowski motioned to move W2012-36 to Old Business.  E. Brand seconded the motion.  All in favor.

T. Gutowski motioned to approve W2012-36 with the following conditions:

  • The applicant will provide a sketch on the placement of the dredged material and the area the hay bales will be placed for the purpose of erosion and sedimentation control prior to any activity conducted.  
M. Drobney seconded the motion.  All in favor.  Motion carried.

W2012-4 Notice of violation: Matthew & Amy Michanczyk conducting activities at 23 Lindsey Lane in violation of the Inland Wetlands & Watercourses Act (section 22a-36 through 22a-45 of the Connecticut General Statutes) and the Inland Wetlands and Watercourses Regulations of the Town of Willington. (Resolve by May 1, 2012)

D. Schreiber read the letter from the property owner dated 8/27/2012 on the scheduled work to be done.  S. Yorgensen has not received any correspondence since.  

The commission agreed to have staff send a letter thanking the property owner for their correspondence and asking for an update on the work it is completed.
 W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

T. Gutowski will follow up with DEP on an Integrated Contingency Plan via email and will copy S. Yorgensen on the email.

T. Gutowski motioned to approve the minutes of June 11, 2012.  M. Drobney seconded the motion.  All in favor.

Staff Report and Discussion

Continue discussion regarding pond (Daleville Rd) and beaver dam on Old Farms Road.

The commission reviewed the file.  S. Yorgensen has spoken to the new owner and they have hired someone to trap the beavers in December.  A discussion was held on the previous work done as a temporary fix in 2004 and again in 2010.  

T. Gutowski would like to know the long term recommendations; will removing the beavers address all the problems?  A discussion was held on fixing the culvert and the storm run-off.  Robert Hockla presented pictures to the commission and said the stream bed is so full that the water has no place to go.  He said he has spoken to Lynn Nichols and Christina Mailhos in 2010.  

A discussion was held on the condition of Daleville Road and requesting road work to be done.

The commission agreed they would like to send a memo to the Selectmen, Public Works and Karl Acimovic asking the town to review the area and a possible solution as this is an ongoing issue.  

Clarification of wetland conditions at 3 Polster Road Love’s Travel Stops & Country Stores

Attorney Jacobs and Tom Galiotta were present for clarification on the Inland Wetland’s permit issued.  

Item #12 should read every day that Fuss & O’Neil are on site and not that they have to be there every day.  Inspections will be done at least once a week and after a significant rain storm. .  

A discussion was held on Item #14 and the commission clarified that sampling should say assessment.

A discussion was held on Item #15 in regards to the location of the ground water monitoring to be installed and how often it will be done.  The commission agreed to quarterly monitoring but would like to clarify with Ken Metzler on the location of the ground water monitoring wells.  

Item #16 was discussed and T. Gutowski will clarify if Industrial Standards should be used for water quality monitored.  She will let S. Yorgensen know.   

A discussion was held on clarification of whose engineer us designated as stated in Item #20 and determined as follows:  Detailed design calculations and final retaining wall plans shall be submitted by the Design Engineer to be reviewed and approved by Fuss & O’Neil’s Land Use Engineer as well as the Town of Willington’s Land Use Engineer.  The Fuss & O’Neil Engineer shall be on-site to oversee the construction of the retaining wall, the compaction of soils, and the functional integrity of the adjacent E & S controls.  A report indicating the Fuss & O’Neil’s Engineer approval of such work shall be submitted to the Commission.  

Attorney Jacobs and Mr. Galiotta thanked the commission for their time.
