Meeting Minutes

D. Schreiber called the meeting to order at 7:35.

The members welcomed Heather Dion to the Inland Wetland and Watercourse Commission.

Old Business

Notice of Violation and follow up letter sent to the Board of Selectman about Fenton Ruby Park / Burma Road.

T. Gutowski motioned to add the Notice of Violation to the agenda.  M. Drobney seconded the motion.  All in favor.

S. Yorgensen explained the violation to H. Dion.  She said the water comes down the road and washes the silt into the wetlands.  The town came in with an application to fix the road that was approved but never constructed and the road continues to wash out into the wetlands.
 
Selectman Christina Mailhos gave the latest information; the work to be done was priced at 70,000 but the Board of Finance did not like the number.  It is currently out to bid and she estimated the work to be approximately $50,000.  Selectman Mailhos said the Board of Selectmen went before the Board of Finance the week before with the Notice of Violation and a letter from the Conservation Commission.  The Board of Selectman scheduled a Special Meeting to call a Town Meeting.  A discussion was held on the meeting.  Selectman Mailhos said the Board of Finance is on the fence about the work to be done and asking if there is a cheaper way to do it.  She said they want public works to continue filling in the road but the problem is serious and getting worse.

Pre-application

The Millworks 156 River Road: Discussion about rehabilitation measures to be undertaken for the trail race walls, the wing of the main building that spans the trail race and possible demolition of the structure just downstream from aforementioned wing.

Ralph Tulis and Tom Buccino were present.  Mr. Tulis explained that Mr. Buccino has an opportunity to rent space in the building but they wanted to come before the commission to discuss the necessary repairs to be done.  He gave details of the proposed work to be done which included masonry work especially under the footprint including putting something under the building to hold it up.  Mr. Tulis said they are not sure if they can do all the work until they put it out to bid and find out the costs.  They want to build in all precautions and a discussion was held on diverting the water.  Mr. Tulis presented pictures of the steel beams and commented that the bearing plates are in sad shape.  

T. Gutowski asked if this was a commercial space only and Mr. Buccino said it was.  T. Gutowski asked how high the water rose during the last storm and Mr. Buccino said maybe 8 inches.  A discussion was held on the channel, the water and where it flows.  A discussion was held on possibly dropping the dam.  Mr. Tulis said he believes it would be best to sandbag it and run a pipe though it.  

D. Schreiber asked if there would be a fish issue and Mr. Tulis said no, not really.  M. Drobney said the water is pretty shallow and Mr. Tulis added, with some deep pockets.  

Mr. Tulis said they would like to repaint the beams that they can save and hope to save the walls by doing a repointing job.  He explained that, if the building were to be demolished, they would have to put similar precautions in place as they would to save the building.  A discussion was held on the demolition if that were to happen.

A discussion was held on the classification of the dam and T. Gutowski said she would get the information.  

A discussion was held on the permit.  S. Yorgensen said it would be valid for 9 years and the applicant could also come in for an extension assuming they come in before it expires.  

Mr. Buccino asked the next steps and Mr. Tulis said they have to come up with a plan and can go out to bid but cannot move forward until they go before the board.  

Old Business

W2003-49 Notice of Violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.  

This application was tabled until the next meeting.

A discussion was held on training.  T. Gutowski explained the web-based training that is available.  

Minutes

The minutes of August 15, 2011 were table until the meeting and will be added to the agenda.  

T. Gutowski motioned to approve the minutes of September 12, 2011 with the following modifications:  Application W2011-41 was referred to staff and the second paragraph on the Staff report should read as follows; D. Schreiber said the logging issues are getting nebulous with regards to the towns ability to regulate them.  M. Drobney seconded the motion.  All in favor.  

Staff Report

S. Yorgensen conducted a site walk at 33 Baxter Rd (W2011-41) and issued a permit.  

Guidelines for Logging Applications were tabled for another meeting.

Meeting adjourned at 8:35.
