W2011-27 Application for construction of travel stop, including store, food service, fueling station and associated construction at 3 Polster Road Owner: Frank & Joseph Malack et al Application: LovesTravel Stop and Country Store Inc. (Received June 13, 2011 Public Hearing August 15, 2011 Decision within 35 days after close of P.H.)
Public Hearing has been set for August 15, 2011.
W2011-32 Application for Modification of approved permit (W2007-39) reduce 6 lots to 3 lots with construction of foundation within regulated area at 59 Latham Road (Map 9 Lot 33 Zone R80) Owner/Applicant: Michael Nogas (Received July 11, 2011 Public Hearing by September 12, 2011 Decision within 35 days after close of P.H.)
Michael Nogas and Ed Pelletier, of Datum Engineering, were present. Mr. Pelletier said the subdivision was originally 6 lots and he was previously approved for the proposed 3 lot subdivision but did not make the deadline before the moratorium. He also said the 3 lot subdivision is for his relatives; not for sale.
Mr. Pelletier explained the proposal on the plans and said the design has the same placement of the houses as the previous application and the lots will be bigger.
D. Schreiber said there is quite a bit of wetland on the property. Mr. Pelletier agreed and showed the areas on the plans. He said the only change from the original application is the footing drains on lot 2. D. Schreiber asked if the path of the drain goes near the wetlands and Mr. Pelletier said it goes near but not in; about 40 feet away. S. Yorgensen asked if lot 2’s footing drain will outlet on lot 1. Mr. Pelletier said yes, with an easement.
T. Gutowski motioned to approve W2011-32 as a modification of an approved permit (W2007-39), plans dated May 24, 2011. Evan Brand seconded the motion. All in favor. Motion carried.
W2011-33 Application for single family house, request for declaratory ruling at 17 Adamec Road (Map 24 Lot 33 Zone R80) Owner/Applicant: Robert J & Mary A Wiecenski (Received July 11, 2011 Public Hearing by September 12, 2011 Decision within 35 days after close of P.H.)
Stephen Filip, of Filip Associates, was present for the applicant. Mr. Filip presented the plans. He said the wetlands were flagged by Roy Shook.
T. Gutowski motioned to approve the declaratory ruling based on no jurisdiction in regards to plans dated June 11, 2011. M. Drobney seconded the motion. All in favor.
W 2011-34 4 Lot re-subdivision, request for declaratory ruling 276 Tolland Turnpike Owner/Applicant: Ridgeview-Willington, LLC, Samuel L. Schrager (Received July 11, 2011)
Attorney Samuel Schrager was present for the applicant. He said he is present for a finding of no jurisdiction as the only wetlands are on lot 4 and all proposed activity is well beyond 200 feet from the wetlands and 300 feet from the proposed septic.
Atty. Schrager said Soil Resource Consultants from Meriden flagged the wetlands and submitted plans for the record.
T. Gutowski motioned to approve the declaratory ruling based on no jurisdiction in regards to plans dated January 2010 and 2 sheets dated September 17, 2010 and based on the condition that all three will be signed and certified by the Soil Scientist. E. Brand seconded the motion. All in favor.
W 2011-35 Application for Repair to Roaring Brook/Polster Road Bridge Abutment Owner/Applicant: Town of Willington (Received July 11, 2011, Decision by September 12, 2011)
Town Engineer Karl Acimovic was present for the town. He said the bridge was inspected by CT DOT and scoured footings were found in as much as 2 ½ to 3 feet deep in some areas. He said they propose to clean out the scoured areas by hand and with small equipment and then place in stone rip rap. Mr. Acimovic submitted a narrative and photos for the record and explained the documents.
K. Acimovic said they would like to do the work when the brook is relatively low. He said they would do the westerly abutment first and then follow with the easterly abutment. K. Acimovic said the super structure itself may eventually have to be replaced but that will be another issue and they are currently in the process of discussing funding with DOT.
T. Gutowski asked why the scouring and K. Acimovic said high velocity and soil materials underneath. He said they would like to do the work in 2 to 3 months when the water is low.
The commission agreed to remand this application to Staff. T. Gutowski said Roaring Brook is a very high quality stream and asked Staff to take some time to look at the application.
Old Business
W2011-29 Application to put shed within 100’ of wetland at 268 River Road (Map 24 Lot 37A Zone R80) Owner/Applicant: Denise Morrow (Received July 11, 2011 Public Hearing by September 12, 2011 Decision within 35 days after close of P. H.)
The commission briefly looked at the plans and the letter memo from Rick Zulick. The application was tabled until later in the meeting.
W2011-22 Application for installation of yard drains and piping at 11 Meadow Lane (Map 16 Lot 32 Zone R80) Owner/Applicant: Robert & Elena Testa (Received May 9, 2011 Site walk June 20, 2011 Public Hearing by July 11, 2011 Decision within 35 days after close of P.H.)
Robert Testa was present. He said he talked to his neighbor, Cliff Dutton, regarding the work to be done and Mr. Dutton was fine with it. Mr. Testa submitted a memo dated 6-19-11 regarding this conversation. He said the excavator came out and drew a more scaled drawing. T. Gutowski said the commission had conducted a site walk on June 20, 2011 and a discussion was held on the plans.
T. Gutowski motioned to approve application W2011-22 based on the information submitted; a Memo Document from Robert Testa dated June 19, 2011 and a new schematic submitted July 11, 2011. E. Brand seconded the motion. All in favor.
W2011- 24 Applicant to replace culvert liner at Potter School Road Owner/Applicant: Town of Willington (Received May 9, 2011 Public Hearing by July 11, 2011 Decision within 35 days after close of P.H
Karl Acimovic said he contacted Brian Murphy at Fisheries. He said they are currently in the queue behind 8 DOT culverts but they hope to hear from them by August. A brief discussion was held on the plans.
T. Gutowski motioned to approve Option 1 on the plans as the diverson (gravity pipe through the existing pipe) and the condition that the comments and recommendations from Fisheries are incorporated into the plans dated April 2011. M. Drobney seconded the motion. All in favor.
A discussion was held on the Burma Road project. Selectman Christina Mailhos said the Board of Finance did not give them funding and asked them to price out options. She said they are still waiting to hear back on that. Selectman Mailhos said they brought in a bulldozer to level off the area and make it passable. She said it has since washed out some but is still passable. Lynn Nichols said they are going to put it out to bid.
S. Yorgensen asked about erosion control measures and K. Acimovic said they could look at having intermediate run-offs but he hesitates on that as well. A discussion was held on materials that could be used to keep the run off out of the road and sediment out of the wetlands.
W2011-29 Application to put shed within 100’ of wetland at 268 River Road (Map 24 Lot 37A Zone R80) Owner/Applicant: Denise Morrow (Received July 11, 2011 Public Hearing by September 12, 2011 Decision within 35 days after close of P. H.)
The commission re-visited this application. Denise Morrow was present. She said the shed would hold lawn equipment, snowmobiles, quads and patio furniture. A discussion was held on the pitch of the land and Ms. Morrow showed this on the plans. She said the shed will be 24 by 24 and have doors facing the house.
T. Gutowski said the shed would be in the upland review area; 30 feet from the wetlands. D. Schreiber said he is concerned fuel from the shed could leak into the wetland area. The applicant said the area is level. A discussion was held.
T. Gutowski said the agenda should be corrected to read the application was received on June 13, 2011.
T. Gutowski motioned to approve application W2011-29 with the site plan dated February 9, 2011 on the condition that no grading is involved. E. Brand seconded the motion. All in favor.
W2011-23 Application to construct paved apron on existing entrance at Ruby Road between house #168 and #190 (Map 33 Lot 19 Zone R80) Owner/Applicant: Ruby Road Associates LLC c/o Stanley Sadlak (Received May 9, 2011 Public Hearing by July 11, 2011 Decision within 35 days after close of P.H.)
Ed Pelletier was present. He said the previous application was for a 24 foot road and they have scaled it back. Mr. Pelletier said they want to put in an apron and grade down just shy of the culvert. He said there would be no fill in the wetlands itself and silt fence would be installed. Mr. Pelletier said they want to clear trees to drive four wheel vehicles up to access the property for hunting.
A discussion was held on the apron and areas to park. M. Drobney asked if there was any change after the apron and the existing road and Mr. Pelletier said some tree clearing. A discussion was held on the woods road and the area of clearing. A discussion was held on ATV’s and trucks accessing the road without the owner’s knowledge and how to prevent this. M. Drobney said if they start disturbing the woods road, it is going to affect the wetlands. T. Gutowski said they will have to block it.
Mr. Pelletier said they are hoping to have property access and make it more appealing, therefore, increasing the opportunity for future plans.
A discussion was held on the culvert in regards to clearing. T. Gutowski said the previous application has been scaled back (less of a footprint) and it is reasonable to allow the owners a place to park and access to the property. .
T. Gutowski motioned to approve application W2011-23 (maps dated May 2, 2011) for the construction of a paved apron and gravel up to the existing culvert (approximately 40 feet in length)only. No widening of existing roadway, no disturbance or clearing past the culvert and an effective barricade (chain) shall be installed across the apron, one car length in. E. Brand seconded the motion. All in favor.
W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

Staff Report and Discussion
A discussion was held on the memo from Richard Zulick regarding 268 River Rd. T. Gutowski said the work Mr. Zulick is suggesting is sufficient but she would like a time frame for items #3 and #4.
Minutes
M. Drobney motioned to approve the minutes of June 13, 2011. E. Brand seconded the motion. All in favor.
A discussion was held regarding issuing a Notice of Violation for Burma Road. The commission agreed that they would like to minimize the impact to the wetlands.
