Meeting Minutes

W2010-4 Wetland crossing at 268 River Road (Map 24 Lot 37-A Zone R 80)
Owner/Applicant: Denise Morrow (Received March 8, 2010 Public Hearing by May 10, 2010 Decision within 65 days after close of P.H.)

Steve Filip was present for the applicant and presented plans.  He said it is an existing crossing which was constructed in violation and is at the narrowest point of the wetlands. Mr. Filip showed the previous area used for wood storage which has now been moved to the back of the site. G. Jones said the culvert is in the wetlands and has been graveled over. Mr. Filip said the site was slightly graded and some of the hill was cut down.  K. Metzler asked if they were going to feather the slopes and Mr. Filip said yes.  D. Schreiber asked about the concrete blocks and Mr. Filip said they are being used as a barrier and showed this on the plans.  Mr. Filip said the site has been stabilized and was extremely compacted.  He said they did not have any problems with the recent rain storm.  D. Schreiber asked how much wood was being stored and Denise Morrow said 10 to 15 cords.  

K. Metzler would like to schedule a site walk and requested that the applicant attend the next meeting.  G. Jones will contact the commission and the applicant regarding the date and time of the site walk.

W2010-5 Application for Timber Harvest at 22 Willington Hill Road (Map 23 Lot 54/54A Zone R80) Owner/Applicant: Dave and Mary Krivanec (Received April 12, 2010 Public Hearing by June 14, 2010 Decision within 65 days after close of P.H).

Application has been received.  

W2010-9 Application for Wetlands Crossing and Garage within regulated area at 115 Mason Road ~(Map 11 Lot 27A-2D Zone R80) Owner/Applicant: Mark Hannegan (Received April 12, 2010 Public Hearing By June 14, 2010 Decision within 65 days after close of P.H.)

Mark Hannegan was present and said he was there to address the driveway put in 20 years ago.  He said it was a farm road and he put in 2 culverts and covered it with stone.  Mr. Hannegan said he has a shared driveway and is using this as a second driveway.  

K. Metzler would like to schedule a site walk prior to the next meeting.  G. Jones will contact the commission and the applicant regarding the date and time of the site walk.  

W2010-10 Application for road repair due to storm damage at Hockla Farms Road (Map Lot ) Owner/Applicant: Town of Willington (Received April 12, 2010 Public Hearing by June 14, 2010 Decision within 65 days after close of P.H.)

Selectman Christina Mailhos and Lynn Nicholls of Public Works were present.  Selectman Mailhos said Hockla Farms was the only road they had a problem with during the last storm.  She said half of the road washed away in just a few hours and they suspect the reason why is the beaver dam upstream.  Ms. Nicholls said they put some process on top of it for now to make it passable.  K. Metzler asked about sediment going downstream.   Ms. Nicholls said it has pretty much settled and they will have to dig it out.  

Ms. Nicholls said they want to put a bigger pipe in that goes with the flow of the stream as well as a larger culvert.  They also want to talk to the owners about the beaver dam.  Ms. Nicholls said the previous owner would drop the pond at certain times and they want to explain this to the new owner.  Ms. Nicholls said all activity will be on town property.  A discussion was held on the detention basin and the beaver dam.

Karl Acimovic previously submitted short term and long term recommendations which has been included in the file.  

D. Schreiber motioned to remand this application to staff.  T. Gutowski seconded the motion.  All in favor.  Motion carried.

W2010-11 Application for construction of travel stop, including store, food service, fueling station, and associated construction at 3 Polster Road Owner: Frank & Joseph Malack et al Applicant: Love’s Travel Stop & Country Stores, Inc (Received April 12, 2010 Public Hearing by June 14, 2010 Decision within 65 days after close of P.H.)

Attorney Leonard Jacobs and Rich Pettinelli, from Fuss & O’ Neil, were both present.  Atty. Jacobs said the proposed work is in the regulated area, not in the wetlands.

Mr. Pettinelli presented plans and said the proposed site is at the corner of Lohse, Polster and Mihaliak Rd.  He said it will be a travel stop with two small restaurants and a convenience store.  Mr. Pettinelli showed the fuel area on the plans.  He said the DOT and DEP are abutters.  


Mr. Pettinelli showed a pocket on the plans that is a potential vernal pool and said they are currently doing a study.  He also showed the seeps within the wetland boundaries and said 2 level spreaders will be put in at the ponds. T. Gutowski asked if the proposed plan is the only buildable area for the site and Mr. Pettinelli said yes.  Mr. Pettinelli showed the proposed area for the septic and well and said they are currently doing septic monitoring.  

Lynn Nichols, of Public Works, expressed her concern on truck safety and said there is no place to turn around if the trucks miss the driveway.  K. Metzler said a current truck stop in town had a 10,000 gallon oil spill and told the applicant the commission will be looking at their containment plan.  K. Metzler said potential for significant activity exists with the amount of oil and based on the history in town.  He suggested the applicant look at the file of the existing travel center in town.  

K. Metzler asked if the only proposed activity in the wetlands is excavation and the applicant said yes.  K. Metzler said they would like to see the filling station curbed.  T. Gutowski asked the applicant if they will have the vernal pool study completed by May 10th and Mr. Pettinelli said they should. D. Schreiber asked if the wetlands were flagged.  Mr. Pettinelli said they were but they will double check.  K. Metzler tentatively scheduled the site walk for May 8, 2010 and the Public Hearing for May 10, 2010.  G, Jones will confirm the dates.  A discussion was held on notifying the abutters.  

W2010-12 Application for water main extension between Senior Center Complex (60 Old Farms Road & Center School at 12 Old Farms Road (Map 17 Lot 1 & Map 22 Lot 53) Owner/Applicant: Town of Willington (Received April 12, 2010 Public Hearing by June 14, 2010 Decision within 65 days after close of P.H.)

Selectman Christina Mailhos was present.  D. Schreiber asked if the fire station will be hooked into the water extension.  Selectman Mailhos said it is part of the reason they are looking at doing this but it’s not part of the immediate plan and not part of the grant.  

The commission looked at the plans and a discussion was held on the piping. T. Gutowski asked if the plans were completed and Selectman Mailhos said she does not believe so; they have not had a formal presentation yet.  

Application was received.

Old Business

W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

Review of Integrated Contingency Plan for Travel Center of America at 327 Ruby Road.

T. Gutowski said she would like to know if Susan Yorgensen has read the plan.  G. Jones will try to get the plan on CD to distribute to the commission.  The commission will review the plan and discuss it next month.  A discussion was held on the spills over the past 2 years.  T. Gutowski asked if the Town Agents could do audits periodically.  A discussion was held on auditing the site and monitoring the detention and catch basins. K. Metzler said, if DEP has approved the plan, it may be the best they are going to get.  G. Jones will talk to S. Yorgensen.  K. Metzler said to take this item off the agenda if it is completed.

Minutes

D. Schreiber motioned to approve the minutes of with the following change on paragraph 3 of W2005-27; T. Gutowski make the timing adjustments on the plan based on discussion and the motion should read grant rather than grand.  T. Gutowski seconded the motion.  All in favor.  

Staff Report

G. Jones said, in regards to application W2010-9, no building permits were pulled and the original subdivision plan was approved for a common driveway only.  He asked the commission to take a look at the site.  K. Metzler asked staff to pull the minutes from the original subdivision plans.  

G. Jones said, at 22 Willington Hill, there are 2 wetland crossings.  He said he walked the site and the applicant wants to take out 200 trees.  G. Jones recommends, if approved, the work is done in the dry season.  

 A discussion was held on the site walks discussed earlier and K. Metzler asked G. Jones to email the commission with dates and times.
