Public Hearing

K. Metzler called the meeting to order at 7:32.

Regular Meeting

W2009-26 Application for replacement of culvert on Moose Meadow Rd .4 miles N of RT 74 Owner/Applicant:  Town of Willington (Received December 14, 2009 P.H. by February 18, 2010 Decision within 35 days after close of P.H.)

Lynn Nicholls and Christina Mailhos were present for the applicant.  Selectman Mailhos said the replacement came about in a sort of “quasi” emergency situation and needed to be resolved before they went too far into the winter.  Ms. Nicholls presented pictures to the commission and submitted them for the record.  Ms. Nicholls said the pipe was non-existent and explained the replacement.  

K. Metzler asked if the road was unsafe and Ms. Nicholls said yes, they closed the road for 3 days to complete the project and the project was finished within 2 days.  K. Metzler asked how long they knew about the project and Ms. Nicholls said 2 to 3 weeks; the road kept collapsing.

T. Gutowski asked if they have an inventory of roads where incidents could happen.  Ms. Nichols said yes, they have a list of approximately 25 roads.  

K. Metzler asked how the sedimentation and erosion control held out with the rain.  Ms. Nicholls said it worked well and showed the pictures regarding this.  

K. Metzler asked staff to look at the site.  

A discussion was held on the time frame of submitting an emergency situation application.  

This application has been continued until the next meeting.

Old Business

2009-21 Application for split of parcel into two lots and the construction of two single family homes, driveways and associated activity at the intersection, east side of Marsh Road & north side of Boston Tpke (Rte 44). (Map 6 Lot 10 Zone R80) Owner/Applicant: Jennifer & Michael Genesse (Received September 14, 2009 extension of 30 days granted.  Decision by Dec. 14, 2009)

Wes Wentworth, of Wentworth Civil Engineer in Lebanon, was present for the applicant.  Mr. Wentworth submitted the following documents for the record; Notice to Windham Waterworks, Notification to the Town of Ashford, and the Scientific Report from John Ianni.  Mr. Wentworth said the application was submitted to Karl Acimovic for review and referred to the comments Mr. Acimovic provided to S. Yorgensen on a memo.  He said they have added his recommendation of a CHDPE to the plans.  Mr. Wentworth said the driveway plans were submitted to S. Yorgensen and according to her feedback; they will add swale detail to the plans.  

K. Metzler said it seems all requested items have been addressed.   S. Yorgensen said they have to put Inlet Details on the plans.

A discussion was held on the driveway.  K. Metzler asked if there were signs of surface water and Mr. Wentworth said yes.

D. Schreiber motioned to approve the application with the following conditions; Jute detail to be included on note page and field fit during driveway construction to assure proper location within the natural flow path as noted in Highland Soils report (pg.3).   T. Gutowski seconded the motion.

K Metzler said the applicant did a reasonable job minimizing impact on the wetlands.  S. Yorgensen said they will need revised plans.  The commission would like to receive notification when the culvert is adequately placed.

All in favor of application.  Motion carried.

W2009-25 Application for Lot Split for proposed 3 bedroom house in upland review area at 22 Moose Meadow Rd (Map 21 Lot 7 Zone R80) Owner/Applicant: Earl & Martha Gledhill (Received October 26, 2009 Decision by Dec 14, 2009)

Mark Reynolds, a Civil Engineer, was present for the applicant.  He said the Health District has reviewed the application and is satisfied.  

Mr. Reynolds went over the plans showing the lot to be split and the delineated wetlands. He said the road is proposed at a 10% slope and paved.  He said they are proposing an 18 to 24 inch swale which will fill up with water and drain away.  K. Metzler asked what will happen when the ground is frozen.  Mr. Reynolds said it will fill up and sheet flow out.  He said they are trying to create a level spreader.  He said they would like to maintain drainage paths and promote infiltration.  K. Metzler said he in concerned about the soil infiltration.  Mr. Reynolds referred to the Zoning Regulations and said the #1 priority is to eliminate water crossing the street.  K. Metzler asked if they have done an analysis regarding the swale and Mr. Reynolds said yes, they are making it as wide as they can so that it acts as a level spreader.

A discussion was held on the plans.  Mr. Reynolds said when all is said and done, they have an impervious area of approximately 3000 square feet.  K. Metzler said he is worried about the capacity in the winter because there isn’t going to be infiltration.   Mr. Reynolds explained his calculations and said he felt comfortable that they are going to dissipate energy from run-off.   A brief discussion was held on the culvert near the property.   Mr. Reynolds said the current plan is a good compromise to shooting the water out into the road and/or creating a detention basin.  K. Metzler said his concern is to make sure the water does not go in the road.

K. Metzler said they would like K. Acimovic to look at the plans which would require an extension.  The applicant gave the extension, in writing, until the next meeting.  K. Metzler would like staff to look at the plans and would like the applicant to include sedimentation and erosion control along the entire area in the plans.

W2003-49 Notice of violation:  TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property location at 327 Ruby Road.

This application was tabled.

D. Schreiber motioned to approve the minutes of October 26, 2009.  T. Gutowski seconded the motion.  All in favor.  Motion carried.

Staff Report & Discussion

Evan Brand was present and expressed his interest in serving on the Inland Wetland Commission.  A discussion was held.  The commission will be notifying Mr. Brand.

A discussion was held on the Forestry Regulations.  S. Yorgensen said the town could authorize the Inland Wetland Commission to be the regulatory agency of the Forestry Regulations at a Town Meeting.  A discussion was held.  The commission would like to look at the Public Record regarding the Forestry Regulations.  K. Metzler said the regulations would take a lot of revision and he does not feel the commission should take this on.  

A discussion was held with Selectman Mailhos regarding the Town applications.  T. Gutowski said the town needs to make timely admissions of all their applications. She said they expect the same level of response from the town as they do all other applicants.  Selectman Mailhos said they have an inventory of the road problems but it does not address culverts.  She said she will have them added.  A discussion was held
