Public Hearing

K. Metzler called the meeting to order at 7:47.

T. Gutowski motioned to seat G. Blessing.  All in favor.  

New Business

2009-21 Application for split of parcel into two lots and the construction of two single family homes, driveways and associated activity at the intersection, east side of Marsh Road & north side of Boston Tpke (Rte 44). (Map 6 Lot 10 Zone R80) Owner/Applicant: Jennifer & Michael Genesse (Received September 14, 2009 Public Hearing by Nov 9, 2009 Decision within 35 days after close of P.H.)

G. Jones said he spoke to the applicant earlier in the day and they were not prepared at this time.  

T. Motioned to table this application until the October 26, 2009 meeting.  G. Blessing seconded the motion.  All in favor.  

Old Business

W2009-16 Application to remove existing bridge deck and upper portion of existing abutment walls. Construct new concrete abutment, new steel bridge and related road and site work. Location Ketchkes Road approx. 650’ west of Moose Meadow Road Owner/Applicant Town of Willington (Public Hearing on July 27, 2009. 65 days extension requested and approved, decision by Oct. 26, 2009)

The Commission received a copy of an email from Brian Murphy of the CT DEP Inland Fisheries division stating he has no issues with the project.  This was marked as exhibit #7.  K. Metzler said this completes all information requested of the applicant.  T. Gutowski clarified the application is for the bridge, only

T. Gutowski motioned to approve application W2009-16.  G. Blessing seconded the motion.  

K. Metzler said the project seems reasonable and will not impact he environment.

All in favor.  Motion carried.

W2003-49 Notice of Violation:  TravelCenters of America and George Giguere of Royce Properties of property located at 327 Ruby Road

A brief discussion was held on the Storm Water Pollution Prevention Plan.  T. Gutowski said it should be received by January 2010.  The commission agreed to keep this notice on the agenda.

Correspondence

1.  Plans of the Town Bridge and Road Projects

A discussion was held on the current and future town projects.  The commission thanked the Board of Selectmen for the maps and requested a schedule on the work to be done.  

2.  State of Connecticut Siting Council notice of Yougheogheny Communications – Northeast to modify an existing telecommunications facility located at Tpke Rd.

T. Gutowski motioned to approve the minutes of September 14, 2009.  G. Blessing seconded the motion.  All in favor

Staff Report and Discussion

A discussion was held on the timing of applications submitted by the town including past and present projects that have not come before the commission as required.  

A discussion was held on the Access Road Improvement for Kechkes Rd Reconstruction Project that was not submitted to the commission prior to this meeting.  

Karl Acimovic was present and presented plans showing the flagged wetlands.  A discussion was held on the permits required.  Mr. Acimovic said they now have an easement agreement. K. Metzler said the only activity proposed in the regulated area is grading.  G. Blessing asked if the corner will be taken out when the project is finished and Mr. Acimovic said he does not believe so.  A discussion was held on the road owner and condition of the road.

Mr. Acimovic said Ms. Becker requested gates be installed as part of the easement agreement and the owner will maintain the gates.  A brief discussion was held.

Mr. Acimovic said the campground closes October 12 and the town would like to start the project October 13th.  A discussion was held on the timing of the project and the town’s failure to submit the application in a timely fashion in order to meet the project timelines.  The town will now submit the application following this meeting and would like the application reviewed and approved prior to the next scheduled meeting.  The commission has agreed to remand this application to staff but is very unhappy with this process and the fact that this is an ongoing problem.  

A discussion was held on future projects and applications that may come before the commission.
