K. Metzler called the meeting to order at 7:35 PM.

New Business

File #W2007-15 Application for modification of W2005-06 I. W.C. approval stipulated applicant to modify permit for final design of Kucko Road improvements 22 Kucko Road (Map 42 Lot 8-1) Owner: Raymond Crossen Applicant: R. F. Crossen Contractors, LLC Received June 11, 2007 Public Hearing or Decision by July 23, 2007.

Attorney Allison Keen was present to discuss the application.  She stated that they are presenting a modification of and existing wetlands permit.  She stated that the condition of the original permit was that the applicant would return to the wetlands committed once final plans were completed.  Ms. Keen stated that the final plans for the project were created through a legal settlement between Ray Crossen and Planning and Zoning Commission.  

Eric Peterson was present to discuss the modifications to the original plan.  He explained that Kucko road is being paved to meet the current paved road; new catch basins are being put in the road as well.  He explained how the water will flow and where it will enter the catch basins.  
K. Metzler asked if the catch basins were designed to collect increase flow of water if Kucko Road is paved.  Mr. Peterson said that they were, but the plan that they created will bring the flow to a zero or less then zero increase.  
D. Schreiber asked if there is an easement for the new culvert on Kucko Road.  Mr. Peterson said that there is not, that the town would need to request one from the landowner.  

R. Peloquin asked Mr. Peterson if they are asking for approval for the work that the town will need to do in the future.  Mr. Peterson said they are just seeking approval for the section the applicant will be doing, but when all the calculations were done they considered both sections.  

G. Blessing asked if the zero increase was calculated considering both the applicants project and the future town project.  Mr. Peterson said that everything was done with both projects in mind.  

Mr. Peterson asked for a letter to be submitted into the record, he read the letter to the commission, which stated what has and has not changed on the site plan from the original approval.  He stated that there is no additional activity in the regulated area.  

K. Metzler asked Mr. Peterson to summarize the wetland activity on lots two and three.  Mr. Peterson stated that it is typical work associated with building a house such as a foundation drain.  

T. Gutowski asked if there is a shared driveway in the sub-division.  Mr. Peterson said that there is none, that the long road goes into Mr. Crossens driveway.  

G. Blessing asked if Mr. Acimovic went over the drainage calculations.  Mr. Peterson said that he had.  
K. Metzler stated that based on Mr. Acimovic’s comments the commission should treat this as a modification.  D. Schreiber agreed.  

G. Blessing asked where drainage from Kucko Road goes.  He stated that he is concerned about the large amount of sediment, especially during storm events that appears on that road.  He stated that there is an existing high point and low point on Kucko Road and due to that is concerned that the run off will not make it to the culvert.  

Mr. Peterson showed the commission a cross section of the road and explained where the run off would go.  

K. Metzler read the original approval to the commission.  

D. Schreiber made a motion to consider File #W2007-15 Application for modification of W2005-06 I. W.C. approval stipulated applicant to modify permit for final design of Kucko Road improvements 22 Kucko Road (Map 42 Lot 8-1) Owner: Raymond Crossen Applicant: R. F. Crossen Contractors, LLC a modification.
G. Blessing seconded the motion.  All members voted in favor.  

T. Gutowski stated that she feels that this plan is an improved design over the original one.  

D. Schreiber made a motion to approve File #W2007-15 Application for modification of W2005-06 I. W.C. approval stipulated applicant to modify permit for final design of Kucko Road improvements 22 Kucko Road (Map 42 Lot 8-1) Owner: Raymond Crossen Applicant: R. F. Crossen Contractors, LLC.   With the condition that the Town of Willington come to the IWWC for approval before they do any work, so the commission can evaluate the entire road, including the potential for future development, not just the portion that the town will be working on.  
F. Dirrigl seconded the motion.  All members voted in favor.

File W2007-16 Application for modification of W2005-13 approved subdivision plan include: the reduction of one house lot with modifications to the associated site improvements and drainage design to ledge on the property.  150 Clint Eldredge Road (Map 12, Lot 20) Owner/Applicant: CE Road, LLC Received June 11, 2007.  Public Hearing or Decision by July 23, 2007.

Tim Gosselin was present to discuss the application.  He stated that he is proposing six development lots on the property and currently there is one existing house already on the property.  He passed out the originally approved plans as well as the new updated plan.  Mr. Gosselin discussed the proposed conservation easement for the property.  He stated that the water currently flows into the street not into the wetlands on the property.  He explained that there would be a zero increase of runoff from the property.  

Mr. Gosselin said that he changed one of the driveways to be a common drive through discussion with the Planning and Zoning Commission as they both felt that would make more sense in the area.  

K. Metzler asked Mr. Gosselin to summarize the activity that will occur in the wetlands.  Mr. Gosselin said that there would only be limited activity in the regulated area and none in the wetlands themselves.  

G. Blessing stated that there seems to be less activity in the regulated area on the new plans compared to the old plans.  

The commission discussed the easement that the applicant will get for the cross culvert in favor of the town.  

G. Blessing made a motion to approve File W2007-16 Application for modifications of W2005-13 approved subdivision plan include: the reduction of one house lot with modifications to the associated site improvements and drainage design to ledge on the property.
D. Schreiber seconded the motion, all voted in favor.


File W2007-18- Application for 327 Ruby Road (Map 42, Lot 45, Zone DI)  Owner: Royce Properties, LLC Applicant: Travel Centers of America.  Received June 11, 2007.  Public Hearing or Decision by July 23, 2007.

The commission members stated that the set site walk did not occur.  K. Metzler read the proposed plan to the commission members.  T. Gutowski stated that she is concerned about the maintenance, specifically the standard operating procedure.  K. Metzler stated that he was not sure if that fell under the IWWC jurisdiction.  

The commission discussed the new design of the holding tank, burm, and alarm system.  The commission discussed that the DEP had already approved the Travel Centers plan.  R. Peloquin asked what happens if a person working at the TA turns off the alarm and the next day a spill occurs before the tank has been pumped out.  

F. Dirrigl made a motion to approve File W2007-18- Application for 327 Ruby Road (Map 42, Lot 45, Zone DI)  Owner: Royce Properties, LLC Applicant: Travel Centers of America with the following conditions
1.  The commission receives a copy of the operation and maintenance plan
2.  The commission receives a copy of the SPCC Plan
3. The booms be removed a replaced in the detention basin

G. Blessing seconded the motion, all members voted in favor

G. Blessing asked if the water sampling that is being done around the TA is efficient, he stated that he was concerned if any sampling was being done by the outfall.  F. Dirrigl stated that REMA did the original sampling at the discharge point.  
G. Jones told the commission what he has observed when he has gone to visit the TA for monitoring.  T. Gutowski stated that she is concerned with what she saw in the pictures presented to the commission last week.  She stated that she is wondering why the sampling is being done so far down stream.

W2007-19 Application to build a Veterinary Hospital and a post & beam model home at 451 River Road (Map 34 Lot 6)  Owner/Applicant: Jeff and Teresa Love.  Received July 9, 2007.  Public Hearing or decision by Sept. 12, 2007.

File was received today and applicant has not completed plans.

Old Business

Review of Operation and Maintenance for Storm Water Systems at Town Library at 7 Ruby Road

No new information was presented to the commission.
T. Gutowski suggested petitioning the Board of Selectman to pay for a report to be completed.  She suggested the commission writing a letter and ccing the library board.

G. Blessing made a motion to approve the minutes; T. Gutowski seconded the motion, all members voted in favor.

Staff Report and Discussion

The commission stated that they would like to discuss the Clover Spring Sub-division.  G. Jones stated that S. Yorgensen had spoken to Mark Branse, who decided that if the work is not complete by a certain date the bonds will be pulled.  The commission stated that they need a report as to what is happening with the property.  The commission asked the staff to take inventory as to what needs to be done and to find out how much it will cost to complete the work.  The commission also said that they need to know how much the bond is so they will know what work it will cover.  

F. Dirrigl asked if pictures should be taken before the bond is pulled.  G. Jones suggested asking Mark Branse.  

The commission discussed the Travel Center violation.  The commission stated that they would like the oil soaked booms to be removed.  G. Blessing asked how plans would be audited at the TA.  The commission stated that they would need to monitor how the TA is training their employees and if it is on going.  

L. K made a motion to adjourn at 9:09 PM, G. Blessing seconded the motion.   Unanimous.
